Agenda 06/28/2011 Item #10E 6/28/2011 Item 10.E. EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners (BCC) approves a Land Development Code Amendment Cycle. OBJECTIVE: To have the BCC approve an LDC Amendment cycle in the fall of201 I (Fiscal Year 2012). CONSIDERATIONS: The adoption process for the Administrative Code includes Staff review of the consultant's draft. During this review, Staff has found inconsistencies in the LDC which were inadvertently omitted or changed during the recodification of the LDe. Some of these "glitches" may be substantive and therefore; may not be addressed in the Administrative Code. In addition, the County Manager invited the Collier Building Industry Association (CBIA) to suggest possible amendments to the LOC which may spur economic activity without affecting the high quality of development in the County. The CBIA has suggested several LOC Amendments. /- Recent Growth Management Plan Amendments also require LDC Amendments for implementation. County Staff, in the course of reviewing permits and applications, also has suggestions for improved efficiency in the LOC. There is also State legislation that mandates local changes to the LDC. FISCAL IMP ACT: County Staff will review proposed amendments and be involved in the public hearing process for LDC Amendments. Individual amendments may also have fiscal impacts, but they will be considered during the public hearing process. The work will be completed by existing budgeted employees and budgeted operating funds. GROWTH MANAGEMENT IMPACT: Approved Growth Management Plan Amendments will require LDC Amendments for implementation. LEGAL CONSIDER<\TIONS: This item is legally suflicient. A majority vote is needed for Board approval. HFAC RECOMMENDATION: That the BCC approve an LDC Cycle Amendment and direct the County Manager or his designee to schedule the nccessary hearing dates.
