Should a hearing be held on this item, all participants are required to be sworn in. 9/13/2011 Item 16.A.16: EXECUTIVE SUMMARY Recommendation to provide after the fact approval for the submittal of a State of Good Repair (SGR) Bus and Bus Facilities grant application, for the amount of $11,335,290, to the Federal Transit Administration (FTA) for construction of improvements at the Collier Area Transit (CAT) Administration and Maintenance Facility at 8300 Radio Road. OBJECTIVE: To receive after- the -fact approval from the Board of County Commissioners to submit 'a State of Good Repair (SGR) Bus and Bus Facilities grant application to the Federal Transit Administration (FTA) to fund the construction of improvements at the Collier Area Transit (CAT) Administration and Maintenance Facility at 8300 Radio Road. CONS` IDERATIONS: The FTA Section 5309 Bus and Bus Facilities grant program makes funds available to public transit providers to finance capital projects to replace, rehabilitate, and purchase buses and related equipment and to construct/rehabilitate bus- related facilities. The initiative will be funded with up to $750 million in unallocated Fiscal Year (FY) 2011 discretionary Bus and Bus Facilities program funds authorized by 49 U.S.C. § 5309 (b) of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A Legacy for Users (SAFETEA -LU). There is no floor or upper limit for any single grant under this program; however FTA intends to fund as many meritorious projects as possible. The CAT. Administration and Maintenance facility currently houses the transit administration offices, maintenance area, and a passenger transfer center. It is a multimodal facility that serves buses, passenger cars, pedestrians, and bicycles. The maintenance facility is a prefabricated steel . building that was constructed in 1985. Due to the age of the facility, and the fact that less restrictive building codes were in place at the time of construction, the building is susceptible to complete destruction during severe weather. Without the maintenance building, the transit system would be vulnerable to service disruption. The Alternative Transportation Modes (ATM) Department is applying for a Bus and .Bus Facilities Grant to fund construction improvements at the Collier Area Transit (CAT) Administration and Operations ,Center, which currently houses the transit administration offices, maintenance area, and holds a passenger transfer center.. Funding will be used to achieve the following goals: • Rehabilitate the existing parking lot/driveway and add a stormwater retention area; • Replace the aging maintenance facility; • Construct a permanent fueling island; and • Construct a permanent bus wash down facility. The ATM Department for the Collier County Growth Management Division and the Collier County Facilities Management Department will provide oversight and project management following the FTA grant award for this project. The Federal grant amount requested is $11,335,290. The current project total is $15,113,720 (including land). The required matching share for the project is 20 %. Collier County is providing a 25% match in the amount of Packet Page 1721- /00�N, 9/13/2011 Item 16.A.16. $3,778,430, which would be provided by utilizing the previous purchase of the land for the facility, and requesting 75 % ($11,335,290) from FTA. Selected projects will be announced in September 2011. Due to the short turnaround time, it was necessary to obtain County Manager approval to submit the application and obtain "after- the- fact" approval from the Board of County Commissioners. Collier County CMA #5330 authorizes the County Manager to approve the submittal of grant applications with subsequent Board of County Commissioners action at the next available Board meeting to ratify the approval as "after- the - fact." FISCAL IMPACT: The total cost of improvements to the Collier Area Transit Administration and Maintenance Facility project is $15,113,720 including the land. The grant requires a 20% match, however Collier County is matching with 25% and requesting federal funding for 75 %. If awarded, the grant will fund $11,335,290 which will cover the construction costs. The match is provided by utilizing the previous purchase of the land for the facility. The grant has been entered into the Grant Management System (GMS), and -the assigned number is TR- 00000141. If awarded, a subsequent item will be brought before the board to accept the grant and authorize the necessary budget amendments. