EXECUTIVE SUMMARY
Recommendation to reject Invitation to Bid #11 -5697 for the construction of Immokalee South
Park Community Building due to considerations in bidding associated with Housing and Urban
Development (HUD) requirements not considered in solicitation.
OBJECTIVE: To construct a new Community Building with all site improvements in
Immokalee South Park.
CONSIDERATION: On January 26, 2009, the Board of County Commissioners approved and
signed the grant agreement with the U.S. Department of Housing and Urban Development for
Economic Development Initiative (EM) funds in the amount of $147,000. The grant funds of
$147,000 will be used and broken down into two basic services: $29,400 for Architectural
Engineering Design and $117,600 for Building Construction. The architectural design service
was completed and the project is now in the bid process for construction.
The Parks and Recreation and Purchasing Department prepared bid documents to solicit the
construction of Immokalee South Park Community Building. At the time the bids were opened
the full details of the grant requirements were not known to staff nor disclosed to the bidders as
part of the formal bid process.
Staff recommends re- solicitation of the ITB in order to meet requirements associated with HUD
for this earmark and to include in future solicitation.
FISCAL IMPACT: Funds are budgeted in Community and Regional Park Impact Fee Fund 346.
Project 80085, Immokalee South Park with available funds of S1,051,167.88 including the $147,000
grant funding.
LEGAL CONSIDERATION: This item has been reviewed by the County Attorney's Office,
requires majority vote, and is legally sufficient for Board action. - CMG
GROWTH MANAGEMENT IMPACT: The value of the improved facility will be inventoried
in the Growth Management Plan. .
RECOMMENDATION: That the Board of County Commissioners rejects Bid 911 -5697 and
authorize staff to re -bid the project in compliance with HUD requirements.
