n EXECUTIVE SUMMARY
Recommendation to approve, execute, and accept an Utility Easement to the
Collier County Water -Sewer District for The Golisano Children's Museum of
Naples, Inc.'s water utility facilities located at North Collier Regional Park, at no
cost to the County.
OBJECTIVE: To obtain approval from the Board of County Commissioners (Board) to:
1) convey an easement to the Collier County Water -Sewer District (CCWSD) for water
utility purposes required to connect the parcel leased by The Golisano Children's
Museum of Naples, Inc. (CMON) to the water main within the North Collier Regional
Park; and 2) accept the easement on behalf of the Collier County Water -Sewer District
(CCWSD).
CONSIDERATION: On June 20, 2006, Agenda Item 16131, approval was given by the
Board to convey an easement to the CCWSD for the water and wastewater utility
facilities within the road areas of North Collier Regional Park (NCRP). On April 26,
2011, approval was given by the Board to convey all water utility infrastructure to the
CCWSD by a Utility Facility Warranty Deed and Bill of Sale for service and maintenance
of the facilities _within all County Utility Easement areas within the NCRP. Subsequently,
during. the construction of CMON it was necessary to tap the water main and install a
water line from the main to the meter assembly for the parcel leased by CMON at
NCRP. CMON will process the appropriate documents to convey that infrastructure to
the CCWSD. However, since Collier County (County) has fee ownership of the
underlying property, it is necessary for the County to grant the easement to the
CCWSD. Pursuant to the lease between the County and CMON, as amended, the
costs associated with this process shall be bome by CMON.
FISCAL IMPACT: The cost for recording the Utility Easement shall be paid by CMON.
GROWTH MANAGEMENT IMPACT: NCRP is inventoried in the Collier County Growth
Management Plan. The conveyance of these facilities is consistent with the Growth
Management Plan.
LEGAL CONSIDERATIONS: The attached Utility Easement has been approved for
form and legal sufficiency. This item requires a majority vote for approval. -JBW
RECOMMENDATION: That the Board approves granting the Utility Easement to, and
accepting on behalf of, the CCWSD, and authorizes the Chairman to execute the
aforementioned document; and also for the Board to direct the County Manager or his
designee to proceed to follow all appropriate closing procedures for the aforementioned
document and verify its recording in the Public Records of Collier County, Florida.

THIS EASEMENT, made and entered into this day of , 2011, by
COLLIER COUNTY, A POLITICAL' SUBDIVISION OF THE STATE OF FLORIDA, whose post
office address is 3335 East Tamiami Trail, Suite 101, Naples, Florida 34112, hereinafter
referred to as "Grantor"; to the BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AS THE - GOVERNING BODY OF COLLIER COUNTY AND AS THE
EX- OFFICIO GOVERNING BOARD OF THE COLLIER COUNTY WATER -SEWER DISTRICT,
whose post office address is 3335 East Tamiami Trail, Suite 101, Naples, Florida 34112, its
successors and assigns, hereinafter referred to as "Grantee ".
WITNESS.ETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants,' bargains and sells unto the Grantee, its
successors and assigns, a perpetual, non- exclusive easement, license, and privilege for
water utility purposes, on the following described lands located in Collier County,
Florida, to wit:
See attached Exhibit "A" which is incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
[THIS IS NOT HOMESTEAD PROPERTY.]
TO HAVE AND TO HOLD the same unto the Grantee together with the right to
enter upon said land, excavate, and place or remove materials for the purpose of
constructing, operating, and maintaining water utility facilities thereon. Grantor and
Grantee are used for singular or plural, as the context requires.
