EXECUTIVE SUMMARY Recommendation to approve defined maintenance responsibilities for specific public, but unaccepted unplatted roadways in Collier County. OBJECTIVE: To clarifY the defined maintenance responsibilities for several public roadways in Collier County that have not been accepted for County maintenance, but have been the subject of sporadic and minimal maintenance activities over the years, to address public health, safety and welfare. CONSIDERATIONS: There are numerous roadway segments in the Collier County area that are unplatted and/or unaccepted that the Road & Bridge Maintenance Department has perfonned sporadic and minimal maintenance on over the years, to address public health, safety and welfare. Exhibit "A", attached, is a detailed listing of those specific unaccepted roadways that the Road & Bridge Maintenance section of the Growth Management Division, is requesting to continue to perfonn minor maintenance activities in the interest of public health, safety and welfare. Over the years, decisions to provide periodic, limited maintenance has raised questions on what role the County should take on those roadways. This action by the Board is sought to resolve the continuing debate over whether public funds should be spent on these maintenance efforts and the level of maintenance to be provided on those public roadways not in the County roadway system. At no time will any roadway be removed from the list or added to the list, without the Board of County Commissioners approval. The Road & Bridge Maintenance Department will only perfonn the specific maintenance activities listed on Exhibit "A", with no deviations, without Board approval. A Resolution is attached as Exhibit "B", to this Executive Summary granting the Road & Blidge Maintenance section of the Growth Management Division, the ability to continue to perfonn the approved maintenance activities until such time as the Resolution is either rescinded or amended by the Board of County Commissioners. In the future, should residents of these areas request improvements, residents will be required to enter into a MSBU. FISCAL IMP ACT: Road and Bridge Maintenance Department estimates that it will cost approximately $25,000.00 annually to perfonn the specific maintenance activities for the listed roadway segments. Funds are currently available in the Growth Management Division 10 1 Operating budget. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. A.ttomey's Office that to ensure that there is a public purpose for the expenditure of funds used . to maintain private roads, and to diminish the long-term costs of the County in obtaining public right-of-way, that the County secure public right-of-way easements as a condition precedent to maintenance. That process can take years, and is admittedly easier said than done. Having said this, the item is legally sufficient, provided that the Board find a public purpose for the expenditure of these funds. -JAK RECOl\1MENDATION: That the Board of County Commissioners of Collier County, Florida, approve the attached Resolution and roadway list for specific maintenance activities to be performed by the Road & Bridge Maintenance Department. RESOLUTION NO 2011- A RESOLUTION DIRECTING THAT CERTAIN UNPLATTED UNACCEPTED ROADWAYS WITHIN COLLIER COUNTY BE MAINTAINED BY COLLIER COUNTY IN ACCORDANCE WITH THE SPECIFIC GUIDELINES ATTACHED HERETO AS EXHIBIT 'A'. WHEREAS, certain roadways in unincorporated Collier County have been sporadically maintained by the Road and Bridge Section of the Growth Management Division of Collier County; and WHEREAS, said roadways have not met the minimum standards for acceptance by Collier County due to lack of sufficient right-of-way ,absence of acceptable drainage capability, lack of paved surface, or other similar defects, but said roadways are deemed to be public roadways by virtue of the public's open usage and acceptance of said defects; and WHEREAS, the Board of County Commissioners has determined that it is in the public interest that the Road and Bridge Section of the Growth Management Division continue to maintain said roadways, as enumerated below, for reasons of public health, safety and welfare. NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY FLORIDA, that: 1. The Road and Bridge Section of the Growth Management Division will maintain the specific roadways listed on Exhibit A attached hereto and made a part hereof. 2. Maintenance activities shall be subject to the following constraints and conditions: a. The existing roadways shall be maintained to the limits of the traveled way which existed on the date of approval of this Resolution. The Road and Bridge Department of the Growth Management Division has caused inventory of the specified roadways to be made as of the date of approval of this Resolution. The basis for all specific maintenance shall be as set forth on the inventory attached herewith as Exhibit "A". b. No additional improvements of any kind, shall be undertaken without the express approval of the Board of County Commissioners 3. If any property owner or group of property owners, desires to have the roadway improved beyond what exists at the time of approval of this Resolution, then said property owner(s)shall petition the Board of County Commissioners in accordance with the requirements of Resolution No 95-454. Alternatively, said property owner (s)may petition the Board of County Commissioners in accordance with Ordinance No 98-45 for the formation of a Municipal Services Benefit Unit MSBU for the purpose of improving roadway Minimum County standards then in effect. ThetBoard of County Commissioners may, at some future date, determine that i is in the public interest to require the improvement of any or all of the said roadways to the then current minimum county standards. The Board of COUity Commissioners may, upon finding that it is in the interest of public health, safety and welfare, invoke the power provided under Section 125.01 (1) (q), Florida Statutes, to form an MSBU. 5 The Board of County Commissioners finds that the expenditure of funds for the maintenance of the aforementioned roads is in the best interest of public health, safety and welfare and constitutes a valid public purpose.
