EXECUTIVE SUMMARY CU- PL2011 -0579, Garden Street Recycling, a Resolution of the Board of Zoning Appeals of Collier County, Florida providing for the establishment of a Conditional Use to allow an iron and metal collection and transfer station (refuse systems) - within an industrial (1) zoning district pursuant to Subsection 2.03.04.A.1.c.16 of the Collier County Land Development Code for property located in Section 36, Township 49 South, Range 25 East, Collier County, Florida, OBJECTIVE: To have the Board of Zoning Appeals (BZA) consider an application for Conditional Use to allow a collection and transfer site for resource recovery within an Industrial (I) zoning district pursuant to Subsection 2.03.04.A. l .c.16 of the Collier County Land Development Code (LDC); and to insure that the community's interests are maintained. CONSIDERATIONS• The purpose of this petition is to obtain a Conditional Use approval to allow a scrap iron and metal collection and waste transfer station (refuse systems (SIC 4953)) which is located in the Industrial (I) zoning district. The subject 4.18± acre site was previously developed and is the former location of the Naples Lumber Truss facility. The applicant proposes .to relocate the Garden Street Iron and Metal Collection, Inc., facility (an iron and metal collection and transfer station under existing Conditional Use 93 -215) located at 6101 Shirley Street to 4246 Exchange Avenue. Scrap metal is collected, stock piled, sorted into bins and dumpsters, and is hauled from the site to another location where it is further processed. During a site visit to the Shirley Street site, staff observed the collection and sorting of aluminum cans, copper wiring and pool cages. According to note number 7 on the Master Plan, there will be no shredding of metal at this site, as it is prohibited. There are two existing mostly open sided buildings (one has a small area enclosed with walls) totaling approximately 47,652 square feet on the subject_ site. According to information submitted by the applicant, processing of materials will occur under the buildings and outside stockpiling will be limited to 8 feet. The site is buffered by existing 10 -foot wide Type D right- of-way landscape buffer which consists of a 3 -foot high hedge and trees 30 feet on center along Exchange Avenue. The remainder of the property boundaries are buffered by an existing l 0 -foot wide Type A landscape buffer which consists of trees located 30 feet on center. Consistent, with LDC Subsection 4.02.12 "Design Standards for Outside Storage" the stock piles and recycling operations will be screened by a proposed 7 -foot high screen consisting of a hedge, wall or opaque fencing along the perimeter of the "northern" half of the site as shown on the Master Plan. A proposed 8 -foot concrete wall along the perimeter of the "southern" °portion of the site will screen the stockpiles and recycling operations as shown on the Master Plan included in the attached Staff Report. The proposed Exchange Avenue facility will operate in a similar fashion as the "existing facility on Shirley Street. Scrap metal such as soda cans, copper tubing; old aluminum pool cage framing, and rebar from building renovations and reconstruction will be collected. During a site visit to the Shirley Street facility, staff observed the crushing of aluminum cans and their collection on a conveyor belt into a semi trailer. There were also dumpsters containing metals such as sorted copper wiring and a pile of pool cage framing. According to information provided by the applicant, while the uses will be similar to the Shirley Street site, there will be a few additional items collected at the proposed Exchange Avenue site which will include intake of appliances and vehicles. The recycling of scrap metals which includes collecting, sorting and transporting will be the primary land use at the Exchange Avenue site. FISCAL IMPACT: Approval of the Conditional Use, in and of itself, would have no fiscal impact on Collier County. There is no guarantee that the project, at build out, would maximize its authorized level of development, however, if the use were approved, a portion of the existing land would be developed and the new development would result in an impact on Collier County public facilities. The County collects impact fees prior to the issuance of building permits to help offset the impacts of each new development on public facilities. These impact fees are used to fund projects identified in the Capital Improvement Element of the Growth Management Plan as needed to maintain adopted Level of Service (LOS) for public facilities. Additionally, in order to meet the requirements of concurrency management, the developer of every local development order approved by Collier County is required to, pay a portion of the estimated Transportation Impact Fees associated with the project in accordance