Agenda 07/10/2018 Item #16D 707/10/2018 EXECUTIVE SUMMARY Recommendation to accept an extension to the State Housing Initiatives Partnership (SHIP) Program grant expenditure deadline for Fiscal Years 2014/2015 and 2015/2016 granted by the Florida Housing Finance Corporation (FHFC). OBJECTIVE: To continue to promote affordable housing strategies for low to moderate -income persons through the SHIP Program. CONSIDERATIONS: On July 7, 1992, the Florida legislature enacted the William E. Sadowski Affordable Housing Act to provide funding to local communities to promote and advance affordable housing initiatives. Funds are generated through documentary stamp tax on real estate transactions. Under the SHIP Program, Collier County and the City of Naples receive funds from the State of Florida through the FHFC to undertake eligible activities as outlined in the Board-adopted Local Housing Assistance Plan. Community and Human Services Division (CHS) received an extension from FHFC for the SHIP FY 2014/2015 expenditure deadline. The deadline was extended from June 30, 2017 to March 31, 2018. As a result of Hurricane Irma and the availability of contractors and supplies it was necessary for CHS to request an additional time extension to complete projects. On March 8, 2018, the CHS Division requested an extension to the expenditure deadline for Collier County’s FY 2014/2015 SHIP funding. The extension was requested in order to complete projects under the Rehabilitation Program previously approved by the Board of County Commissioners (Board). On March 20, 2018, the FHFC granted the extension, moving the deadline from March 31, 2018 to June 30, 2018. Staff is on target to expend the funding. On May 17, 2018, CHS requested an extension to the expenditure deadline for Collier County’s FY 2015/2016 SHIP funding. The extension was requested due to delays resulting from the aftermath of Hurricane Irma. Our rehabilitation partners had significant delays and setbacks in securing contractors or goods in order to complete rehabilitation due to the demands created by Hurricane Irma. On June 6, 2018, the FHFC granted the extension, moving the deadline from June 30, 2018 to December 31, 2018. FHFC does not require the Board Chairman to sign a document for the extension to take effect. FISCAL IMPACT: The proposed action has no new Fiscal impact. The funding source for the grant is the FHFC. Funds are budgeted within SHIP Grant Fund (791), Projects, 33331 and 33429. LEGAL CONSIDERATIONS: This Item is approved as to form and legality and requires majority vote for approval. - JAB GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this extension will further the Goals, Objectives, and Policies within the Housing Element of the Growth Management Plan. This six-month extension will ensure that the County expends all of FY15/16 SHIP funds for approved strategies, in a compliant manner. As of today, we have encumbered the entire FY 15/16 allocation, $1,660,124.00 and have expended nearly half, $761,711.23. We anticipate additional expenditures by 6/30/2018. Once fully expended, we will meet 100% of our set-aside requirements. In our program execution, we have experienced the most difficulties in the owner occupied and rental rehabilitation programs. Consistent with information provided in our extension request for the FY14/15 funds, our rehabilitation partners have had significant delays and setbacks in securing contractors or goods in order to complete rehabilitation due to the demands created after Hurricane Irma. Of late, these issues have lessened and the projects are again moving forward. Exhibit A shows the details of the status of each strategy and clearly illustrates all the programs are fully in motion, just needing additional time to complete. In consideration of our request, we wish to provide Florida Housing Finance Corporation with some assurances and information on the subsequent funding years. We are happy to report that both in order to meet hurricane response needs AND to accelerate expenditure of funds, Collier has encumbered all of the 16/17 and 17/18 funds, and have even expended over $500,000 to date. The details of the strategies and current status can be found on Exhibit B, attached to this letter. At this point we anticipate meeting the expenditure deadlines for both of these allocations. According to Rule 67-37, which governs the SHIP program, exceptions to the timeframe, are allowable under certain conditions, as detailed below: The funds deposited to the local housing assistance trust fund must be spent within twenty-four months from the end of the applicable State fiscal year. Exceptions will only be granted for good cause. Examples of good cause are natural disasters, requirements of other State agencies, adverse market conditions, and unavoidable development delays. Adequate documentation detailing the reasons for the requested extension as well as a timeline for completing the expenditure of funds must be submitted to the Corporation before an extension will be granted, e.g., project status, work plan and completion schedule, commitment of funds, etc. The Corporation may require a local government requesting an expenditure extension to receive technical assistance through the Catalyst program to evaluate the need for an extension. Florida Housing believes that your current situation warrants an additional extension based on the reasons presented in your correspondence. Therefore, your deadline to expend funds for the 2015/2016 fiscal year is extended by six (6) months. The new deadline is December 31, 2018. We do stipulate, however, as a part of this extension, when requested, the County provide the Corporation a written update outlining the status of the current spending. Please keep in mind that you are still required to submit an annual report by September 15, 2018. The Corporation commends your continuing efforts to benefit the citizens of Florida through the SHIP Program.
