EXECUTIVE SUMMARY
Recommendation to approve a grant application for the FY 2010 Adult Drug Court
Discretionary Grant Program in the amount of (approximately) $200,000 over two years
from the United States Department of Justice, Bureau of Justice Assistance. If awarded,
request authorization to serve as the Fiscal Agent and to authorize the County Manager or
his designee to negotiate a contract with the Drug Court treatment provider, David
Lawrence Center, as a sub-recipient of the award. No general fund dollars will be used for
this grant initiative.
OBJECTIVE: For the Board of County Commissioners to approve the submittal of a grant
application, that if awarded, will allow the Collier County Adult Drug Court program to enhance
its existing services according to the National best practice standards. Research shows that Drug
Courts that follow the best practice model can effectively treat non-violent offenders with drug
addiction problems and reduce recidivism,
CONSIDERATIONS: The Collier County Drug Court program has been in operation since
1999, with 35 people enrolled in the program at any given time, Statistics show that only 18% of
past Drug Court graduates were rearrested as compared to a 40% re-arrest rate for those who
did not complete the program, Although the program has been successful and program managers
have adjusted well by maintaining the level of service even when presented with funding
restrictions, several areas of needed enhancement have been identified.
The United States Department of Justice, Drug Court Discretionary Grant Program provides
funding resources to local courts to establish or enhance drug courts and systems for nonviolent
substance-abusing offenders. The proposed enhancements will follow recommendations included
in the Florida Adult Drug Court Toolkit: Recommended Practices. as well as Defining Drug
Courts: The Key Components developed by the National Drug Courts Program Office.
For enhancement projects, the maximum grant award is $200,000 and the project period is 24
months, Federal funds may not cover more than 75 percent of the total cost of the project and
the remaining 25 percent may be comprised of cash or in-kind contributions, Applicants for this
Drug Court grant are limited to states, state and local courts, counties, units of local government
and federally-recognized Indian tribal governments, Housing and Human Services offers the
expertise needed to manage this fcderal grant successfully, It is anticipated that the matching
funds will be comprised of $66,667 from participant fees and in kind office space for Drug Court
staff,
The initiative will enhance the collaboration of the Drug Court Team including Judge Grieder,
the David Lawrence Center, Court Administration, the State's Attorney, Public Defender's
Office, and the Sheriffs Office Department of Corrections. Collier County will serve as the
fiscal agent and the Housing and Human Services Department will manage the grant.

If awarded, the grant agreement and associated sub-recipient award will be brought to the Board
of County Commissioners for approval and signature, As Fiscal Entity for the grant, Collier
County will be responsible for ensuring compliance with the programmatic and financial
reporting requirements of the United States Department of Justice, The sub award contract will
include requirements for the contractor to provide information as needed for these reports. The
award will include the need to create a sole source subrecipient award contract with the David
Lawrence Center, David Lawrence Center is the only comprehensive publicly funded substance
abuse agency in Collier County, They are the only treatment provider with the Drug Court Team,
Sole source justification in included in the grant proposal.
The grant proposal includes funding requests for 1) case management/court coordination, 2)
improved participant drug testing ability, 3) participant incentives for compliance, and 4) training
for the Drug Court Team, Each of the enhancements will allow the Drug Court to better comply
with National best practice standards,
FISCAL IMPACT: The grant application is for approximately $200,000, If awarded, Collier
County and the partners will be required to provide a match equal to $25% of the total project
cost of $266,667. It is anticipated that the matching funds will be comprised of $66,667 from
participant fees and in kind office space for Drug Court staff. The enhancements will improve
the Drug Court's ability to successfully rehabilitate participants, Doing so will reduce criminal
recidivism in the population, ultimately lowering court and jail costs, and improving the overall
life in the community, There will be no general fund dollars used for this grant.
GROWTH MANAGEMENT IMPACT: There is no growth management impact due to this
request.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office
and is legally sufficient for Board action, - CMG
RECOMMENDATION: That the Board of County Commissioners approves a grant
application to the Bureau of Justice Assistance for the FY 20] 0 Adult Drug Court Discretionary
Grant Program in the amount of $200,000 and authorizes staff to electronically submit the
application. If awarded, the Board of County Commissioners authorizes the Housing and
Human Services Department to serve as the Fiscal Agent and to authorize the County Manager
or his designee to negotiate a sub-recipient agreement with the David Lawrence Center to be
approved and signed by the Board,