with Chapter 74 of the Collier County Code of Laws and Ordinances. Other fees collected prior to issuance of a building permit include building permit review fees. Please note that impact fees and taxes collected were not included in the criteria used by staff and the Planning Commission to analyze this petition. GROWTH MANAGEMENT PLAN (GMP) IMPACT: Future Land Use Element (FLUE): The property is currently zoned "I" Industrial (or Lutz Industrial/Tract B Subdivision) and is designated Industrial on the Future Land Use Element, Future Land Use Map (FLUM). Uses allowed in the "I" zoning district are allowed in the Industrial designation of the FLUM. Based on the above analysis, staff finds the above request consistent with the Future Land Use Element, Future Land Use Map of the Growth Management Plan. ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION: The EAC did not review this petition because the project did not fall within the powers and duties, or scope of land development project reviews for the EAC pursuant to Code of Laws and Ordinances Section 2 -1193 Powers and Duties. COLLIER COUNTY PLANNING COMMISSION (CCPCI RECOMMENDATION: The CCPC heard petition CU- PL2011 -0579 on August 18, 2011, and by a unanimous vote of 8 to 0 recommended to forward this petition to the Board of Zoning Appeals (BZA) with a recommendation of approval. The approval is subject to the following Staff conditions of approval 1 through 3 and an additional condition 4 added by the CCPC: 1. Outside storage of materials is limited to the screened areas of the site. The materials shall not be stored or placed in such a way that the resulting height is in excess of the height of the site's outdoor storage screen/concrete wall. 2. The proposed building facade along the street frontage of the existing building shall be a minimum height of 8 feet. 3. On -site shredding of metals is prohibited. 4. Outdoor storage shall be located to the rear of the first landscape islands (72 and 83 feet from the front facade of the building) as shown on the Conditional Use Master Plan revised on August 18, 2011. Because no letters of objection have been received, this petition has been placed on the Summary Agenda. LEGAL CONSIDERATIONS: Before you is a recommendation by the Planning Commission for approval of a conditional use authorizing an Iron and Metal Collection and Transfer Station (Refuse Systems) in the Industrial zoning district. A conditional use is a use that is permitted in a particular zoning district subject to certain restrictions. All testimony given must be under oath. The attached report and recommendations of the Planning Commission required are advisory only and are not binding on you. Petitioner has the burden of demonstrating that the necessary requirements have been met, and you may question Petitioner, or staff, to satisfy yourself that the necessary criteria has been satisfied. In addition to meeting the necessary criteria, you may place such conditions and safeguards as you deem appropriate to allow the use, provided that there is competent, substantial evidence that these additional conditions and safeguards are necessary to promote the public health, safety, welfare, morals, order, comfort, convenience, appearance, or the general welfare of the neighborhood. As a further condition of approval of the conditional use, you may require that suitable areas for streets, public rights -of -way, schools, parks, and other public facilities be set aside, improved, and /or dedicated for public use, subject to appropriate impact fee credits. Approval or denial of the Petition is by Resolution. The proposed Resolution was prepared by the County Attorney's Office and is legally sufficient for Board action. According to the applicant, the hours of operation for the facility are currently from 7:30 a.m. to 5:00 p.m., Monday through Friday, and 7:30 a.m. to 1:00 p.m. on Saturday. The applicant would like to extend these hours as needed. There will be site lighting for security purposes. The site presently has water service provided by the City of Naples and sewer service provided by Collier County. The proposed Exchange Avenue facility will operate in a similar fashion as the existing facility on Shirley Street. Based on the above analysis, staff finds the above request consistent with the Future Land Use Element, Future Land Use Map of the Growth Management Plan. ANALYSIS: Before any Conditional Use recommendation can be offered to the Board of Zoning Appeals (BZA), the Collier County Planning Commission (CCPC) must make findings that: 1) approval of the Conditional Use will not adversely affect the public interest and will not adversely affect other property of uses in the same district of the neighborhood; and 2) all specific requirements for the individual Conditional Use will be met; and 3) satisfactory provisions have been made concerning the following matters, where applicable: 1. Subsection 2.03.04 A.1.c.16., of the LDC permits Conditional Uses in the Industrial (1) zoning district. The requested uses for a scrap iron and metal collection and waste transfer site for resource recovery (SIC 4953) are permitted as conditional uses in the Industrial (I) zoning district, subject to the standards and procedures established in section 10.08.00, Conditional Uses Procedures, of the LDC. 2. Consistency with the Land Development Code (LDC) and the Growth Management Plan (GMP). r� This request is consistent with the Growth Management Plan (GMP) and this project will be in compliance with the applicable provisions of the Land Development Code (LDC). 