EXECUTIVE SUMMARY
Recommendation to approve budget amendments of $108,300 and $1,100 for Fund 408 (Collier
County Water Sewer District), and Fund 441 (Goodland Water District) respectively, to reallocate
budgeted operating expenses within the funds for reimbursement to the Federal Emergency
Management Agency / State of Florida for Tropical Storm Fay expenses also paid by insurance.
OBJECTIVE: Approval of budget amendments of $108,300 and $1,1.00 for Fund 408 (Collier
County Water Sewer District), and Fund 441 (Goodland Water District) respectively, to
reallocate budgeted operating expenses within the funds for reimbursement to the Federal
Emergency Management Agency (FEMA) / State of Florida for Tropical Storm Fay expenses
also paid by insurance.
CONSIDERATIONS: The Public Utilities Division (PUD) incurred approximately $799,000 in
reimbursable emergency related expenses for Tropical Storm Fay. The expenses were generally
eligible for reimbursement at 75 percent from FEMA, plus 12.5 percent from the State of Florida
for both emergency expenses and related direct administrative costs. A subset of those expenses
(initially $331,000 and, more recently, an additional $22,000) was determined eligible for
reimbursement by insurance at 100 percent, excluding direct administrative costs. Based on
Section 312 (b)(1) of the Stafford Act (42 U.S.C. 5155), once insurance proceeds are received,
all resulting duplicate assistance must be returned to FEMA / State of Florida. Total
reimbursements from Tropical Storm Fay, after return of duplicate payments, will approximate
$744,000 ($391,000 from FEMA / State of Florida and $353,000 from insurance).,
When the initial insurance. proceeds were received August 2009, specific items were determined
to have been paid by both FEMA / State of Florida and insurance, and $202,000 in duplicate
payments was immediately returned to FEMA / State of Florida. The PUD also began working
on amended / supplemental claims to insurance at that time.
In April 2011 the PUD received insurance proceeds from Johns Eastern Company, Inc., for final
payment for the amended / supplemental claims. Total insurance reimbursements received were
then reviewed against reimbursements received from FEMA / State of Florida to identify any
further duplication of payment. Approximately $109,400 was identified as duplicate and is due
back to FEMA / State of Florida, $108,300 from Fund 408 and $1,100 from Fund 441.
FISCAL IMPACT: Funds are available within the FY2011 approved operating budgets for
Funds 408 and 441.
LEGAL CONSIDERATIONS: This item does not present any legal issues and requires a
majority vote. - JB W
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with
this request.
