DOA-PL2010-1052: Olde Cypress Development, LTD &Vita Pima, LLC, represented by Chris Mitchell of Waldrop Engineering, P.A. and Richard Yovanovich of Coleman, Yovanovich & Koester, P.A., request a change to the previously approved Olde Cypress Development of Regional Impact DRI, in accordance with Florida Statutes, Subsection 380.06(19). Proposed modifications will add 63.9 acres into the DRI boundary, amend Map H, and remove the 3.9 acre park requirement to incorporate this change. EXECUTIVE SUMMARY Recommendation to authorize the County Attorney to file a lawsuit on behalf of the Collier County Board of County Commissioners, against SURETY CONSTRUCTION COMPANY, in the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, to recover damages incurred by the County, as a result of contracted work, for the repair to the Pollution Control Laboratory in Building "H" 3'd Floor in the amount of $99,492.99, plus costs of litigation, including reasonable attorneys fees. OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney to file a lawsuit on behalf of the Collier County Board of County Commissioners, against SURETY CONSTRUCTION COMPANY, in the Circuit Court of the Twcntieth Judicial Circuit in and for Collier County, Florida, to recover damages incurred by the County, as a result of contracted work, for the repair to tbe Pollution Control Laboratory in Building "H" :;rd Floor in the amount of $99,492,99, plus costs of litigation, ineluding reasonable attorneys fees. CONSIDERATIONS: Pursuant to an Agreement for Contractor Services with SURETY CONSTRUCTION COMPANY dated October 9, 2007 (#06-3971), and the Work Orders thereto, SURETY CONSTRUCTION COMPANY commenced work in May 2010 on interior alterations to the Pollution Control Laboratory on the 3rd Floor of Building "H" on the Collier County Government Campus. This space is rented to the State of Florida. SURETY hired sub-contractors to facilitate the work, one of which was D, E. MOUNTS CORPORA nON. Due to the installation of an improper hose on a washing device, the bose burst and flooded the area causing damages to the facility, machinery and equipment. The County sustained damages in the amount of $99,492.99 for the repairs and replacement of machinery and equipment. The Agrecment with SURETY requires the company to have insurance and to indemnify and hold the County harmless for damages, as well as to pay reasonable attorneys fees and costs. SURETY has refused and continues to refuse to reimburse the County for its costs paid for the repairs and replacement of equipment. The County has no other recourse but to seek redress in the Courts. FISCAL IMPACT: Funds are budgeted and available in the Risk Management Property & Casualty Fund. Filing fees, service and process fees total approximately $500.00. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this item. LEGAL CONSIDERATIONS: The County Attorney has reviewed and approved this item.
