Agenda 07/10/2018 Item #16E 107/10/2018 EXECUTIVE SUMMARY Recommendation to approve a Resolution to execute a standard form Interlocal Agreement for use with local governments, independent fire districts and other first responder agencies for re - fueling during wildfires or extended fire response without further Board action. OBJECTIVE: To provide fuel during wildfires as the provider of last resort and establish an efficient process to ensure that all costs of fuel under mutual aid situations are reimbursed to Collier County in a timely fashion. CONSIDERATIONS: The Board of County Commissioners (Board) frequently serves as the provider of fuel as a last resort on the site of wildfires. This item is to formalize a documented, uniform procedure to process reimbursements to the County. Acco rdingly, a standard form interlocal agreement for re -fueling was developed for use. Terms of the agreement include: 1. Request for emergency refueling by Collier County shall be reported to the Collier County Director of Emergency Management or designee. 2. Users submit an open purchase order to Collier County’s Department of Emergency Management on March 1st annually for fuel expenses against which fuel expenses will be invoiced. 3. Collier County will only charge for fuel at its wholesale or governmental entity cost. 4. In all cases the local governments, independent fire districts and other first responder agencies will be responsible for all costs including those of their respective local assets and resources, as well as those costs associated with all mutual aid resources assisting that authority having jurisdiction. 5. Terms are “net 30 days” from receipt of fuel to the jurisdiction requesting re -fueling supplies and delivery resources. 6. Agreements are valid for a period of three years with (3) one-year automatic renewals and a 60- day written notice termination clause by either party. 7. Collier County shall not be liable, under any circumstance, for the failure or delay to deliver fuel under the terms of this Agreement. 8. Local governments, independent fire districts and other first responder agencies shall indemnify Collier County. Also presented with this item is a resolution authorizing use of a standard form Interlocal agreement for re -fueling (Exhibit “A” to the resolution). This resolution authorizes the use of the standard form agreement without further approval by the Board of County Commissioners. FISCAL IMPACT: The wildfire season of 2017 provided a historical estimation of approximately $7,000 per year that could be expended dependent upon the magnitude of the fire season or other extended fire event. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this action. LEGAL CONSIDERATIONS: Non-Standard interlocal agreements will continue to be presented to the Board for consideration. If this item is approved, Agreements confirmed as using the standard form will be processed for Board Chairman signature without further action. Agreements will be maintained by the Clerk to the Board at the Minutes and Records Department.
