This resolution adopts the rates that fund the FY12 Budget for solid 'waste collection and disposal. O~CTIVE: Approv~ the annual rate resolution setting landfill tipping fees, recycling cent~r fees, and residential multi-family and commercial waste collection fees for FY12. This resolution adopts the rates that fund the FY12 Budget for solid waste collection and disposal. CONSIDERATIONS: The Solid Waste Management Department's budget is based on the annual mandatory trash collection and disposal assessments and user fees for the Collier County Landfill, the Immokalee Transfer Station, and its four recycling centers (Marco' Island, Naples, North Collier, and Camestown). These fees are critical to sustaining the Board of County Commissioners {Board)-approved Integrated Solid Waste Management Strategy, which provides directives towards obtaining best value solutions to preserving valuable landfill (disposal) airspace, .and the proper disposal of solid waste generated in Collier County. The fees outlined in the rate resolution support the Solid Waste Management Department's FY12 Budget approved by the Board at the September 22, 2011, budget meeting., These rates reflect ~ budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the wide range of waste generated in the county. Waste collected throughout Collier County includes municipal solid waste taken to the landfill and recycling centers, biomass, construction and demolition materials, tires, electronics, household hazardous waste, cardboard, white goods, and furniture. The rate resolution provides the correct funding to retire costs associated with the demands for solid waste disposal, while planning for the future recycling and solid waste needs of our community. Solid waste collection services in Collier County include twice a week trash'pickup, once a week recycling pickup, on demand bulky item and electronics pickup, once a week biomass (yard) waste pickup, and guaranteed recycling services. Residential curbside ?tes for FY12 will remain the same as the FYl1 rates; $173.49 per residential unit for Distfict.I (greater Collier County), and $165.28 per residential unit for District II (Immokalee and northeastern Collier County), as approved by the Board as Agenda Item 17B at the September 13, 2011, meeting. The Solid waste disposal service costs are impacted by any change in landfill , tipping.. fees and the volume of waste disposed of., The tipping fees will also remain the same as the 2011 rates; the disposal volume continues to be driven downward due to the increase of recycling. The Recycling Center rates for Commercial and Residential Construction and Demolition (C&D) . and Biomass have been slightly adjusted.to more accurately account for the material being brought in by the public. The existing multiple rates have been adjusted to a single flat rate that accounts for the appropriate disposal costs. The slight adjustment will eliminate confusion and streamline the acceptance of the material. It should be noted that C&D and Biomass materials are collected in ~ Packet Page ~1721- 9/27/2011 Item 16.C.5. ~ limited quantities at the recycle centers to ensure these materials are better handled by the private sector market. FISCAL IMP ACT: The proposed landfill tipping fees and recycling center fees will provide estimated FY12 revenues of $13,944,400 for the Solid Waste Disposal Fund (470). The mandatory trash collection and disposal assessments will provide estimated FY12 revenues of $18,527,700 for the Mandatory Trash Collection Fund (473). LEGAL CONSIDERATIONS: This item is legally sufficient and requires a majority vote. JBW GROWTH MANAGEMENT IMP ACT: This rate resolution is in compliance with the Growth Management Plan that provides for increased recycling and reuse of the solid waste stream. Approval of the FY12 fees will ensure compliance with the Solid Waste Management Department's 2011 AUIR requirements. RESOLUTION NO. 2011- ~ RESOLUTION SUPERSEDING RESOLUTION 2010-192 AND ESTABLISHING THE FEES, RATES AND CHARGES FOR USE OF COLLIER COUNTY SOLID WASTE FACILITIES PURSUANT TO COLLIER COUNTY ORDINANCE NO. 84 - 31 WHEREAS. under the authority of Chapter 403.706, Florida Statutes. Collier County has the responsibility and power to provide for the operation of solid waste management facilities to meet the needs of all areas of the County; and WHEREAS, said statutory authority grants the Board of County Commissioners the power to prescribe, fix, establish and collect fees, rentals or other charges for the use of the established solid waste disposal system and to pledge such revenues as security for the payment of bonds issued under said statutory authority for the construction of a solid waste disposal facility; and WHEREAS, Florida Statutes, Section 125.01(k)(1) and (2) grants the Board of County Commissioners the power to provide and regulate waste collection and disposal; and WHEREAS, The Board of County Commissioners through its adoption of County Ordinance No. 84-31 has implemented the user fee system for Solid Waste to all public and private users. ~ WHEREAS, these rates reflect budget guidance and provide the appropriate fees necessary to collect, process. recycle, and/or dispose of the County's wide rate of generated waste. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION 1: Resolution No. 2010-192 is hereby superseded in its entirety.
