EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to file a lawsuit on behalf of the Collier
County Board of County Commissioners, against Max Stankeveh and Oliver Scott Vanoy,
in the Circuit Court of the Twentieth Judicial Circuit in and for Collier County, Florida, to
recover damages incurred by the County for the repair to a traffic signal cabinet damaged
by them in the amount of $15,417.81, plus costs of litigation.
OBJECTIVE: For the Board of County Commissioners to authorize the County Attorney
to file a lawsuit on behalf of tbe Collier County Board of County Commissioners, against Max
Stankeveh and Oliver Scott Vanoy, in tbc Circuit Court of the Twentieth Judicial Circuit in and
for Collier County, Florida, to recover damages incurred by the County for tbe repair to a traffic
signal cabinet damaged by them in the amount of $15,41 7,81, plus costs of litigation.
CONSIDERATIONS: On February 28, 2010, Max Stankeveh was operating a vebicle
owned by Oliver Scott Vanoy in an easterly direction on Golden Gate Parkway at the
intersection of Sunshine Blvd. in Collier County. Mr, Stankeveh proceeded through a steady red
light, causing a collision with another vehicle, which caused Mr. Stankeveh to lose control of the
vehicle, spin, leave the roadway and crash into a traffic signal cabinet owned and maintained by
the County. The County incurred damages in tbe amount of $15,417,81 for repair to tbe cabinet
and its function, Both Stankeveh and Vanoy have refused and continue to refuse to reimburse
the County for these repairs. The County has no other recourse for recovelY of the costs than to
proceed with litigation.
FISCAL IMP ACT: Funds are budgeted and available in the Risk Management Property &
Casualty Fund. Filing fees, service and process fecs total approximately $500.00,
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated
with this item,
LEGAL CONSIDERATIONS: The County Attorney has reviewed and approved this item,
This item is legally sufficient for Board action and requires only a majority vote. - CMG
