EXECUTIVE SUMMARY Recommendation to approve a Stipulated Final Judgment for Parcel Nos. 112RDUE and 112TCE in tbe amount of $356,263 in tbe lawsuit styled Collier County v. Kaye Homes, Inc., et aL, Case No. 10-2680-CA (Collier Boulevard Project No. 68056) (Fiscal Impact $66,963). OBJECTIVE: That the Board approve the attached Stipulated Final Judgment for payment of full compensation, for the taking of Parcels Parcel No.'s 112RDUE and 112TCE in Collier Coul1Iy v. Kaye Homes, et al.. Case No.1 0-2680-CA, Collier Boulevard Projeet No. 68056. CONSIDERATIONS: Collier County has condemned .651 aeres of perpetual, non-exclusive, road right-of-way, drainage, and utilities easement (Pareel I 12RDlJE) and .102 Acres for a 36 month temporary construetion easement from the property owner, Pine Ridge Holdings, LLC. The County's initial appraisal dated Oetober 16, 2008, valued the taking at $336,000 for Parcel 112RDUE and $2,400 for Parcel 112TCE. The County offered the owner $338,400 for both parcels as the County's statutory offer on January 28, 2008. The offer was not accepted. A second appraisal dated September 13, 2010, refleets a reduetion in value of the Parcels to $289,300. An Order of Taking hearing was held on October 19,2010, and the County deposited the sum of $289.300 in the Court Registry. On December 6, 2010, $289.300 was disbursed to the owner, pending final resolution ofvaluation. The owner contends that the taking renders the remainder tract unbuildable due to a small building envelope in the after condition. The proposed settlement resolves the building envelope concern by rendering the lot a non-conforming Estates lot under Section 2.03.01.B.2.b of the Land Development Code in exchange for fee simple conveyance of existing road right-of-way and parcel I 12RDUE. Non- eonforming Estates lots have smaller setbacks. The total eompensation is $356,263, which represents the previously disbursed sum of $289,300, plus $66,963, representing additional compensation, attorney's fees, expert fees, and costs. The taking is now a fee taking and the temporary eonstruetion easement has been extended through 2017. Staff finds this settlement to be reasonable and recommends approval. If the attached Stipulated Final Judgment is approved, the County will be responsible for the following costs: Additional Amount Owed: TOTAL $ 66,963 $ 66,963 (includes attorney's fees, ex pelt fees and costs) FISCAL IMP ACT: Funds in the amount of $66,963 are available from impact fees.
