EXECUTIVE SUMMARY Recommendation to approve conveyance, execution and acceptance of a Utility Easement and Utility Facility Warranty Deed and Bill of Sale to the Collier County Water -Sewer District for the water and wastewater utilities at the North Collier Recycling Drop-off Center, and approve execution of a Corrective Easement to Florida Power and Light, at a cost not to exceed- $166. OBJECTIVE: To obtain approval from the Board of County Commissioners of Collier County, Florida (Board) to: 1) execute and convey a Utility Easement, and a Utility Facility Warranty Deed and Bill of Sale (Bill of Sale) from Collier County, a political subdivision of the State of Florida (County) to the Collier County Water -Sewer District (CCWSD) for water and wastewater utility purposes; 2) accept the Utility Easement by the CCWSD for the water and wastewater utilities in the County's property at the North Collier Recycling Drop -off Center ( NCRDC); and 3) execute a Corrective Easement to Florida Power and Light (FP&L). CONSIDERATIONS: The Board, at their October 26, 2010, meeting approved Agenda Item 10E authorizing the award of Bid No. 10 -5594 for the construction of the NCRDC. A Utility Easement to the CCWSD for the water and wastewater utilities including, but not limited to, lines, pipes and valves, installed within the Utility Easement area, is required to provide: a) an area for the water and wastewater lines to connect the NCRDC to the water and wastewater mains; b) for access to allow for maintenance of the water and wastewater utilities; and c) for future installation, as needed. The Utility Easement area measures a total of approximately 1,698 square feet, and is shown and described on Exhibits "A" and `B" to the Utility Easement. The construction of the NCRDC is complete and preliminary acceptance of the water and wastewater utilities has been issued by the County's Growth Management Division (GMD). A copy is attached. A Bill of Sale to the CCWSD for the water and wastewater utilities including, but not limited to, water and wastewater lines, pipes and valves installed within the Utility Easement area is required to convey ownership at the time of final acceptance for ongoing and continued maintenance of water and wastewater utilities and future installation, as needed. The County's GMD will . process the final utility conveyance acceptance per the Utility Ordinance and a copy of the recorded Bill of Sale should be delivered to GMD for that process. The recording of this Bill of Sale does not constitute final acceptance. A location map identifying the location of the water and wastewater utilities subject to these documents is attached for reference. The Board, at their April 12, 2011, meeting approved Agenda Item 16C3 approving an Easement to FP &L for the installation of service lines outside of the right -of -way along Goodlette -Frank Road within the County's and the CCWSD's property to provide electricity to the NCRDC. During the course of installation of that service line, FP &L determined that both a variation to the design and additional easement area would be required. Accordingly, a correction to the previous Easement to reflect the change in the legal description and sketch, as well as to correct a scrivener's error, is required. A location map identifying the location of the FP &L line is attached for reference. The attached Utility Easement, Bill of Sale and Connective Easement have been reviewed and approved by the County Attorney's Office and the Public Utilities Division. FISCAL ACT: The total cost for recording the Utility Easement, Bill of Sale and Corrective Easement will. not exceed $166. Funds in the amount of $166 are available in the Solid Waste Capital Improvement fund 474 under Project No. 70013. GR(}WTH MAnGE MENT IMPACT: There is no impact to the Growth Management Plan. This item requires a majority vote for approval. -JBW RECOMMENDATION: That the Board 1. approve the attached Utility Easement, Bill of Sale and Corrective Easement; 2. authorize the Chairman to execute the Utility Easement, Bill of Sale and Corrective Easement; 3. accept the attached Utility Easement in its capacity as the ex- officio governing board of the CCWSD; 4. direct the County Manager or his designee to proceed to record the Utility Easement, Bill of Sale and Corrective Easement in the Public Records of Collier County, Florida; and, 5. direct the County Manager or his designee to proceed to deliver the Bill of Sale to the Growth Management Division to be held for further processing at the time of final acceptance of the water and wastewater utilities.