3. Ingress and egress to the property and proposed structures thereon, with particular reference to automotive and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. Transportation Planning staff has reviewed the petition and has found no transportation related issues. As shown on the Master Concept Plan on page three, adequate vehicular access to the site would be afforded from two existing access points along Exchange Avenue. 4. The affect the Conditional Use would have on neighboring properties in relation to noise, glare, economic or odor effects. The subject site is currently surrounded by other industrial uses, such construction contractors and subcontractors to the north, a hurricane shutter company and an electrical wholesale company to the south, and a roofing supply company and an equipment rental company to the west. As previously stated in this Staff Report, the existing buildings are mostly open sided buildings. In addition to the existing landscaping buffers, the applicant proposes the following to minimize impacts to the neighbors (please refer to the site plan on page 3 of this Staff Report): CU- PI 2011 -0579 GARDEN STREET RECYCLING Page 6 of 9 7 -18 -11 Packet Page -1232- 10/11/2011 Item 17. B. - install a building fagade along the front street facade of the existing building; - install a 7 -foot height hedge, wall or opaque fencing to further enclose the northern area of the site, continuing approximately halfway down the east and west property lines; - install an 8 -foot high wall is proposed along the remainder of the east south and west property lines. 5. Compatibility with adjacent properties and other property in the district. As noted above, the proposed scrap metal recycling use would be surrounded by other industrial uses including a roofing supply company and a rental company to the west, (which is a use permitted by right only in the Industrial zoning district) as well as building contracting and subcontracting businesses to the north and south. Due to this industrial location, the provision of the required enhanced perimeter buffers previously described, and the conditions of approval recommended by staff, the impacts from this project on the neighboring properties would be minimized and compatibility enhanced. Based on the above findings, this conditional use is recommended for approval. NEIGHBORHOOD INFORMATION MEETING (NM: The applicant duly noticed and held the required meeting on June 29, 2011, at 5:30 p.m. at the Naples Airport. Six people along with the applicant and County Staff attended the meeting. For further information, see Attachment A: NIM Minutes. The meeting ended at approximately 6:00 p.m. COUNTY ATTORNEY OFFICE REVIEW: The County Attorney Office has reviewed the staff report for CU- PL2011 -0579 revised on July 21, 2011. RECOMMENDATION: Staff recommends that the Collier County Planning Commission (CCPC) forward Petition CU- PL2011 -0579 to the Board of Zoning Appeals (BZA) with a recommendation of approval subject to the following conditions: Outside storage of materials is limited to the screened areas of the site. The subject site is located along the south side of Exchange Avenue east of its intersection with Industrial Boulevard in Collier County, Florida. Upon approval of the proposed conditional use, the approximately 4.18 -acre site will be utilized as an industrial use by the Garden Street Iron & Metal Recycling company. Access to the property will be provided to Exchange Avenue via a full site access drive. Additionally, access to Airport Pulling Road, Radio Road, and Livingston Road is provided via the internal roadway network of the industrial park. The methodology to be utilized for this project was sent to Collier County Staff via e- mail on Monday April 25`h, 2011. The initial meeting checklist and agreed upon methodology notes are attached to the end of this document for reference. This report examines the impact of the development on the surrounding roadways. Trip generation and assignments to the site access driveways will be completed and analysis conducted to determine the impacts of the development on the surrounding intersections. Surrounding the subject site on all sides