EXECUTIVE SUMMARY
Recommendation to waive formal competition and approve additional funding to
to continue consulting services with York Claims Services Inc. (PO 4500105855)
providing Collier County with support as required for FEMA claims for Tropical
Storm Gabrielle, Hurricane Katrina and Hurricane Wilma for time and material not
to exceed $65,000.
OBJECTIVE: To continue consulting support and assistance with FEMA claims for
Tropical Storm Gabrielle, Hurricane Katrina and Hurricane Wilma with York Claim
Services.
CONSIDERATIONS: Mr. Bruce French of York Claim Services was previously
employed with the Florida Department of Emergency Management and was working
with Collier County as the expert for the Department of Emergency Management and
FEMA. Due to Mr. French's expertise in FEMA issues and his previous assistance, he
was hired through York Claim Services to provide necessary consulting services
pertaining to FEMA issues.
On March 26, 2009, under Administrative Purchasing Procedures, Coastal Zone
Management obtained the services of Mr. French while employed with York Claim
Services. Mr. French was instrumental in Collier County's recovery of $9,750,000 in
additional FEMA reimbursement resulting from additional beach renourishment
expenses from Hurricanes Wilma and Katrina. Mr. French invoiced Collier County
approximately $50,000 for this work.
Staff is requesting an additional $15,000 be budgeted for Mr. French's continued
involvement in securing additional FEMA reimbursement for additional renourishment
cost as a result of Tropical Storm Gabrielle. Collier County is seeking an additional
$9,000,000 in reimbursement funding as a result of this tropical storm.
Staff is recommending a waiver of the formal competitive bidding process due to
Mr. French's background knowledge of the County's claim and his recognized expertise
in this area.
FISCAL IMPACT: The Source of funds is from Category "A" Tourist Development Tax.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management
Plan related to this action.
LEGAL CONSIDERATIONS: The Purchasing Policy, Section V, provides that the
formal competitive threshold may be waived for single source purchases or where it is
determined to be in the best interest of the County to do so. This item has been
reviewed by the County Attorney's Office, requires majority vote, and is legally sufficient
for Board action. CMG
