Recommendation to approve and authorize the Chairman to sign a modification to Dieter
Recovery Initiative Agreement #10DB- D4- 09- 21 -01 -KO9 between the Florida Department
of Community Affairs (DCA) and Collier County to extend the period of the grant and
update project work plans.
OBJECTIVE: To approve and authorize the Chairman to sign a modification to Disaster
Recovery Initiative (DRI) Agreement #IODB- D4-09- 21- O1 -K09 between the Florida Deparhnent
of Community Affairs (DCA) and Collier County.
CONSIDERATIONS: On May 25, 2010, item 16D 10, the Board of County Commissioners
accepted a federally - funded disaster recovery agreement with the DCA involving five (5)
hurricane hardening projects. The original agreement was modified on July 26, 2011, item
161313 reducing the number of projects to four (4). A modification to the grant agreement is
needed to extend the period of the grant by six (6) months. This modification to the grant
agreement includes an update of associated work plans for each project.
This extension is necessary to procure the major contracts under the sub - recipient agreements
which has taken longer than expected because extensive efforts were. undertaken to assure
compliance with HUD Section 3 requirements. Completion dates for these projects are expected
to extend past the current expiration date of the grant (June 21, 2012). A six (6) month extension
of the grant agreement will extend the grant period through December 21, 2012. The additional
n time will allow for execution of construction contracts, completion of the funded projects and
grant close out activities. Date extensions are allowable under the grant, but requires BCC
approval first prior to DCA execution. Once the modification is executed by the DCA, the
affected subrecipient agreements will be brought back before the BCC for consideration of date
extensions to December 21, 2012.
FISCAL ACT: Approval of this modification to grant agreement will have no additional
effect on ad valorem or general fund dollars. Disaster Recovery Initiative grant funds are
available within the Housing Grants Fund (705).
_GROWTH MANAGEMENT E"ACT: Implementation of DRI will help facilitate efforts to
meet the goals, objectives and policies set forth in the Housing Element of the Growth
Management Plan.
LEGAL CONSIDE TIONS: This item is legally sufficient and requires a majority vote for
Board action. -JBW

MODIFICATION NUMBER 2 TO GRANT AGREEMENT BETWEEN
THE DEPARTMENT OF COMMUNITY AFFAIRS AND
Collier County
This Modification is made and entered into by and between the State of Florida,
Department of Community Affairs, (the Department "), and Collier County, (the
Recipient "), to modify DCA Contract Number l ODB- D4- 09- 21- 01 -KO9, award dated
June 22, 2010, ( "the Agreement ").
WHEREAS, the Department and the Recipient entered into the Agreement,
pursuant to which the Department provided a grant of $9,963,208 to Recipient under the
Community Development Block Grant/Disaster Recovery Program ( "CDBG/DRI ")
Program as set forth in the Agreement;
WHEREAS, the Department and the Recipient desire to modify the Agreement;
NOW, THEREFORE, in consideration of the mutual promises of the parties
contained herein, the parties agree as follows:
o Reinstate Agreement
1. The Agreement is hereby reinstated as though it had not expired.
X Extend Agreement
2. Paragraph 3, Period of Agreement is hereby revised to reflect an ending date
of December 21, 2012.
X Revise Activity Work Plan
3. The Attachment B, Activity Work Plan section of the Agreement is hereby
deleted and is replaced by the revised Attachment B, Activity Work Plan
section, which is attached hereto and incorporated herein by reference.
o Revise Program Budget and Scope of Work
4. The Attachment A, Program Budget and Scope of Work section of the
Agreement is hereby deleted and is replaced by the revised Attachment A, the
Program Budget and Scope of Work, which is attached hereto and
incorporated herein by reference.

provisions and caveats that meet or exceed the conditions agreed to in the
Participating Party Agreement between the Recipient and the original
Participating Party.

6. The Attachment A, Program Budget and Scope of Work section of the
Agreement is hereby deleted and is replaced by the revised Attachment A, the

deleted and is replaced by the revised Attachment B, Activity Work Plan
section, which is attached hereto and incorporated herein by reference.

8. The Attachment A, Program Budget and Scope of Work section of the
Agreement is hereby deleted and is replaced by the revised Attachment A, the
Program Budget and Scope of Work, which is attached hereto and
incorporated herein by reference.
o Modify Additional Special Conditions in Original Contract
9. The Attachment J, Special Conditions section of the Agreement is hereby
amended to include additional grant requirements, and is attached hereto and
incorporated herein by reference.
All provisions of the Agreement and any attachments thereto in conflict with this
Modification shall be and are hereby changed to conform to this Modification, effective
as of the date of the execution of this Modification by both parties.
All provisions not in conflict with this Modification remain in full force and
effect, and are to be performed at the level specified in the Agreement.
