EXECUTIVE SUMMARY
SV-2006-AR-9400 - relating to an after-the-fact Sign Variance for the Swamp Buggy RacesIFlorida
Sports Park. The Sign Variance requested is to allow an cxisting non-conforming, off-premises
directional sign to remain at its existing location until the Rattlesnake-Hammock/Collier Boulevard
bridge is expanded or an adjacent property owner allows the sign to be moved onto tbeir property.
Tbe subject property is located at the southeast corner of Collier Boulevard and Rattlesnake-
Hammock Road on property hereinafter described in Collie.. County, Florida.
OBJECTIVE:
To have the Board of County Commissioners (BCC) finally approve an existing, nonconforming,
off-premises directional sign to remain at its existing location until either a new bridge is
constructed at the location or new property owncr approves the re-Iocation of sign, whichever
occurs first.
CONSIDERATIONS:
At the BCC's December 14, 2010 meeting, the BCC heard a Public Petition by Randy Johns
requesting a twelve month extension for a Variance for the Swamp Buggy Sign that was
previously approved with a three year time limit. The sign is an off-premise directional sign for
~. the Swamp Buggy 1acility. The Swamp Buggy sign is located at the Florida Sports Park
entrance at the southeast intersection of Collier Boulevard and Rattlesnake Hammock Road.
At that meeting, the BCC directed that a Variance extension be approved to allow the sign to
remain subject to the following terminating events, whichever occurs first:
1. The Rattlesnake Hammock/Collier Boulevard bridge is expanded.
2. The adjacent property owner allows the sign to be relocated on their property.
Please note the following additional information regarding the history of the subject sign:
I) A Variance (Resolution 07-22) was passed on January 23, 2007 that allowed the "'original
sign" to remain in place for a period of up to 3 years up to January 23,2010. See attachment A:
Resolution 07-22.
2) On December 1, 2009, the BCC previously approved a one-year extension until Dccember 1,
2010.
3) A new sign face, slightly larger than the "'original sign lace" was erected without a rcquircd
sign pennit. A Sign Permit was granted preliminary approval on January 14,2011, subjcct to
the approval of this Sign Variance Extension.

4) As a result of a complaint that the sign was altercd without a sign pennit, a Code
Enforcement Case was opened on March 6, 2009, Codc Case number CES20090002361. The

Code Case will remain open until the proposed Sign Variance Extension is granted and the sign
receives a Certificate of Completion. Please see attachment B, entitled "Code Case Details."
FISCAL IMPACT:
None.
GROWTH MANAGEMENT PLAN IMPACT:
This request will have no impacts on the Growth Management Plan.
ENVIRONMENTAL ISSUES:
There are no environmental issues associated with this request.
COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION:
The CCPC was not required to hear this item.
LEGAL CONSIDERATIONS:
This Executive Summary has been reviewed by the County Attorney's Office and is legally
sufficient. A majority vote is required. STW
RECOMMENDATION:
Staff recommends that the Board of County Commissioners approve the request for Swamp
Buggy Sign Variance subject to the following terminating events, whichever occurs first:
a. The Rattlesnake Hammock/Collier Boulcvard bridge is expanded.
b. The adjacent property owncr allows thc sign to be relocated on their property.

OF NOT MORE THAN THREE YEARS. TIlE SUBJECT

ROAD ON PROPERTY HEREINAFfER DESCRIBED IN
COLLIER COUNTY. FLORIDA.
WHEREAS. the Legislature of the State of Florida in Chapter 125. Florida Statutes. has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 04-41) which establishes regulations for the zoning of panicular geographic
divisions of the County, among which is the granting of variances; and
WHEREAS, the Board of z"ning Appeals (BZA) has held a public hearing after notice
as in said regulations made and provided. and has considered the advisability of an after-the-fact
sign variance to allow an ex:isting, non--confonning off-premises directional sign (hereinafter
referred to as the "Sign") to remain at its existing location for a period of not more than three
years. The Sign is located on the southeast comer of Collier Boulevard and Rattlesnake-
Hammock Road, as shown on a sire plan attached as Exhibit "A:' The BZA has found as a
matter of fact that satisfactory provision and arrangement have been made concerning all
applicable matters required by said regulations and in accordance with Section 9.04.00 of the
Zoning Regulations of said Land Development Code for the unincorporated area of Collier
County; and
WHEREAS, all interested panies have been given the opportunity to be heard by this
Board in public meeting assembled and the Board baving considered all matters presented.
NOW. THEREFORE. BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COU.IER COUNTY. FLORIDA. that:
The Petition SV-2006-AR-9400. filed by Robert J. Mulhere of RWA, Inc.. representing
Mr. David Torres of ToU.Rattlesnake, LLC, with respect to the property hereinafter described

Parcel 17 of Section 14, Township 50 South, Range 26 East of Collier County.
Florida,
be and the same hereby is approved for an after.th::-fact sign variance for the Swamp Buggy
Races/Florida Sports Park. The Sign may remain at its existing location ns shown on Exhibit
"A," subject to the following conditions:
1. The Sign shaH be allowed to remain in place until the earlier of the permanent relocation
of the Swamp Buggy venue or upon written request by the Collier County Transportation
Division to accommodate improvements to Collier Bouievard or Rattlesnake-Hammock

