EXECUTIVE SUMMARY
To update the Board of County Commissioners (Board) on Public Petition Item #6A discussed at
the Board of County Commissioners meeting on January 11, 2011 by Anton Karaba and Eva
Karabova seeking approval to retain the ten-foot fence built on property located at 12243 Fuller
Lane.
OBJECTIVE:
To respond to the Board's direction for staff to investigate the matter and report the findings in a
public hearing as the result of a code violation.
CONSIDERA TIONS:
A code enforcement case was opened (CEAU20090008537) for an unpermitted fence due to a
site visit on May 19, 2009.
After hearing Mr. Karaba's concerns, the Board directed the County Manager or his designee to
review the circumstances regarding Mr. Karaba's claims and assist him in achieving compliance.
Based on Board direction staff accrued outstanding hours not associated with fee based services.

On January 11, 2011, Anton Karaba appeared before the Board seeking approval to retain a 10-
foot high fence on property located at 12243 Fuller Lane. He cited safety concerns relating to
gang activity, thefts, and unconfined animals running loose.
As a result of Mr. Karaba's concerns, statistics relating to gang activity and arrest data were
provided by the Sheriff's Office and service call data was provided by the Domestic Animal
Control. (See attached staff report)
The property o'Vvner submitted all required documentation and was issued a building permit for
the existing 10-foot fence located at 12243 Ful1er Lane. Upon staff review, a Certificate of
Occupancy was issued on May 18, 2011.
FISCAL IMPACT:
The Fiscal Impact estimated to be in the amount of approximately $3,150 for County staff hours
allocated to the research, meetings site visits and preparing for presentation to the Board.
LEGAL CONSIDERATIONS: This Executive Smnmary has been reviewed by the County
Attorney's Office and is fom1d legally sufficient. (STW)

BACKGROlThTD INFORMATION
During a site visit on May 19,2009, a Code Enforcement Investigator noticed the height of the fence
located at 12243 Fuller Lane in the Victoria Falls neighborhood. A Code Enforcement Case (Case
No. CEAU20090008537) was opened and records researched. It was discovered that a permit had
been applied for in 2005 but had never received a Certificate of Completion due to a failed
inspection. Pennit No. 2005040965.
May 29, 2009, a Notice of Violation was sent certified and first class mail and posted at the property
and cOUlthouse.
May 7, 2010 the homeowner was found to be in violation by the Special Magistrate and ordered to
abate the violation by obtaining a building pelmit or demolition pennit and remove the fence by
August 15, 2010 or a fine in the amount of $1 00 per day would be assessed.
August 6, 2010 the respondent's request for an extension oftime was denied by the Special
Magistrate.
September 3, 2010, an Imposition of Fines hearing was continued by the Special Magistrate until
December 3, 2010.
December 3, 2010, the case was withdrawn from the Imposition of Fines hearing to be brought back
at a later date.
March 17,2011, a meeting was held with Mr. Karaba and he was given written options on how to
correct the violation. Mr. Karaba was also given the opportunity to ask staff any questions that he
may have.
July 1, 2011, current Imposition of Fines hearing scheduled.
Description of Fence
The actual construction of the fence includes an approximate 2'-0" high stem wall foundation with a
wooden fence installed on top of the stem wall. The fence height is variable due to ground level
conditions, and greatly exceeds the 6'-0" height and constructability indicated in the original permit
application.

FENCE fERMIT NO. 2005040965 (see Attachment A)
A permitifor a 6 foot wood fence was issued on April 7, 2005 for property located at 12243 Fuller
Lane. This permit never received a Certificate of Completion and expired on October 4, 2005.
(see Atta4hment B)
Inspection Results:
On Septelnber 26,2005, the final inspection was perfonned by a structural inspector and failed due to
the fence: exceeding the height approved on the permit, fence posts were not 4"x4" as required and
the fenceiheight exceeded 6'-0" as approved on the building permit. Additionally, the construction of
the fence did not match the infonnation included in the permit application.
The PlanjReview and Inspection Department inspects the final product to verify location and height
approved: by Zoning Services for each permit. Building inspectors also verify that the material of the
structureS is in accordance with the approved documents. Since this permit differs from the original
permit, tHe inspection could not be approved.

The PlaniReview and Inspection Department will ensure compliance with section 1805 of the Florida
Building Code (FBC) 2007 with 2009 supplements which will address foundation (stem wall).

The Flori:da Building Code (FBC) has specific requirements for fences built in the high velocity zone
only (Mi~111i-Dade & Broward County) Collier County is not located in a high velocity zone and
thereforelthere is no specific requirement for the construction of a fence.

