OBJECTIVE: That the Board of County Commissioners approve the attached Stipulated Final Judgment for payment of full compensation for the taking of Parcels 105 and 705 in the lawsuit styled Collier County v. Highland Properties of Lee and Collier Limited, et al., Case No. 06~0563- CA, Santa Barbara Boulevard Project No. 62081. CONSIDERATIONS: Collier County condemned a 3,723 square foot right-of~way parcel in fee simple (parcel 105), together with a 705 square foot temporary construction easement (parcel 705), as part of the Santa Barbara Boulevard improvement project from the property owner, DDRM Countryside, LLC as successor to Inland Southeast Countryside Limited Partnership. The County's initial offer for Parcels 105 and 705 was $109,500 (the appraiser's estimate of full compensation as of January 11, 2006). The offer was not accepted. The appraisal was updated on June 27, 2006, and pursuant to the Order of Taking hearing on July 18, 2006, the County deposited the sum of $119,900 in the Court Registry. The subject property is the shopping center that has a Sweet Bay Supennarket at the corner of Radio Road and Santa Barbara Boulevard. The owner claimed that when the landscape buffer that was taken is replaced, 22 parking spaces would be removed resulting in a damage of$I,067,800. Owner's total claim was $1,314,000. After several negotiations and a failed mediation, this case was set to go to trial on April I I, 201 I. On the eve of trial, Respondent accepted $200,000 in settlement offull compensation, including any and all claims relating to the road construction project, Parcels 105 and 705, and areas where the County or its agents may have performed work outside of the interests tak~n and more particularly described in the appraisal prepared by Richard Harris for Respondent. The County's Offer of Judgment had been $155,001. Per the proposed Stipulated Final Judgment, the 5-foot landscape buffer along Radio Road will not be required to be increased to 20 feet on the remainder tract in accordance with LDC Sections 1.06.01 and 9.03.07.C.3 and Section 1.04.04 of Ordinance No. 06- 07 and the Zoning Manager's Opinion dated December 3, 2010 attached as Exhibit "A" to the Stipulated Final Judgment. The settlement takes into consideration appraisal differences in land value and costs to cure, intereSt and additional compensation where the County's contractor did work outside of the easement area. If approved, the County will be responsible for the following costs: Additional amount owed *Statutory attorney's fees TOTAL $ 80,100 $ 29.865 $109,965 *Attorney's fees are mandated by g73.092, Florida Statutes and are based on a percentage of the difference between the settlement amount and the original offer (e.g., $200,000 - $109,500 x 33% = $29,865). It is my understanding that tbe current owner, DDRM Countryside, LLC, has asserted in a pending eminent domain aCtion, Collier County v. Highland Properties of Lee and Collier Limited, el al., Case No. 06-0563-CA, that Collier County's taking will cause damage to the value of the property regarding certain county landscaping requirements. TIle purpose of this letter is to establish that, in the event offuture development or redevelopment, Le., a redevelopment to a boutique strip mall, the County will not require replacement of the landscape buffer nor to any non-conforming landscaping. This commitment from County Zoning shall TUn with the land and benefit future owners of the property.
