Move Item 10L to 16A16: Recommendation to approve the Ribbon Cutting Ceremony for the
new Transit Route between Collier County and Lee County to be known as the "LinC" and to authorize
the Chairman to sign all applicable agreements associated with use of private property for the event

Move Item 16A15 to Item 10M: Recommendation to direct the County Manager or his designee to
amend the Collier County Land Development Code (LDC) and Right-of-Way Ordinance in regards to
storage containers, Planned Unit Development (PUD) Annual Monitoring Reports, specific standards
for the location of accessory buildings and structure provisions to include Personal Storage
Containers (PODS), number of dogs allowed in residential districts, and exceptions to a Right-of-Way
(ROW) permit meeting specific criteria. (Commissioner Hiller's request)
Move Item 16Bl to Item 13Bl: Recommendation that the Collier County Community Redevelopment
Agency (CRA) approves and executes an amendment to the employment agreement between the CRA
and David L. Jackson, the Bayshore Gateway Triangle CRA Executive Director, extending the term of
employment four years and modifying severance terms, and authorize the CRA Chairman to sign.

when he rescued ninety-year old Margaret Webb who was being attacked by an alligator. The
Proclamation designates September 24,2011 as "Dwain Daniels Day". Per Ordinance Number 2011-
17 a majority vote of the Board is required to add this document to the agenda since it was submitted
following the publication of the printed agenda. Sponsored by Commissioner Henning.

OBJE~: To appoint 4 members to terms that will expire on October 1, 2015. The
members will represent District 1, District 2, District 3 and District 4.
CONSIDERATIONS: The CoHier Connty Planning Comm~sion has 4 terms that will expire
on October 1, 2011. . This 9 member committee assists in the formulat,ion and review of the
Comprehensive Land. Use Plan, Land Development Code, and amendments to both, and then
submits their recommendations to the Board for final decision. Members are required to file a
Form 1, Statement of Financial Interest each year with the Supervisor of Elections. Terms are 4
years.

As noted in your memorandum of September 6, 2011, there are four vacancies on the above referenced
advisory board. Three of the applicants, Barry Klein (District 3), Donna J. Reed (District 2), and Melissa
Ahern (District 4) have reapplied to continue serving on the Collier County Planning Commission
(CCPC). In addition, Mr. Phillip E. Brougham has applied to fill the vacancy created by the resignation
Robert Murray (District 1). I have attached a spreadsheet listing their occupation, educational background
and professional experience pertaining to this position.
In addition, Section 2-1157 (CCPC Membership qualifications) of the Code of Laws and Ordinances
requires the members of the Planning Commission to be permanent residents and qualified electors of
Collier County and reside in Commission District allocated for each vacancy. All candidates are
permanent residents of Collier County and they are also listed registered voters on their application. They
also reside within the Commission Districts that they are seeking to fill.
This section also states that although no specific experience requirements shall be necessary as a
prerequisite to appointment, consideration shall be given to applicants who have experience or who have
shown interest in the area of planning, zoning, and related fields. Further consideration in the appointment
of Planning Commission members shall be made so as to provide the Planning Commission with the
needed technical, professional, business, and/or administrative expertise to ~ccomplish the duties and
functions of the Planning Commission. Commissioners Reed, Klein and Ahern are seeking reappointment
to the CCPC and were previously determined to have experience in the area of planning and zoning. Mr.
Brougham's resume indicates that he has experience in the area of planning and zoning as part of his work
with the Floodplain Management Planning Committee as well as his service on the Parks and Recreation
Advisory Board.
Based upon the information contained in their applications, all candidates are qualified to serve on this
advisory board.

This 9 member committee was created by authority of Chapter 67-1246, Laws of FL. On
09/03/85 the BCC adopted Res. No. 85-190, expressing intent to consider an ordinance
consolidating functions of Coastal Area Planning Commission and Immokalee Area Planning
Commission into CCPC. On 09/24/85, Ord. No. 85-51 created the CCPC, which was repealed
by LDC Ord. 91-102. This committee assists in the formulation and review of the
Comprehensive Land Use Plan, Land Development Code, and amendments to both, and then
submits their recommendations to the Board for final decision. Members are required to file a
Form 1 Statement of Financial Interest each year with the Supervisor of Elections. Terms are 4
years.
On 1-8-03 at an LDC Mtg the BCC amended the LDC (sec. 5.2.3.2) to include a member of the
School Board. The BCC determined on 10/14/03 that they will be a non-voting member.

Ex erience:
fter sellin houses in 1969, Is ent 13 years with Schostak Brothers in the Detroit area. I started as
ommercial real estate salesman, and by 1972 I was the to shop ing center leasin a ent in the com any. W
develo ed over 20 sho ping centers in a 10 year eriod, and I became an e uity partner, while still makin
deals as a broker. After I trained Jerry Schostak's oldest of four sons in the com any, I left, on good terms,i
1983, to open my own com any, which specialized in shop ina center development, leasing, and I also di
consulting for several tenants and retail chains. I have develo ed sho ing centers as large as 250,000 s.f. (wit
Forest City Enterprises), and for many years was a" referred develo er" for Walgreen, doing several "ground-
" stores for them in Michigan. I have been an active member of the International Council of Sho pin
Centers since 1972, and was a State Director for two three-year terms, and also was on their Board of Trustee
or six consecutive years. I have appeared before lanning commissions "on the other side" many times before
serving on the CCPC. Since being on the Planning Commission, I have taken advantage of several workshops,
rograms, and tours that were offered by staff and invitations of Commissioner Fiala, includin : a publi
orksho on 10-10-10 on ro osed chan es to the Land Develo ment Code; on 10-14-10 I attended
orksho on Ethics and Sunshine Laws; from October 29-30, I attended a resentation by the faculty of th
niversity of Miami Rosen Stiel School at the Na les Beach Hotel much of which was devoted to the Gulf oil
s ill, and how it mi ht affect Collier County; on 12-1-10 I attended an all-day "Invasive S ecies Worksho II a
GCU; on 1-5-11, I toured the Collier County South Water Plant, very close to my home; and on 2-3-11
oured the North Wastewater lant in North Naples; a week later, I visited the Marco Island Recycling Center i
e mornin , and the Collier County Land Fill in the afternoon. I would not call it "beautiful", but it was so
fascinating I would do it a ain; on 3-1-11, I had an e e-opener:the EOC tour, followed by the South Re iona
Library next door. On March 2, I toured the Collier County Jail. I think all of these 0 ortunities hel ed m
derstand wh Collier Count is a wonderful lace to live, and its em loyees and volunteers should work har
o make it even better.
