WHEREAS, R & S Development Company, a Florida Limited liability company ( "R&S Development"), was the owner of a certain parcel of property located in Collier County, Florida (hereinafter the "Property" }. WHEREAS, R & S Development submitted an Application for a PUD rezoning on the Pro � perty, Petition PUDZ- 2004 -AR -6932 — Sandalwood Residential Planned Unit Development (RPUD). WHEREAS, County Staff recommended approval of the Application. WHEREAS, notwithstanding the recommendation, the County denied the application on February 14, 2006. WHEREAS, R & S Development filed an action challenging the denial of its APPlication, Case No. 06- 384 -CA, in the Circuit Court of the Twentieth Judicial Circuit, in and for Collier County. WHEREAS, the County Commission approved a settlement offer in a meeting held September 26, 2006 and authorized the County Attorney's office to make such an offer. WHEREAS, the parties thereafter agreed upon the form of the corrected RpUD Rezoning Order, which reflects the settlement. WHEREAS, CNL Bank is the current owner of the Property. WHERAS, CNL Bank and County wish to amend the Settlement Agreement. NOW THEREFORE, it is agreed as follows: 1. The recitations above are true and correct and are incorporated. herein. 2. Exhibit "3" of the Settlement Agreement shall be amended as follows: A. Section 5.8 of the Sandalwood Planned Unit Development Document is hereby deleted in it's entirely. B. Except as modified herein, Exhibit "3" of the Settlement Agreement Shall remain in full force and effect. 3. Except as modified by this Amendment, the Settlement Agreement shall remain in full force and effect. A copy of this Amendment of Settlement Agreement shall be filed in Case No. 06- 384 -CA in the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida. 4.
