EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be on this item, all participants are required to be sworn in. This is a recommendation to
acknowledge the vacation of the 50 -foot wide temporary drainage easement as shown on the plat of
Italia as recorded at Plat Book 47, Pages 68 through 70, public records of Collier County, Florida.
OBJECTIVE:
To acknowledge the vacation of the temporary 50 -foot wide temporary drainage easement as
shown on the plat of Italia and to direct the Clerk to make a notation on the plat of this
acknowledgement.
CONSIDERATIONS:
On November 14, 2006, the Board of County Commissioners approved the final plat of Italia for
recording. The developer was required to record a temporary drainage easement to address the
subdivision drainage until such time as the Lely Area Storm -water Improvement Project (LASIP)
was complete and inspected within the Treviso Bay section. The easement was to be
"automatically vacated" upon completion of the LASIP improvements. The LASIP
improvements have been completed and inspected therefore there is no longer a need for the
temporary drainage easement. Requesting that the Clerk make notation on the original plat will
assist anyone doing title research on the affected properties.
FISCAL IMPACT:
There is no fiscal impact associated with this Executive Summary.
LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the plat and associated legal
documents for legal sufficiency. This item requires a majority vote. This item is ready for Board
consideration and approval. STW
GROWTH MANAGEMENT IMPACT:
There is no growth management impact associated with this Executive Summary.
RECOMMENDATION:
To acknowledge the vacation of the 50 -foot wide temporary drainage easement as shown on
the final plat of Italia, and to direct the Clerk to make notation of this acknowledgement on
the final plat as recorded at Plat Book 47, Pages 68 through 70.