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and only requires a majority vote for approval-SRT. GROWTH MANAGEMENT IMPACT: Construction of improvements at the Collier Area Transit Administration and Maintenance Facility is consistent with the Transportation element of the Growth Management Plan. Collier County, created in 1923, was named after a Memphis, Tennessee, millionaire named Barron Gift Collier, who acquired his fortune through streetcar advertising. When Collier arrived, he introduced paved roads, electric power, telegraphs and many new businesses to the community. As a result, more people were attracted to the area. By 1950, the number of residents was 6,488. In 1980 that number grew to 85,000 and according to 2010 U.S. Census Bureau projections that number increased to 321,520, making it one of the fastest growing counties nationwide.' Located on Florida's southwest coast on the Gulf of Mexico, Collier County is home to nearly 50 miles of white -sand beaches. Since CAT's inception in February 2001, ridership has increased from approximately 97, 000 passengers to more than one million passengers. This program provides service 7 days per week and provides door -to -door 5 Packet Page -1731- 9/13/2011 Item 16.A.16. transportation service to individuals who are unable to access the fixed -route bus service due to physical or cognitive conditions. Also, it provides service to those who have no other means of transportation available or who are not in a fixed -route service area. This service provides the disadvantaged with access to employment, medical appointments, shopping and leisure activities. CAT's Technical, Legal, and Financial Capacity Since CAT's inception in 2001, it has been operating with all technical and legal authority of similar Collier County departments. Collier Area Transit operates under the supervision of the County's Alternative Transportation Modes Department and the Growth Management Division. Within the Division are various departments with experienced professionals such as: licensed engineers (including environmental and traffic operations), designers, planners, construction project managers, landscape architects, transit managers, and many others who support CAT. Also, the County Attorney's office has assigned an attorney experienced in transit law, regulations and requirements to assist CAT. CAT has extensive knowledge regarding federal, state and local regulations, in addition to the Collier MPO and Public Involvement process. Through audits conducted by the Florida Department of Transportation (FDOT), CAT has successfully managed grants and all compliance issues. FDOT recently audited CAT's Safety System Program Plan and Grants Program Management, and the audits were outstanding with zero findings. n FTA recently conducted its first Triennial Review of the CAT system. Of the 24 areas, no deficiencies were found with FTA requirements in 22 areas. However, deficiencies were found in 2 areas: legal and drug -free workplace, both of which were corrected immediately after the site visit. CAT staff has FTA experience handling projects and grants. CAT received over $3 million in American Recovery and Reinvestment Act (ARRA) grant funding and is currently implementing all projects that include renovations to the existing operations facility, Intelligent Transportation System (ITS), purchase of buses, security enhancements and transit enhancements. Collier County has a sophisticated accounting system and software (SAP) that includes all required components to meet the financial needs for grant management compliance. The County recently implemented a companion Grants Management System that further supports overall grants administration. The County also has a dedicated Grant Management Office to promote proper management and works in conjunction with the County's Clerk of Courts Finance Department. The Clerk — governed by Florida Statute — provides an additional layer of independent oversight in the financial management of grants is responsible to prepare the Comprehensive Annual Financial Statements as well as coordinate the single audit. CAT has a total of 18 grants currently managed internally with combined revenue of over $21.7 million for the ATM department of the Growth Management Division. All of these grant requirements, including compliance reports, performance measures, financial reports and audits and many other responsibilities are successfully managed by knowledgeable staff. Key Personnel The key personnel who will be responsible and involved in the project are listed in this organizational chart. Planning and Prioritization at the Local Level The ATM Department collaborates with the Collier Metropolitan Planning Organization (MPO) to n implement short- and long -range planning of major roadway facilities and evaluate and manage strategic plans and goals under the Collier County Transit Development Plan (TDP). All proposed projects are consistent with priorities identified in the TDP and the 2035 Long Range Transportation Plan (LRTP). Part of CAT's initiatives /goals is to build projects that are environmentally - friendly, and sustainable. As part of this effort, CAT is designing a maintenance facility, fueling island, and bus wash facility that are environmentally sound and sustainable. If awarded to CAT, this grant will allow for a modernized facility that will be secure in the event of storms and will reduce the impact to the environment. As part of the sustainability effort, CAT is pursuing the Federal Transit Administration (FTA) grant State of Good Repair Bus and Bus Facilities Initiative to construct a stable, modern facility that will achieve the following goals: • Rehabilitate the existing parking lot /drive way and add a stormwater retention area; • Replace the aging maintenance facility; • Construct a permanent fueling island; and • Construct a permanent bus wash down facility. It is a prefabricated steel building that was constructed prior to more restrictive building codes being put into place in Southwest Florida, as