EXECUTIVE SUMMARY Recommendation to request the Board of County Commissioners (Board) waive false alarm citation fees for the District School Board of Collier County. OBJECTIVE: To have the Board approve waiver of citation fees incurred for false alarm citations. CONSIDERATIONS: The District School Board of Collier County has received fifty one False Alarm citations since May of 2006. The total amount of citation fees due, including collection fees, is $4,867.88. The Collier County School System has achieved compliance to assure no additional false alarms occur by repairing and/or replacing the entire alarm system at locations cited. There has been no re-occurrence of False Alarms since the repairlreplacement action was taken. The Collier County Sheriff's Office reviewed and has concurred that the citation fees should be waived. FISCAL IMPACT: If approved by the Board, citation fees in the amount of $4,867.88 will be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. LEGAL CONSIDERATIONS: The False Alarm Ordinance provides in relevant part that "Fines and costs imposed against a responsible party are to be distributed as follows: $5.00 to Collier County Code Enforcement as an administrative fee, and the balance of the funds of each fine is to be deposited in the fine and forfeitures funds of the sheriff's office to offset the sheriff's operating budget costs." The Sheriff has already agreed to waive the sums due his Office. Of the amount due, only $255 is owed to Collier County. It is this amount that the Board is being asked to waive, which waiver requires majority approval. JAK RECOMMENDATION: That the Board waive the False Alarm citation fees. After being briefed by you about the modification of Code Enforcement, especially since the downturn in the economy, to work with those who have been fined to come into compliance, along with reviewing the steps by the C.C.P.S. to repair or completely replace those alarm systems that were not functioning properly, I am supportive of the recommendation by the Executive Summary to waive the citation fees based on their efforts to fully come into compliance.