SITE VISIT - BUll..DING DEPARTMENT
On Thur$day, January 27, 2011, Structural Inspector Tim Stick visited the job site at 12243 Fuller
Lane to perform an inspection on an existing fence.

The exis~ing fence was not constructed as outlined under Pennit No. 2005040965. The original fence
pennit was specified per high velocity design standards and a maximum height of 6'-0"; the
construc~ion of the actual fence meets common practice construction standards and it appears to be
structura'ly sound. With regards to the height, this is variable due to site conditions. Height varies
between ~, -0" to 9"-0" to maintain top of fence at the same level.

A new ~ennit shall be obtained, including details for stem wall and foundation which was not
included i in the 2005040965 permit. Under the Florida Building Code, there are no specific
requirem~nts for construction of a fence except for fences located in the high velocity area. Collier
County does not have high velocity areas. Therefore, a permit to legalize the construction of this
fence cali be approved as long as all zoning requirements are met.

ENGINEERING DEPARTMENT SITE VISIT
The fence has no direct affect on the neighbors to the East or to the West as far as site drainage is
concemdd. The stem wall/fence does however protrude into the rear drainage easement. The oVlrner
should b~ required to have an engineer review the conditions to determine that there is not a negative
impact or conveyance. If the swale is being utilized for storage as well then the engineer would need
to show that compensating storage is still being provided on the subject property. With a report from .

responsible entity for the swale) the current utilization of the easement would be allowed. (Site visit
pelformed by Daryl Hughes, Inspections Manager, Engineering Review Services)
COUNTY SURVEYOR'S REPORT
County Surveyor Stephen Higgins did a site visit to the Victoria Falls home located at 12243 Fuller
Lane on Thursday, February 3, 2011 with Claudine Auclair, Business Center Manager. They met
with Mr. Karaba who took them to the rear of the property. Mr. Higgins performed several readings
with his surveying equipment and other measuring tools. The fence was measured to be 6 feet high
and located above a concrete wall measuring about 2 feet in height. There is a 7" support beam on
which the fence rests.
The crown elevation of the road was established at between 6.27 to 6.20. The total height of the
fence was measured at 8 feet 7 inches.
The fence was built in a drainage easement that is dedicated to Collier County for the purpose of
accessing and maintaining its respective facilities, with no responsibility for maintenance.

VICTORIA FALLS PUD DOCUMENT REGULATIONS - ZONING
The fence meets Zoning requirements in accordance with the Victoria Falls PUD which was
originally approved in 1980 under Ordinance No. 80-62 and was later amended in 1991 by Ordinance
No. 92-86. A final amendment to the PUD was adopted on November 23, 1999 by Ordinance No.
99-83.
In accordance with Section 3.4, Development Standards, the minimum yard setbacks for both
Principal Structures and Accessory Structures are:
Front Yard: 20 ft.
Side Yard: 7.5 ft.
Rear Yard: 20 ft.
Minimum Distance Between Structures: 15 ft
Section 5.11, Landscape Buffers, Benns, Fences and Walls, states:
Fence or wall maximum height: 9 feet, as measured from the finished grade of the ground at the base
of the fence or wall. For the purpose of this provision, finished grade shall be considered no greater
than 18 inches above the crown elevation of the nearest existing road, unless the fence or wall is
constructed on a perimeter landscape benn. In these cases, the fence or wall shall not exceed 6 feet in
height from the top of benn elevation with an average side slope of great than 4: 1 (i.e. 3: 1, 1: 1, or
ve11ical).

cUlTently two (2) documented gang members and one (1) gang associate residing in the Victoria Falls
development. There has been no gang activity within the development in the past calendar year.