are existing industrial developments. Airport Pulling Road is a north/south six -lane divided arterial roadway to the west of the subject site. The Level of Service Standard on Airport Pulling Road from Golden Gate Parkway to Radio Road is LOS "E ", or 3,230 vehicles. The Level of Service Standard on Airport Pulling Road from Radio Road to Davis Boulevard is LOS "E ", or 4,100 vehicles. Airport Pulling Road is under the jurisdiction of the Collier County Department of Transportation. Livingston Road is a north/south six -lane divided arterial roadway to the east of the subject site. The project traffic distribution was determined and agreed upon by County Staff during the methodology process. The resultant project traffic distribution is illustrated on Figure 2. Figure 3 illustrates the assignment of the total project trips to the site access drive based upon the project traffic 0 distribution. '^ VI. FUTURE TRAFFIC CONDITIONS In order to determine which roadway segments surrounding the site will be significantly impacted, Table 1A, contained in the Appendix, was created. This table indicates which roadway links will accommodate an amount of project traffic greater than the 2 % -2 % -3% Significance Test. Therefore, the net new traffic generated as a result of the proposed conditional use application was compared with the Capacity for Peak Hour — Peak Direction traffic conditions as defined by the 2010 Collier County Annual Update Inventory Report (AUIR). Based on the information contained within Table lA, none of the roadway links analyzed were shown to sustain a significant impact. The current remaining capacity and Level of Service Standard for each roadway segment analyzed was obtained from the 2010 Collier County Annual Inventory Update Report (AUIR). In order to estimate the projected 2016 background traffic volumes, the existing 2010 peak hour peak direction traffic volumes from the 2010 AUIR were adjusted by the appropriate growth rate. These projected volumes were then compared with the 2010 existing plus trip bank volumes from the 2010 AUIR. The more conservative of the two volumes was then utilized as the 2016 background traffic volume. VII. PROJECTED CONSISTENCY AND IMPROVEMENTS The concurrency analysis was performed by subtracting the project traffic volumes from the 2016 background remaining capacity in order to determine whether or not sufficient capacity will be available after the addition of the net new traffic associated with the proposed Garden Street Iron & Metal Recycling operation. Based on the information contained within Table IA, there will be sufficient capacity on the surrounding roadway network to serve the net new trips generated as a result of the proposed development. Figure 4 was created to indicate the results of the concurrency analysis on the adjacent roadway network. As can be seen within Figure 4, a positive capacity is shown after the addition of the net new project traffic on all roadway links analyzed as a result of the proposed development. Based upon the information contained within Table IA and Figure 4, all roadway segments access by the proposed development are shown to operate at an acceptable Level of Service condition in 2016 with the addition of the new trips anticipated to be generated by the proposed development. Therefore, no roadway link improvements will be required as a result of the new traffic added as a part of the proposed Garden Street Iron & Metal Recycling Operation. INTRODUCTION TR Transportation Consultants, Inc. has conducted a traffic impact statement for the proposed conditional use rezoning application for Garden Street Iron & Metal Recycling. The subject site is located along the south side of Exchange Avenue east of its intersection with Industrial Boulevard in Collier County, Florida. Figure 1 illustrates the approximate location of the subject site. Upon approval of the proposed conditional use, the approximately 4.18 -acre site will be utilized as an industrial use by the Garden Street Iron & Metal Recycling company. Access to the property will be provided to Exchange Avenue via a full site access drive. Additionally, access to Airport Pulling Road, Radio Road, and Livingston Road is provided via the internal roadway network of the industrial park. The methodology to be utilized for this project was sent to Collier County Staff via e- mail on Monday April 25"', 2011. The initial meeting checklist and agreed upon methodology notes are attached to the end of this document for reference. This report examines the impact of the development on the surrounding roadways. Trip generation and assignments to the site access driveways will be completed and analysis conducted to determine the impacts of the development on the surrounding intersections. EXISTING CONDITIONS The subject site is currently vacant but previously contained a wood truss plant and distribution