Collier County is requesting Drug Court Discretionary Grant Program funds in
the amount of $200,000 to enhance its adult drug court to better assist nonviolent felony
offenders with drug and alcohol rehabilitation, The goals are improve the Drug Court
program to increase the likelihood of participants' ,successful completion of treatment and
improved opportunities for productive lives in the community, The funds will provide a)
enhanced drug testing, b) case management services, and c) incentives

Statement ofthe Problem
The Mission of the Collier County (FL) Adult Felony Drug Court is:
Changing and saving lives through honesty, personal responsibility and recovery.
The Collier County Adult Drug Court forges continuing partnerships with the
court, treatment providers, social service agencies, and law enforcement. Leveraging the
partnership and its authority, the court directs substance-abusing offenders into
evaluation and treatment to achieve personal responsibility and to help them to become
productive members of society, The drug court focuses on the individual adult offender
charged with non-violent felony drug or drug related charges, including violations of
probation, The goal is to teach substance abusers how to get off drugs and alcohol, and
how to get into and stay in recovery, Another goal is to stop substance abusers from
committing new crimes and going to jail. This program will improve their lives by
reuniting them with their families and helping them to become productive members of
society,
Current Operations
The Drug Court program is a post adjudication, court supervised, comprehensive
treatment program for non-violent defendants, The program, which has been in operation
since 1999, is a collaborative effort of the Drug Court Team, The original team members,
some of whom are still involved in the Drug Court, participated in Drug Court Planning
Initative trainings in 1998 and in 2001. Members of the team include the State's
Attorney's Office, the Public Defender's Office, Court Administration, the Department of

comprehensive substance abuse and mental health services provider,
Target population. The target population of the Collier County Drug Court
includes adult offenders who have been charged with a non-violent felony or drug-related
charge and for whom drug abuse or addition is one of the motivating factors in the
commission of the crime.
Screening. Referrals to the Drug Court cOl11e from the State Attorney's Office,
Public Defender's Office, private attorneys, treatrrient providers, family members and the
Department of Corrections, Once referred: the Defendant is screened by a David
Lawrence Center Certified Addictions Professional (CAP) to confirm that they are
appropriate for the program, The substance abuse assessment, CAP completes a
substance abuse assessment, including the Addiction~everity I~1ex (ASI) to determine
the nature and the history of the substance abuse problem. The assessment explores the
extent to which chemical dependency is a major factor in the person's life, the motivation
to change, and the capacity to follow through with rules and sanctions of the Court, The
assessor applies ASAM (American Society of Addictions Medicine) criteria to determine
the level of treatment best suited to the individual's needs, The State Attorney's Office
reviews the screening recomIllendations, along with the booking report and criminal
history record, and makes the fmal determination for acceptance into the program,
Exclusionary criteria at this point may include a DUI charge, habitual offender status, or
drug trafficking charges.
Structure and length.. The structure of the court involves a special court docket in
which only drug court cases are heard at the same time and day each week.

