EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to file a lawsuit on behalf of the Collier County
Board of County Commissioners, against TODD SONDRINI, in the Circuit Court of the Twentieth
Judicial Circuit in and for Collier County, Florida, to recover damages incurred by the County for
the repair to a County Emergency vehicle that was struck by a vehicle owned by TODD and KESIA
SONDRINI and driven by TODD SONDRINI in the amount of $21 ,060.50, plus costs of litigation.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney to file a
lawsuit on behalf of the Collier County Board of County Commissioners, against TODD SONDRINI, in
the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, to recover damages
incurred by the County for the repair to a County Emergency vehicle that was struck by a vehiele owned
by TODD and KESIA SONDRINI and driven by TODD SONDRINI in the amount of $21,060.50, plus
costs oflitigation,
CONSIDERATIONS: On September 27,2009 a vehiele owned by TODD and KESIA SONDRINI
and driven by TODD SONDRINI was traveling northbound on Livingston Road at a high rate of speed at
the intersection of Vanderbilt Beacb Road in Collier County, Florida. The County's Emergency vehiele
was responding to a call, and was proceeding eastbound on Vanderbilt Beach Road proceeding through
this intersection with its emergcncy lights flashing and its siren sounding, Mr. Sondrini, apparcntly
ignoring the sircn and flasbing cmergency lights, procecded around stoppcd cars into the intersection and
collided with the passenger side of the County's vehicle, turning the County's vehicle ovcr on its side,
There was a Collier County Sheriff and a County Emergency supcrvisor that were eyewitnesses to the
accident. The County sustained damages in the amount of $21,060.50 for the repair to the vchicle. The
Sondrinis have refused and continue to refuse to reimburse the County for these repairs. The County has
no other recourse for recovery of the costs than to proceed with litigation.
FISCAL IMPACT: Funds arc budgeted and availablc in the Risk Management Property & Casualty
Fund. Filing fees, service and process fees total approximately $500.00,
GROWTH MANAGEMENT IMPACT: There is no grmvth management impact associated with this
item,
LEGAL CONSIDERA nONS: The County Attorney has reviewed and approved this item. This
item is legally sufficient for Board action and rcquires only a majority vote. - CMG
RECOMMENDATION: That the Board of County Commissioners authorize the County Attorney to
file a lawsuit on behalf of the Collier County Board of County Commissioners, against TODD