center. Exchange Avenue borders the subject site to the north. Surrounding the subject site on all sides are existing industrial developments. Airport Pulling Road is a north/south six -lane divided arterial roadway to the west of the subject site. The Level of Service Standard on Airport Pulling Road from Golden Gate Parkway to Radio Road is LOS "E ", or 3,230 vehicles. The Level of Service Standard on Airport Pulling Road from Radio Road to Davis Boulevard is LOS "E ", or 4,100 vehicles. Airport Pulling Road is under the jurisdiction of the Collier County Department of Transportation. Livingston Road is a north/south six -lane divided arterial roadway to the east of the subject site. The Level of Service Standard on Livingston Road from Golden Gate Parkway to Radio Road is LOS "E ", or 3,760 vehicles. Livingston Road is under the jurisdiction of the Collier County Department of Transportation. Radio Road is an east/west four -lane divided arterial roadway to the south of the subject site. PROPOSED DEVELOPMENT Upon approval of the proposed conditional use, the approximately 4.18 -acre site will be utilized as an industrial use by the Garden Street Iron & Metal Recycling company. Table 1 summarizes the land use being proposed on the subject site. TRIP GENERATION The trip generation for the proposed development was determined by referencing the Institute of Transportation Engineer's (ITE) report, titled Trip Generation, 8th Edition. Land Use Code 110 (General Light Industrial) was utilized for the trip generation purposes of the proposed Garden Street recycling/transfer center use. The equations for this land use code are contained in the Appendix of this report for reference. Table 2 outlines the anticipated weekday A.M. and P.M. peak hour trip generation of the Garden Center Iron & Metal Recycling use as currently proposed. TRIP DISTRIBUTION The trips the proposed industrial use is anticipated to generate were assigned to the site access drive and the surrounding roadway network. The project traffic distribution was determined and agreed upon by County Staff during the methodology process. The resultant project traffic distribution is illustrated on Figure 2. Figure 3 illustrates the assignment of the total project trips to the site access drive based upon the project traffic .-., distribution. VI. FUTURE TRAFFIC CONDITIONS In order to determine which roadway segments surrounding the site will be significantly impacted, Table lA, contained in the Appendix, was created. This table indicates which roadway links will accommodate an amount of project traffic greater than the 2 % -2 % -3% Significance Test. Therefore, the net new traffic generated as a result of the proposed conditional use application was compared with the Capacity for Peak Hour — Peak Direction traffic conditions as defined by the 2010 Collier County Annual Update Inventory Report (AUIR). Based on the information contained within Table IA, none of the roadway links analyzed were shown to sustain a significant impact. The current remaining capacity and Level of Service Standard for each roadway segment analyzed was obtained from the 2010 Collier County Annual Inventory Update Report (AUIR). In order to estimate the projected 2016 background traffic volumes, the existing 2010 peak hour peak direction traffic volumes from the 2010 AUIR were adjusted by the appropriate growth rate. These projected volumes were then compared with the 2010 existing plus trip bank volumes from the 2010 AUIR. The more conservative of the two volumes was then utilized as the 2016 background traffic volume. VII. PROJECTED CONSISTENCY AND IMPROVEMENTS The concurrency analysis was performed by subtracting the project traffic volumes from the 2016 background remaining capacity in order to detennine whether or not sufficient 1001N, capacity will be available after the addition of the net new traffic associated with the proposed Garden Street Iron & Metal Recycling operation. Based on the information contained within Table IA, there will be sufficient capacity on the surrounding roadway network to serve the net new trips generated as a result of the proposed development. Figure 4 was created to indicate the results of the concurrency analysis on the adjacent roadway network. As can be seen within Figure 4, a positive capacity is shown after the addition of the net new project traffic on all roadway links analyzed as a result of the proposed development. Based upon the information contained within Table IA and Figure 4, all roadway segments access by the proposed development are shown to operate at an acceptable Level of Service condition in 2016 with the addition of the new trips anticipated to be generated by the proposed development. Therefore, no roadway link improvements will be required as a result of the new traffic added as a part of the proposed Garden Street Iron & Metal Recycling Operation.