a result of Hurricane Andrew. There are several concerns with the existing maintenance building including its increasing age approaching its useful life, environmental issues, and limited security. Due to the age of the building, CAT could face a catastrophic loss in the event of a hurricane that could potentially shut down maintenance operations. In addition to the threat of natural disasters, there are other concerns related to the age of the maintenance facility. Pipes have ruptured throughout the building, which has caused mold in the walls and have created an indoor air quality concern. The roof is also aging and as a result leaks in several locations during rainstorms that are common throughout the summer months in Southwest Florida. The repeated leaks have caused the ceiling insulation to lift and degrade. The fleet for the system is being washed outside without a drainage /treatment system. In order to comply with current Florida environmental regulations and requirements an appropriate water reuse system must be constructed to capture the water use for bus washing to avoid the environmental hazard associated with the lack of an oil and water separator. Because the facility was an old car dealership there are also old hydraulic lifts within the facility that are leaking and need to be removed. 8 Packet Page -1734- There are minimal security measures in place in the existing maintenance facility. All parts are stored in one room that does not have security cameras. Due to the high dollar value of the items being stored, an upgrade in security is necessary. 9/13/2011 Item 16.A.16. The existing maintenance facility has reached full capacity. In order to expand, there would need to be substantial renovations. Due to the age and condition of the building, it would be cost prohibitive to rehabilitate the structure to bring it up to current building code. In order to address CAT's Fleet maintenance needs, the maintenance building needs to be replaced with a modernized facility that will allow for more efficient operations and room for future growth. Construct a permanent fueling island The fuel truck was purchased in 2003 and is deteriorating rapidly due to constant usage. The Fleet Management fuel truck was purchased in 2004 for emergency uses, for refueling emergency generators throughout the County during power outages. For those purposes, the truck was expected to last 15 -20 years. The fuel truck was not intended to be a permanent stationary refueling site for transit buses. It was a temporary solution until a permanent refueling site could be constructed. The constant daily use in that time period, pumping over 700,000 gallons of diesel fuel, has taken its toll on the pumping mechanisms of the truck. At the current rate of use, nearly all of the pumping apparatus will need replacement within the next two years. The purpose of this truck remains emergency use for County contingencies. When emergencies arise, there are strong possibilities that the fuel truck will not be available for refueling transit buses. Construct a permanent bus wash down facility Currently, fixed route buses and paratransit vehicles are washed manually on an asphalt surface. There is no drainage /treatment system in place to catch run off. The lack of a catch and treatment system is a potential environmental.. - hazard. CAT recently contracted a consultant to look at operations and make recommendations regarding green strategies. The consultant recommended that CAT construct a bus wash down facility to include a zero - discharge closed loop water recycling system to catch, treat, and reuse the wash water. This project is scalable. Each component is independent and can be constructed as such. TIP /STIP can be Amended The Collier MPO will amend its TIP upon award of the grant. In addition, the amendment will be incorporated into the STIP. Project Funds can be Obligated Quickly If the project is selected, CAT will move quickly to obligate the funding and implement the project. This project can be constructed within 18 -24 months. Project Timeline The Notice to Proceed for design is expected to be issued by November 1st. This design will last between 6 -12 months depending upon permitting review. Source of Local Match is Identified and is Available for Prompt Project Implementation The source of the local match is existing land and building (8300 Radio Road) that was purchased with local dollars for CAT. The conduct of an independent appraisal by a certified appraiser: In acquiring 8300 Radio Road, an independent appraisal was conducted by a certified appraiser. • The requirement for a review appraisal of the initial appraisal: In acquiring 8300 Radio Road, a review appraisal of the initial appraisal was not conducted as there was no federal funding tied to the purchase. • FTA review and concurrence requirements related to the grantee's offer to buy the property: In acquiring 8300 Radio Road, Collier County did not utilize any federal funding; therefore, no request was submitted to FTA. • The requirement to prepare an excess property utilization plan for all real property no longer used for its original purpose: At the current time, Collier County is utilizing the property therefore no excess property utilization plan was prepared.