OPTIONS A V All..ABLE FOR RESOLUTION
The following options are available to Mr. Karaba to resolve the fence issue.
1. Apply for a demolition pennit to remove the entire fence.
2. Apply for a new building pennit for the fence, including an engineer's letter confirming de
minimus impact.
. The new building permit must include the stem wall on which the fence was built but not
detailed in the original building pennit application. The Florida Building Code does have
specific guidelines for foundation walls under Section 1805, therefore the new building
pennit will have to be reviewed and inspected to ensure compliance with this section of the
Florida Building Code.
. However, due to a change in the grading of the site, the Engineering Review Services will
need to review the building pennit application to ensure the lot drainage meets the
conditions of the plans approved during construction of this subdivision and to evaluate the
impact of the grade elevation change on the adjacent properties.
. The new building pennit will also need to be in compliance with the design standards (height
limitations) allowed in the PUD Ordinance. A fence 9 feet in height may be allowed if it
meets the requirements of Section 5.11, Paragraph B of the PUD Ordinance.
MEETING WITH MR. KARABA - MARCH 17, 2011
PlmUling and Regulation staff met with Mr. Karaba on Thursday, March 17,2011 to review the
findings of this staff report. The following are the steps he needs to take to resolve the unpennitted
fence.
. Mr. Karaba must obtain an engineered site plan drawing to show that there is minimal to no
impact to the drainage/retention area located behind his home. This drawing will satisfy the
PUD requirements for site drainage and retention. Claudine Auclair, Business Center
Manager, will provide Mr. Karaba with engineering finn points of contact in the area that
might assist him in acquiring the engineered site plan drawing.
. Mr. Karaba must provide, to Gary Harrison, Building Official, construction drawings to
indicate how the wall was constructed and how the fence is secured to the retention wall that
was erected. These drawings do not have to be signed and sealed by an Engineer as long as
they meet the construction standards of the FIOlida Building Code.
. Once received, and all conditions have been satisfied, Mr. Karaba will need to apply for a
building pennit for fonna1 review and inspection. All applicable building permit and
inspection fees will apply.
. Staffwill continue to monitor the status and prepare an update to the County Manager's
Office as well as the Board of County Commissioners.

on several occasions to assist in what was needed to secure a permit since the original permit had
expired. ;

The applifant was required to submit:
1. V~rification that the Home Owners Association did not object to the wall/fence within the

2. V~rification from an engineer that there would not be a negative impact on the storage or

We've been seeing over the years a trend toward people trying to
use other countries to bring in fruits and vegetables. So that hasn't
been a good thing for this area. So actually the specialists at the
university are looking at this trend also.

asking:for a variance to regulations for our project of wood fence.

we tried to build it our best knowledge in the conditions we live and
where we live to protect our faInily and our property and privacy, so
we tried to build it strong.
Also, hurricane I think it was Wihna, in 2005, it withstood that.
It stay and didn't do any damage, so it's hun"icane proof.
Looks like the lnain problem is it's not going down like copying
the property or the terrain down to the canal. So if I built a fence in
the canal there is lnight be two feet water, it's going to rot in a few
years, Inaybe. .And the water was cOIning up to our property so we
had to deal with tIns problem.
So we're living in an area built by Habitat for Hunlanity of
Collier County.
When we asked the management of tIns Habitat for Humanity to
build our property right, that's mean fill the property with lnore dirt so
the water is separated or it's built kind of canal for the water going
away, we got an answer, no.
So then we spend a lot of Inoney and hours of labor to fix this
and other problems for our safety and fighting crhne in our place
where we live.
When we cOInplain about the conditions froln the beginning
where we live, our reward was hate and retaliation at any chance, and
nothing changed to better.
I would like to l1lention a few exalnples. When we built the
fence, we had to do it because next door neighbor, they got thTee big
dogs running around, sOlnetnnes on the streets, picking up dust under
our windows because we have very close houses. And if it's a nice
weather, we would like to enjoy the Florida weather, you know, open
the winds and fi-esh air.
So barking, nless, stink, anything from the dogs_ So we had to
build sonlething really good.
The other thing was stealing of our properties by neighbors
gangs. .And a few thnes it was in the night, nights. SOlnetllnes it was

when we been absent from our house. They make damages. When
we been away from our house. That was maybe during the day or
something. We don't know. . ,"
So I have copy of the letter, I can leave the letter here.
We have also damages to our 'house. Mostly doors, windows.
When we left for summer last year, that was in 2008. We put
hUITicane shutters on the windows. Next day we had letter fi.om
Habita~ and code enforcement, we have to put it down on the fine.
Next day sOlnebody broke a lot of house. Broke window,
damag~d doors, and did lots of damages. We found out later. So that
was like galne.
You know, we are trying to Inake some kind ofnonnalliving

conditions where we live. So we notified first the Habitat for
Hunlallity Inanagement, do some kind of rules because they can do it.
And if~hey do it, the people will listen, I think.
And then they said call police. Okay, we call police. And they
didn't help us. We call code enforcelnent, animal control. Sometunes
they did sOlnething if the anlllals are running froln (sic) the streets and
doing tPis really unpleasant and health probleln also. I don't want to
naIne it, but everybody knows, I think.
S9 when we had these problems and called police, nobody was
found guilty. And we were not compensated for our dalnages.
Big concenl is also loud dirty ITIusic and other noises. You
know, picking up dust, snlells. I don't know, sonletulles it's like
sOlnebody's bUlnulg tires or sOlnething. So if you open the windows,
you get it in, you cannot get it out. So it's also kind of -- and
cheIniaals. I don't know, sonlebody spraying sonlething.
sb it's noisy.. Is like loud trucks and blowing hOIns. And noisy.

