EXECUTIVE SUMMARY Recommendation to approve $29,729 in design alternative studies for the Vanderbilt Beach park/restroom facility as directed at the March a, 2011 Bee meeting. OBJECTIVE: Obtain approval for expenditures for the design alternative studies for the Vanderbilt Beach park/restroom facility as directed at the March 8, 2011 BCC meeting. CONSIDERATIONS: On June 22,2010, the BCC approved a conceptual design (Item 10A) for a new facility to replace the existing Vanderbilt Beach bathrooms with an elevated design conforming to FEMA flood requirements. On July 27,2010 (Item 16D9) the BCC approved $160,000 for the design engineering, permitting and construction contract bidding for the proposed Vanderbilt Beach park/restroom facility. On March 8, 2011, the BCC directed staff to develop alternatives to constructing an elevated restroom, deck and concession beach park facility at the current FEMA VE 14 location. Options requested were: 1. Renovate existing facility - Utilizing the appraisal and structural inspection of the existing facility, develop a conceptual plan and evaluate the options to renovate the existing facility. 2. Design a smaller flood proofed facility at grade in proposed AE zone - Develop conceptual design and feasibility cost for a smaller bathroom facility at-grade that does not include a concession stand or refreshment/seating area.. This facility would be flood proofed for the new proposed AE zone. The location of this facility would be built farther off the beach and not in the footprint of the existing facility. These requirements would necessitate this facility to be built in a preserve area. 3. Refurbish the existing bathroom and expand bathrooms in the garage as needed for capacity - Evaluate if this is possible due to code restrictions and if possible, determine how much the existing facility can be refurbished (task1) and develop conceptual layout for bathrooms in the parking garage. Included would be a walkway through the preserve. 4. Construct a new facility at grade in the existing bathroom footprint (VE14). - If granted a Flood map variance by the BCC, what would a new facility conceptual layout/cost be? This would include the demolition of the existing facility, design and construction of new restrooms, ADA accessible ramp, steps and a reduced deck with no concession. 5. Construct a new but smaller elevated facility - Develop a conceptual plan and options to demolish the existing facility and construct a new elevated facility to conform to VE 14 FEMA guidelines. This would include the restrooms, a smaller deck with no concession and either an elevator or ADA access ramps. 6. Renovate existing facility for concession storage - In conjunction with a new bathroom facility, develop a conceptual plan to renovate the existing bathroom Packet Page -580- . . . 6/14/2011 Item 10.F. for concession storage. This would include storage for chairs, umbrellas, shade structures, etc. but exclude food and beverage items. 7. The Growth Management Division will also determine: . The City of Naples history/circumstances surrounding FEMA flood variances granted within the City. · Determine if a Letter of Map Revision (LOMR) is appropriate to qualify this specific site to an AE zone based on actual site elevations provided by Coastal Zone Management. Staff will be required to review these options with the Pelican Bay Foundation. The Pelican Bay Foundation holds restrictive covenants on this parcel as a condition of the property deed transfer. These options will also be reviewed with the Parks and Recreation Advisory Board, the Coastal Advisory Committee and the Tourist Development Council. Cost to develop these design options are as follows: 1. Renovate existing facility - 2. New facility in proposed AE zone - 3. Refurbish existing bathroom and add bathrooms in garage- 4. Construct reduced facility at grade in VE zone - 5. Construct reduced elevated facility in VE zone - 6. Renovate existing bathroom for concession storage - 7. Client Coordination - 8. Reimbursable - Total $ 1,810 $ 7,169 $ 3,414 $ 3,729 $ 3,076 $ 980 $ 1,970 $ 3,885 $ 3,466 $ 230 $29,729 Overall project costs along with design throwaway costs for each option will be presented with each item. On April 25, 2011, the Tourist Development Council recommended that the only two options be studied. These options are: 1. Design a smaller flood proofed facility at grade in the proposed AE zone as detailed it item 2 above and; 2. Refurbish the existing bathroom and expand bathrooms in the garage as needed for capacity. This would also include a structural analysis of the existing facility to determine the amount of refurbishment that could take place. This is detailed in item 3 above and includes a structural evaluation. Cost to develop these design options are as follows: 1. New facility in proposed AE zone - $ 6,890 2. Reimbursable- $ 1,800 $ 1,995 $ 180 Total $14,884 ADVISORY COMMITTEE RECOMMENDATIONS: At the April 14, 2011 Coastal Advisory Committee meeting, the Committee voted 9-0 against recommending the investigation of these options. The Committee's position is that the original design is consistent with County policy and existing facilities. The Committee also indicated that this project has been fully vetted and approved by the BCC and meets FEMA standards for this location. At the April 20, 2011 Parks & Recreation Advisory Board meeting, the Board voted 5 to 1 against recommending the investigation of these options indicating that sufficient due diligence had already been performed. On April 25, 2011, the Tourist Development Council recommended unanimously not to move forward with the options identified by the BCC on March 8, 2011. They recommended 6-3 that only two studies as indicated above be investigated. FISCAL IMPACT: The cost to develop options 1-7 as requested by the BCC on March 8, 2011 is $29,729. If only the two option recommended by the TDC are investigated, the cost will be $14,884. All funds will be provided from Category "A" Tourist Development Tax Fund 183 - Beach Park Facilities. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to' this action. This study will identify specific impacts, if any each option would present to the Growth Management Plan. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office, requires majority vote, and is legally sufficient for Board action. - CMG RECOMMENDATION: Approve $29,729 in design alternative studies for the Vanderbilt Beach park/restroom facility as directed at the March 8, 2011 BCC. (park Shore Assoc.) i 2900 Gordod Drive (The Port Roval Beach Club) - On May 20, 2009, the City of Naples Board of Appeals approved a v~riance to allow the Beach Club to construct a men's and women's pool restroom, no more than 600 sq. ft. each, dn the ground floor below the base flood elevation of 12' NA VD should the existing building need to be replaced idue to the occurrence of substantial damage. The variance approval states, "The proposed design will move th~ Club landward away from the active beach and dune system and provide for use of the existing elevations avoiding excavation and fill. The ground floor level will consist of parking, entry into the building and pool restroo$s which will allow compliance with federal accessibility standards." ! 2101 GulfS~ore Blvd. N. (The Moorings of Naples POA) - On September 15, 2010, the City of Naples Board of Appeals apptoved a variance to allow the Moorings of Naples POA to construct beach restrooms approximately 18" above ~e existing grade, which is below the required base flood elevation of 13' NA VD. The proposed structure is rio more than 258 sq. ft. It will consist of one (1) men's restroom with a toilet and sink and one (1) women's re~room with a toilet and sink. There will also be a small supply room. The variance also requires the preparation 9fa flood response plan prior to the Certificate of Occupancy. : 4061 Gulf Shore Blvd. N. (Park Shore Assoc.) - On June] 6,2010, the City of Naples Board of Appeals approved a variance to ~llow the Park Shore Association to construct beach restrooms approximately] 8" above the existing grade, whicI1 is below the required base flood elevation of 12' NA VD. The proposed structure is no more than 289 , sq. ft. It wilJ consist of one (1) men's restroom with a toilet, urinal and sink and one (1) women's restroom with two (2) toile~s and a sink. There will also be a small supply closet. The variance also requires the preparation of a flood respo~se plan prior to the Certificate of Occupancy. Staff Comment on the City's Three Variances - Of the three variances for restroom construction within the VB flood zone, the variance to the Port Royal Beach Club is a preemptive action in case a future substantial damage situation impacts the facility and requires a reconstruction. The other two variances (Moorings of Naples POA and Park Shore Assoc.) are both small restroom facilities with total area less than 300 square feet. That small size is apparently a consideration in the variance based upon the provisions within the National Flood Insurance Program (NFIP) that allow non-supporting breakaway walls for enclosed areas of less than 300 square feet within the VB zone without affecting the cost of flood insurance premiums. It appears that perhaps the size was thought to be small enough to be of no significant impact for potential of obstruction. From the NFIP perspective, it is the use of the structure, and not the size that is the issue for consideration. When constructing within the VB flood zone, all areas below the base flood elevation (BFE) are required to be ITee of obstruction. Below-BFE building elements are limited to access stairs and ramps, decks and patios, elevators, enclosed areas, equipment, foundation bracing, grade beams, shear walls and slabs. To achieve this, the structures are constructed on pilings, columns, piers, and sometimes shear walls. However the use of breakaway walls for enclosed areas below the BFE is allowable provided the appropriate design criteria are met. The NFIP requires that the use of the area below the BFE is limited to access, temporary storage and parking. It appears that the City's issuance of the variance for the restrooms is not consistent with the NFIP (see information from Technical Bulletin 5 below). Compliance with the NFIP is determined by FEMA, and not County staff. FEMA Technical Bulletin No.5 titled "Free of Obstruction Requirements for Buildings Located in Coastal High Hazard Areas in Accordance with the National Flood Insurance Program", and dated August 2008, contains the following section: Restroom Buildings and Comfort Stations One question that arises is whether restroom buildings or comfort stations can be treated differently than other types of V zone structures and be constructed below the BFE, particularly when those facilities are situated in public parks or recreation areas. The answer is no. These structures must meet the same V zone design and construction requirements as other buildings. Summary of Approved LOMRs Within the City of Naples From FEMA's web site, approved LOMR's (Letter of Map Revision) were viewed for the FIRM panels that were directly on the coastline. Panel 379 LOMR Case No. 07-04-2297P - This LOMR was for Naples Cay at the end of Seagate Drive. The area of revision also included the northern end of Seahorse Ave. · The effort moved several buildings within Naples Cay out of a VB (Elev. 12 NA VD or Elev. 13 NA VD) zone into an AE (Elev. 12 NA VD) flood zone. None ofthe.VB flood zones for the buildings (10 and 20 Seagate Drive) near the back of the beach were changed. · The effort moved four houses on Seahorse Ave. from the VE (Elev. 12 NA VD or Elev. 13 NA VD) zone into an AE (Elev. 12 NA VD) flood zone. Also, two houses were moved from the VB (Elev. 14 NA VD) zone into an AE (Elev. 13 NA VD) flood zone. · In the Preliminary DFIRM, most of the buildings within Naples Cay are proposed to be located in an AE (Elev. 11 NA VD or Elev. 12 NA VD) flood zone. However, 81 Seagate Drive is proposed to be entirely within the VB (Elev. 12 NA VD) flood zone whereas on the LOMR it is within the AE (Elev. 12 NA VD) flood zone. Coastal Analysis Transect at the V. Beach Restroom Facility Based upon a discussion that you and I had, it would not appear to be significantly beneficial to contract with Tomasello Consulting Engineers to draw a coastal transect directly through the location of the existing restroom facility and re-run the coastal storm analysis. The current coastal modeling for the Preliminary DFIRM has a transect approximately 100' south of the restroom facility location, and there does not appear to be an significant change in the coastline within that distance. The results from the additional transect would probably not be significantly different than what is already shown. The existing ground elevations, along with the proximity to the open water ofthe Gulf of Mexico, are not sufficient to reduce the incoming wave heights to less than three (3) feet and remove the site from a VB flood zone designation, so there would be no value gained in applying for a Letter of .
