EXECUTIVE SUMMARY
Appointment of member(s) to the Value Adjustment Board.
OBJECTIVE: To appoint a citizen member to the Value Adjustment Board (VAB).
CONSIDERATIONS: Pursuant to Section 194.015, F.S., the VAB is required to be comprised
of the following membership:
2 members of the members of the governing body of the county as elected from the
membership of the Board of said governing body;
1 member of the School Board;
2 citizen members, I appointed by the Board of County Commissioners and must own
homestead property within the county and 1 who must be appointed by the School
Board and must own a business occupying commercial space located within the school
district. '
Additionally, the citizen members may not be a member of or employee of a taxing authority and
may not represent other property owners in any administrative or judicial review of property
taxes. The citizen members should also be available to attend VAB meetings during an
advertised day, the first week in October, and in spring 2012 when the VAB holds its final
meeting.
David Farmer the citizen member elected by the Board of County Commissioners has resigned,
he is now a member of the Mosquito Control Board and as such is disqualified from serving on
the Value Adjustment Board. Bruce Preble the alternate member also resigned. A press release
was issued advertising and applications were received from the following interested citizens.

This notification is in regards to the applicants that have responded to your vacancy request for
VAB Homestead Citizen Member and Alternate Member, that are to be appointed by the Collier
County Board of County Commissioners to serve on the Value Adjustment Board. You had sent
an email to my attention and requested a response.
In reviewing the two applicants for the vacant position, I have confirmed the following:
I. Ms. Darlene M. Allia has homestead in Collier County and that has been confirmed by
the Property Appraiser's Office by the Homestead Director Annabel Ybaceta.
2. Mr. Philippe Fontanelli does not have homestead in Collier County and that has been
confirmed by the Property Appraiser's Office by Ms. Ybaceta.
I have also reviewed the Board of County Commissioners' records to confirm whether or not Ms.
Allia has membership in any taxing authority. Per Florida Statute Chapter 194.015, "a citizen
member may not be a member or an employee of any taxing authority, and may not be a person
who represents property owners in any administrative or judicial review of property taxes ".
Based on the review of the BCC's records, I did not find where she is currently on any such
taxing authority. If we find at a future date that she violates this provision of the statute, her
appointment to the Value Adjustment Board, as the Board of County Commissioners' Citizen
member appointee, will need to be voided and a new appointment will need to be made.
Since Mr. Philippe Fontaneili does not have homestead in Collier County, he cannot be
appointed or serve as an Alternate on the Value Adjustment Board. With this ineligibility, there
wasn't a need to review records further.
