EXECUTIVE SUMMARY
Appointment of member(s) to the Immokalee Enterprise Zone Development Agency
OBJECTIVE: To appoint 1 member to fulfill a term that will expire on April 4, 2013, to the
Immokalee Enterprise Zone Development Agency.
CONSIDERATIONS: The Immokalee Enterprise Zone Development Agency has 1 vacancy
for a term to expire on April 4, 2013. This 13 member committee was created on March 28,
1995, by Ordinance 95 -22 to induce private investment into distressed areas to create economic
opportunities and sustainable economic development for designated areas. To permit Collier
County to participate in this program, the Board of County Commissioners nominated the
Immokalee Community to be considered by the Florida Department of Commerce for Enterprise
Zone designation in Resolution No. 95 -248, approved March 28, 1995. As part of the formal
application for an Enterprise Zone, the State required that a committee: consisting of a broad base
of citizens be .established. The committee has representation from the Immokalee Chamber of
Commerce, financial or insurance entities, businesses operating within the nominated area,
residents living within the nominated area, nonprofit community -based organizations operating
within the nominated area, local Workforce Development Board, local code enforcement agency,
and local law enforcement agency. This committee also serves as the Immokalee
redevelopment Board. A list of the current membership is included in the backup.
Melissa Martinez could not meet the attendance requirements of Ordinance- 2001 -91 and a
vacancy was declared. A press release was issued and 1 resume was received from the following
interested citizen:

The CRA in Immokalee received your memo dated November 8, 2011 wherein you stated
that you required a response from the CRA Advisory Committee/EZDA Agency within a
41 day time frame. The Committee will not meet until December 21, 2011. In that same
correspondence, the CRA/EZDA received one application for the one vacancy on the CRA
Advisory Board and the Immokalee Enterprise Zone Agency Board.
Therefore, I sent an email to the Committee requesting a vote for a recommendation to the
CRA/BCC that Angel Madera, 1025 West Main Street, Immokalee, Fl 3414 be appointed
to the vacant position on the Committee. Mr. Madera represents a Business Owner in the
Zone.
The 13 member CRA/EZDA responded as follows: eleven (11) members voted "yes" to
recommend the following applicants to the Collier County Community Redevelopment
Agency Board for appointment to the CRA Advisory Committee and the EZDA Board; one
(1) member voted "no" and one (1) member was out of town. The "yes" votes represented
a majority of the CRA/EZDA. Please forward the recommendation of the Advisory
Committee to the Community Redevelopment Agency Board.

In Resolution 2001 -29 the CRA Bylaws, Section 10. Attendance, Removal, and Resignation
reads as follows:
"Any advisory board member who is absent for more than two - thirds of the advisory board's
meetings in a given fiscal year shall be deemed to have tendered his or her resignation from
the advisory board. The CRA shall, as soon as practicable after such resignation, declare the
position vacant and shall promptly fill the position. The affected advisory board member shall
not serve at any meeting after his or her position is declared vacant by the CRA."
An Advisory Board member, Ms. Melissa Martinez, has missed eight meetings of the CRA Advisory
Board, she did not advise staff that she would be absent and was therefore counted as an unexcused n
absence. Please see the CRA Advisory Committee FY 2010 -11 Attendance Log attached. According
to the Bylaws, as quoted above and attached to this memo, she shall be deemed to have tendered her
resignation.
The CRA/EZDA met on September 21, 2011 and voted unanimously to recommend to the CRA that
the position be declared vacant and to recommend to the CRA that the position be filled promptly.
The September Minutes are here attached.
Please forward the recommendation of the Advisory Committee to the Community Redevelopment
Agency Board and advertise the position upon the declaration by the CRA.
