EXECUTIVE SUMMARY Recommendation to adopt a Resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11. OBJECTIVE: To have the Board of County Commissioners (Board) approve a resolution amending the Collier County Administrative Code Fee Schedule of development-related review and processing fees as provided for in The Code of Laws and Ordinances, Section 2-11. CONSIDERATION: Fees are collected by the Growth Management Division, Planning & Regulation Section (GMD P&R), for land development review and inspection services. Currently, there are no refunds of planning, environmental or engineering related fees, except those applications which have been deemed not sufficient for staff review and withdrawn within thirty (30) days of notification will be entitled to a fifty percent (50%) refund. After 30 days from such notification there will be no refund of submitted fees. This Executive Summary is a request to revise the language under section 2 of RR) Refund Provisions located on page 19 of the GMD P&R Fee Schedule, Collier County Resolution No. 2010-130. The proposed changes will allow a refund for applications not deemed sufficient for inspection and are 'withdrawn by the applicant. The proposed changes will extend the amount of time an applicant may apply for a refund from 30 days to 4 years. The applicant is required to file an application for refund that will be filed with the County Manager of hislher designee and there will be a non-refundable processing fee equal to one percent of the total amoW1t of the refund owed, with the minimum processing fee being $25.00 and the maximum processing fee not to exceed $250.00. Failure to make timely application for a refund within this period of time shall waive any right to a refund. Refund requests totaling more than $25,000 or more CaJ.IDot be approved administratively and must be submitted by GMD P&R staff to the Board of County Commissioners for approvaL The changes are as foJJows: RR) REFUND PROVISIONS 2) There wiJJ be no refund of Planning, Environmental or Engineering related fees, except those applications which have been deemed not sufficient for staff review or inspection and withdrawn by the applicant. This subject was brought before and discussed at the April 6, 2011 Development Services Advisory Committee (DSAC), whereas, the committee supported any applicant's opportunity to apply for a refund for services that were not provided to the applicant as a result of a project being canceHed versus the current language in the GMD P&R Fee Schedule regarding reftmds. FISCAL IMP ACT: This Executive Summary does request any increase within the current GMD P&R fee schedule, or is it anticipated to require further allocations of GMD P&R operating or personnel expenses that were approved by the Board. . GROWTH MANAGEMENT IMP ACT: There are no growth management impacts. LEGAL CONSIDERATIONS: This request has been reviewed by the ColJier County Attorney and is legaJJy sufficient. FEES ARE ESTABLISHED BY THE BOARD OF COUNTY COMMISSIONERS RESOLUTION, AND CANNOT BE WAIVED OR SUSPENDED WITHOUT AN ACTION BY THE BOARD OF COUNTY COMMISSIONERS. The minimum building pennit fee for sign shall be $110,00. 2) Multiple signs of the same type (i.e., wall signs) and for a single project may be allowed per one permit, however an appropriate fee shall be charged for each sign in accordance with the schedule set forth in the above subsection 1 of Sign Permit Fees. X) CONVENIENCE PERMIT FEES 1) Convenience permits are issued in blocks of 10 each. Only licensed contractors are eligible to purchase convenience permits are limited to the use specified on the permit. II) PERMIT FEE REFUNDS A) Building Pennit Review Standards apply to all internal GMD-P&R reviews for building pennit applications with previously approved site plans, including all required trade reviews, along with any required Zoning, Engineering and Impact Fee reviews. Reviews external to GMD P&R, such as a Fire, are excluded. The performance standard time frame begins upon submission of the application, and runs until either issuance of a comment letter or at approval. Review standard guarantees require the submission of a sufficient number of plan sets (to be determined by the Building Department) to accommodate parallel trade reviews. RR) REFUND PROVISIONS 1) PAY1\1ENT OF FEES: Full payment offees is required for a complete application. Department policy requires full payment of fees at the time of application submittal. No work will begin on staffreview of the application until all fees are paid in full. Iffull payment offees is not received within 14 calendar days of application submittal, the application will be considered void.