Road. In any event, unless otherwise extended by this Board, the Sign must be removed no
later than three years from the date of this Resolution. All costs associates with the removal
or relocation of the Sign shall be borne by the applicant;
2. A right-<lf-way permit, if required, shall be secured within four months from the date of
this Resolution~
3. A building permit application shall be submitted to Collier County within four months of
the date of this Resolution; and
4. Required landscaping shall be planted around the base of the Sign. A planting plan shall
be submitted to Collier County with the building permit application. The Applicant may
utilize manual irrigating techniques if the planting plans include xeric or drought tolerant
plants.
BE IT FURTHER RESOLVED that this Resolution relating to Petition Number SV-
2006-AR-9400. Swamp Buggy Sign Variance. be recorded in the minutes of this Board.

RELATING TO PETITION NUMBER SV-2006-AR-9400
FOR AN AFTER-THE-FACT SIGN VARIANCE FOR THE
SWAMP BUGGY RACES/FLORIDA SPORTS PARK. THE
SIGN VARIANCE REQUESTED IS TO ALLOW AN
EXISTING NON-CONFORMING, OFF-I'REMISES
DIRECTIONAL SIGN TO REMAIN AT ITS EXISTING
LOCATION UNTIL THE RATTLESNAKE-
HAMMOCK/COLLIER BOULEVARD BRIDGE IS
EXPANDED OR AN ADJACENT PROPERTY OWNER
ALLOWS THE SIGN TO BE MOVED ONTO THEIR
PROPERTY. THE SUBJECT PROPERTY IS LOCATED AT
THE SOUTHEAST CORNER OF COLLIER BOULEVARD
AND RATTLESNAKE-HAMMOCK ROAD ON )'ROI'ERTY
HEREINAFTER DESCRIBED IN COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter] 25, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 04-41) which establishes regulations for the zoning of particular geographic
divisions of the County, among which is the granting of variances; and
WHEREAS, the Board of Zoning Appeals (BZA) has held a public hearing after notice
as in said regulations made and provided. and has considered the advisability of an after-the-fact
sign variance to allow an existing, non-conforming off-premises directional sign (hereinafter
referred to as the "Sign") to remain at its existing location until the Rattlesnake-
Hammock/Collier Boulevard bridge is expanded or an adjaccnt propcrty owner allows the Si!,'ll
to be moved onto their property. The Sign is located on the southeast corner of Collier Boulevard
and Rattlesnake-Hammock Road, as shown on a site plan attached as Exhibit "A." The BZA has
found as a matter of fact that satisfactory provision and arrangemcnt have bcen made concerning
all applicable matters required by said regulations and in accordance with Section 9.04.00 of the
Zoning Regulations of said Land Developmcnt Code for the unincorporated area of Collicr
County; and
WHEREAS, all interested parties have been given the oPPOliunity to be heard by this
Board in public meeting assembled and the Board having considercd all matters presented.
NOW. THEREFORE, BE IT RESOLVED BY THE BOARD OF ZONING APPEALS
OF COLLIER COUNTY, FLORIDA, that
Petition SV-2006-AR-9400 regarding the property hereinafter describcd as:

Notice is hereby given that the Board of County Commissioners, as the Board of
Zoning Appeals. of Collier County will hold a public hearing on Tuesday, March 22,
2011, in the Boardroom, 3rd Floor, Administration Building, Collier County Govern-
ment Center, 3299 East Tamiami Trail, Naples. Florida. The meeting will begin at
9:00 A.M. The title of the proposed resolution is as follows:
RElATING TO PETITION NUMBER SV.2006-AR-9400 FOR AN AFTER-THE-FACT SIGN
VARIANCE FOR THE SWAMP BUGGY RACESJFLORIDA SPORTS PARK. THE SIGN VARI-
ANCE REQUESTED IS TO ALLOW AN EXISTING NON-CONFORMING, OFF.PREMISES
DIRECTIONAL SIGN TO REMAIN AT ITS EXISTING LOCATION UNTIL THE RATILE-
SNAKE-HAMMOCK/COLLIER BOULEVARD BRIDGE IS EXPANDED OR AN ADJACENT
PROPERTY OWNER ALLOWS THE SIGN TO BE MOVED ONTO THEIR PROPERTY. THE
SUBJECT PROPERTY IS LOCATED AT THE SOUTHEAST CORNER OF COLLIER BOULE-
VARD AND RATTLESNAKE-HAMMOCK ROAD ON PROPERTY HEREINAFTER OE-
seR/BED IN COLLIER COUNTY, FLORIDA.
Copies of the proposed Resolution are on file with the Clerk to the Board and are
available for inspection. All interested parties are invited to attend and be heard. ,
NOTE: All Persons wishing to. speak on any agenda item must register with the
