EXECUTIVE SUMMARY
Recommendation to reject the ten (10) proposals received under Invitation to Qualify (ITQ) 11-
5681 Rehab of Residential Structures and reissue a new solicitation.
OBJECTIVE: To re- qualify contractors for the rehabilitation of owner- occupied single family residences
using Neighborhood Stabilization Program (NSP) grant funds, by incorporating additional selection
criteria needed for compliance with Section 3 of the Housing and Urban Development (HUD) Act of
1968.
CONSIDERATIONS: ITQ 11 -5681 Rehab of Residential Structures was issued on May 20, 2011, with
approximately 1,192 notices sent to vendors. One Hundred and twenty one (121) vendors downloaded
the specifications, ten (10) proposals were received; one (1) proposer returned a "not interested"
response.
All ten (10) proposals received were qualified under the original terms of the solicitation package;
however, it was later determined that the critical HUD Section 3 selection criteria was missing.
Section 3 of the Housing and Urban Development Act of 1968 provides that, to the greatest extent
feasible, opportunities for training and employment shall be given to recipients of public housing and
lower- income residents of the unit of local government in which the project is located. Contract work in
connection with such projects shall be awarded to business concerns which are owned in substantial part
by persons residing in the same metropolitan area as the project, employ Section 3 residents in full -time
positions, or subcontract with businesses which provide economic opportunities to lower income persons.
The ITQ as written did not provide a 15 — 25% weighted criteria for Section 3 business concerns, and
therefore, staff recommends rejecting the ten (10) proposals received and re- issuing a revised ITQ that
includes the HUD Section 3 weighted criteria. Pursuant to recent changes to Section 119.071(3) F.S., the
proposals received shall not be released into the public record until staff recommends an award under the
new solicitation.
FISCAL IMPACT: There is no fiscal impact in the approval of this Executive Summary.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's
Office and is legally sufficient. This item requires a majority vote. — JBW
GROWTH MANAGEMENT IMPACT: There is no growth management impact in approving this
Executive Summary.
RECOMMENDATION: That the Board of County Commissioners rejects the ten (10) proposals
received under ITQ H -5681 Rehab of Residential Structures and directs the County Manager to resolicit
the invitation to qualify.