collectively sign a Drug Court Contract that states that the defendant agrees to enter a
plea of nolo contender with a suspended sentence, Upon successful completion of the
Drug Court, the defendant is allowed to withdraw the previously entered plea and the
State's Attorney will dismiss the charges,
Once accepted into the program, the Defendant begins one of four phases of
treatment. The defendant reports for regular court appearances and his or her progress is
discussed with the Drug Court Team and the Drug Court Judge, Defendants are placed on
two (2) years Drug Offender Probation, a requirement of which is an extensive treatment
program lasting a minimum ofthe first twelve months of probation, A Defendant's
successful completion of the program may avoid convictions on their record depending
on the status of their case at the time they entered the program. A Defendant attends Drug
Court regularly where their progress is discussed with the entire Drug Court Team,
including the Judge, Advancement through the phases depends upon results of the drug
tests, attendance records for counseling, twelve-step meetings, and commitment to
leading a drug-free life,
The fmal phase also requires attainment of gainful employment or involvement in
a vocational/academic training program, Recently, requirements for employment are less
of a priority due to the economic climate and high unemployment rates, The program
length is determined by each participant's progress, but is no less than one year.

Judicial supervision. Each person admitted to Drug Court is required to attend
court appearances for direct judicial supervision weekly, or
other week. The Judge
reviews progress repots on each participant regarding progress in treatment, including
abstinence from drugs and alcohol.. Supervision alsq includes mandatory reporting to an
assigned probation officer, unannounced home visits, and random drug screenings
Community supervision, Probation activities include
Drug testing. , Drug testing is completed by the substance abuse counseling staff
twice monthly at group therapy sessions, Lab analysis is completed on a regular basis as
tests are done, Results are communicated to the treatment provider immediately and to

the Drug Court Team each week at which time sanctions are discussed for any relapse
issues.
Case management. Each of the treatment phases include case management
activities, currently coordinated by the treatment staff as time allows, Each phase also
includes ongoing review of the treatment plan, recreation/fellowship, and montWy
reporting to the probation officer,
Costs to participants. Participants are required to pay for treatment costs based on
their ability to pay, Community service is sometimes offered in lieu of payment.

program may lead to one or more of the following sanctions: increased drug testing, court
appearances, cOWlseling or 12-step meetings; writing an essay on a Drug Court-related
topic; return to an earlier phase of treatment; commWlity service; commitment to
residential treatment; added special conditions of probation; or incarceration,

Drug Court expansion is a priority for local stakeholders including members of the
Public Safety Coordinating Council. The Council recently approved convening a new
group, the Criminal Justice, Mental Health and Substance Abuse Adviso!)' Council to
begin the process of creating a local strategic plan specifically for diversion programs,
including Drug Court. The group will use the Sequential Intercept Mapping process to
define the current system and target specific areas for improved diversion activities, In
the meantime, the enhancement activities proposed will help to fill some obvious gaps in
the local Drug Court operations, Also, while the Collier County Drug Court has been
active, successful, and growing for more than 10 years, there has not been any new

Describe how the process evaluation will help the drug court assess the effectiveness of
its operations and its ability to meet its goals and objectives, and how the findings could be used
to change and improve the court's operations.
Describe the specific data elements to be collected and analyzed for the process evaluation and
how these data will be used for program operation and management.
Outcome evaluation.
Describe how the outcome evaluation will help the drug court assess the effectiveness of its
operations, and how the findings could be used to change and improve the court's operations,
Describe the plan for collecting data on rearrest, reconviction, and re-incarceration for 1 year
following drug court completion or dropout. If available, provide the identification of sources of
data for other post program outcomes such as drug use, employment and earnings, health care,
and drug treatment participation.
Identify and justify a comparison group for measuring the relative change in postprogram
recidivism outcome measures. The comparison group should be as similar as possible to
the drug court participants, Indicate what variables will be used, either to match drug
court participants to comparison subjects, or to balance the samples statistically for
analysis. Indicate how the evaluation will identify and control other potential matching
variables or covariates,
Capabilities and Competencies
Identify each drug court team member roles, responsibilities, and qualifications.
Identify personnel other than team members who are critical to the enhancement project's
successful implementation and discuss their roles, responsibilities and qualifications,
Discuss organizational capabilities or competencies that will directly impact the ability to