It's lat~ or early in the nlonung, parties and this bad behaviors. They
are no~ kind of regulated in the our place. Nobody was stopped to do
these activities or filled. Police or -- I don't know if it's code
enforc~ment. Because they said it's code enforcement problelns,

police problem, whatever. But nobody measure anything, nobody fix
this probleln, nobody was fined. So the people do these activities
ongoing basis.
I have one exalnple also about these problelTIs here. I don't want
to read it because I don't know if I can say natne or number of the
house and this infolTIlation. So I'll just leave tIns letter here so you can
look at it.
So we nlostly can say we that separate our property fi"om the
canal because of the water. Especially over the SUlnmer, the water
stays for long time. If anything if can -- like mosquitoes, snakes and
anything, it's a health hazard.
So we would like to ask the Cormnission to approve our project.
And if there is any unpleasant like fees or paynlents or any ldnd of
threats (phonetic) or I don't know how to call it, you would like to,
you know, abate it.
And what I can say, it's really bad econolnic times, so we
sacrificing a lot. And tIns is not any pleasant thing to deal with, the
stinks. In the past and these present days.
All I can say, that the fence is built strong and was flXed and
painted. You IG10W, we trying to nlake our property nice, about two
years ago. So -- I think we trying to do the place safe also for the
neighbors.
CHAIRMAN COYLE: Your titne has expired.
I think we get the gist of YOUl" concern. So that you Ullderstand
how these proceedings take place, it is not nonnal for us to solve these
problems today. TIns is a public petition to see if there's sufficient
support on the board to bring tlns issue back for a full hearing where
we would have the staff investigate and provide infonnation to us.
I would like to suggest, though there. atoe two cOIDlnissioners who
would like to Inake conunents. But I would like to suggest that the
two cOlmnissioners consider the possibility of us providing guidance
to the staff to work with you about solving some of those problelTIs.

I did take the time to pull up their pennit on this, the 2005 pennit.
And ac~ording to our staff, not only do we have a height issue, but the
posts were not four-by-four. And you applied for a six-foot wooden
fence. J asked staff for some more information, and they provided
pictures. Even if this was a public petition, I would really question
whether I would approve the consuuction of this fence. Not because
of the Height so Inuch as it's the way it vvas constructed. I don't think it
belongs in any neighborhood.
So I can't support bringing this back unless -- you always have
the riglit to apply for a variance, and I will listen to it. .

Ineans of redress has legally been established for the public to avail
thetnself in a situation like yours. It really isn't fair when everyone
else in the public is applying for variances, going tln.ough that avenue,
and you are circumventing that process and cOIning to the board
tln.ough the public petition process to avoid those types of hearings.
So my suggestion is that you apply for a variance tln.ough the
established legal process for that particular issue.
MR. KARABA: I don't understand. I don't know what you're
talking. .
COMMISSIONER HILLER: What I would recormnend --
MR. KARABA: I don't know the rules or whatever.
COMMISSIONER HILLER: Right. .And that's what we have
staff for. And I think the director of that division, Mr. Casalanguida,
can explain how to apply for it.
Has no one told you that you can apply for a variance through a
variance process?
MR. KARAB.A: No, no, I talk to building departlnent or zoning
depali111ent. Nobody gave n1e straight answer. Only sOlnebody said
you go and do the petition for the -- to the COlnmissioners. That's
what they told me if.
COMMISSIONER HILLER: Mr. Casalanguida, did your
division not explain to him?
MR. CASALANGUIDA: I believe that we did. For the record,
Nick Casalanguida.
.And if there's clarification, we'll gladly sit with the gentlell1an
and walk hiln through it. But I think we clearly explained there is a
variance process and application fee. .And I think both code explained
that and our staff did. And I'ln happy to walk hiln tln.ough it very
clearly and detailed.

sheriff has to be Il1ade aware of. And I would like to know what is
going qn with respect to gallgS in those and in any other type of
cOInm.ttnity. Because obviously it's disconcerting. You obviously
work v~ry hard to try to buy a house for you and your family.

The fence should not be the reason -- I mean, you should not have to
build a fence to protect yourself against water damage if there's
improper drainage with respect to that property.
Mr. Casalanguida? At the same titne, could you help him with
his drainage concerns? Obviously if you've got a canal that's not
