Agenda 07/10/2018 Item #16D 107/10/2018 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to execute a Memorandum of Agreement between the Florida Fish and Wildlife Commission and Collier County to restore and stabilize the Lake Trafford shoreline and enhance the lake’s aquatic habitat at Ann Olesky Park and make a finding that the related Tourist Development Tax expenditure promotes tourism. OBJECTIVE: For Collier County (County) to enter into a joint effort with the Florida Fish and Wildlife Commission (FWC), whereby each party will undertake certain responsibility and obligations as defined in a Memorandum of Agreement (MOA) between the parties to restore and stabilize the Lake Trafford shoreline. CONSIDERATIONS: There has been a significant loss of shoreline erosion at Ann Olesky Park due to a combination of wave action and storm-water runoff. The approximate 400-foot shoreline has experienced severe erosion, which has not only caused a loss of park area but has caused environmental impacts such as increased water turbidity and reduced fish populations near the park. In addition, the sediment buildup at the boat ramp requires constant maintenance to remain safe and operational. The FWC wishes to join with the County’s shoreline stabilization project to include lake bottom enhancement plantings and fish attractors. Parks & Recreation’s shoreline stabilization portion will include a “geo-grid mat” which will be installed along the shoreline to protect against wave action. The geo-grid mat is a three-dimensional honeycomb-like structure that allows plant growth. FWC’s work scope for habitat restoration will include gravel bed fish attractors and plantings to enhance fishing and marine environment along the park perimeter. The County will provide project and construction management services for this project. FWC will contribute $138,000 to this project to cover the aquatic enhancement work and shoreline stabilization. FWC shall reimburse Parks & Recreation within 40 days of receipt of each invoice. Reimbursement shall include, but not be limited to, earthwork, mobilization/demobilization, plantings, shoreline stabilization, and lake bottom enhancements (i.e., both the County’s and FWC’s scope of work). Given the severity of erosion at this location, the Parks and Recreation Division is seeking to use Tourist Development Tax for the shoreline stabilization. In 2016, Parks and Recreation spent $15,916 on an erosion control methods report, $8,084 for alternatives and permitting analysis, and $93,162 for design, permitting, and construction administration services to RWA Inc. Ann Olesky Park has the only public fishing pier to the largest freshwater lake south of Lake Okeechobee and attracts many tourists to Immokalee to enjoy the pier and related amenities. To protect the natura l resources of Collier County, the Division has requested Tourist Development Tax funds in the amount of $260,000 to support this purpose. The Tourist Development Taxes may be used for shoreline stabilization but not for aquatic enhancement such as plantings and fish attractors. The MOA specifies the terms and conditions on which both parties are willing to proceed to provide mutually beneficial support in their respective efforts to complete work as a unified project. FISCAL IMPACT: The requested TDC Grant for shoreline stabilization will be provided from the upcoming FY2019 TDC Grant Request. The FWC and Parks & Recreation funded components of the project will be handled through Parks Capital Improvement Fund (306). Shoreline stabilization is an authorized use of tourist development taxes pursuant to Section 125.0104(5)(a)5, which provides that tax revenues may be used for “construction of beach groins and shoreline protection, enhancement, cleanup, or restoration of inland lakes and rivers to which there is public access as those uses relate to the physical preservation of the beach, shoreline, channel, estuary, lagoon, or inland lake or river.” The tax revenue may only be used as defined herein and therefore may not be used for the aquatic improvements such as plantings and fish replacement. The budget included in this Executive Summary identifies the funding source for each element of the project and specifically notes that Staff is seeking tourist development tax (with a separate funding request) for shoreline stabilization only. -CMG ADVISORY BOARD RECOMMENDATION: On November 15, 2017, the Parks and Recreation Advisory Board approved this project. On May 10, 2018, the Coastal Advisory Committee approved the Fiscal Year 2018-2019 Fund 195 Grant application, with $260,000 approved for Ann Olesky Park Shoreline Stabilization, with a vote 5-2. On May 29, 2018, the Tourist Development Council approved the Fiscal Year 2018-2019 Fund 195 Grant application for $15,077,200, with $260,000 approved for Ann Olesky Park Shoreline Stabilization, with a vote 8-0. GROWTH MANAGEMENT IMPACT: There is no impact to the current Growth Management Plan. RECOMMENDATION: To approve and authorize the Chairman to execute a MOA between the FWC and Collier County to restore and stabilize the Lake Trafford shoreline and enhance the lake’s aquatic habitat at Ann Olesky Park and make a finding that the related Tourist Development Tax expenditure promotes tourism.
