EXECUTIVE SllMMARY Recommendation to adopt a resolution anthorizing the condemnation of those perpetual and temporary easement interests necessary for the construction of stormwatcr improvements for the Outfall 3 and 4 segments of the Lely Area Stormwater Improvement Project. (Project No. 511 01.) Estimated fiscal impact: $1,556,500. OBJECTIVE: To adopt a resolution authorizing the condemnation of those perpetual and temporary easements necessary for the construction of stonnwater improvements known as the Outfall 3 and 4 segments of the Lely Area Stormwater Improvement Project. (LASIP,) CONSIDERATIONS: On January 25th, 2011 the Board adopted Resolution No, 2011-23, authorizing the acquisition by gift or purchase of the easement interests necessary for the construction of Outfalls 3 and 4. This resolution will authorize the condemnation of these easements, The Board of County Commissioners has clearly stated its concern over the extreme flooding issues during the rainy season in the East Naples area, The Lely Area Storm water Improvement Project has been in the design and permitting phase for 18 years. During this pcriod, a sign ificant amount of time and effort has been spent on the analysis of dozens of considerations resulting in LASIP's final alignment. This alignment is based on the natural overland flow of stormwater working in concert with existing wetlands as well as existing ditches and canals constructcd many years ago, The majority of this final alignment is in the same location as thc existing ditches and canals, LASIP will deepen and widen these existing facilities providing the ability to drain the abundant stormwater we receive in the rainy season and to retain the limited storm water that falls in the dry season, The natural direction of sheet flow in the LASIP area is in a generally southwest direction toward the coastal zone and the headwaters of Sandhill and Rookery Bays, Nearly all of the existing conveyance ditches and public canals previously constructed within the LASTP area since the 1950's have been "designed" to convey water to the south and to the west. Eighteen years of analysis has revealed that the most viable approach to construct stormwater improvements within the area is to follow these existing convcyance alignments. Since the entire LASJP area is virtually at "build-out," any alternative alignment would have serious negative and costly real estate impacts, The only practical method for increasing stormwater discharge and alleviating flooding is to widcn the existing ditches and canals, However, these ditches and canals must be enlarged in order to accommodate the increased volume of storm water draining through them, Attached is a vicinity map depicting the approximate location of the easements required for Outfalls 3 and 4, The width of the canal is determined by the anticipated peak tlow volume of stormwater, the desired life cycle of the improvements being constructed, as well as the future maintenance costs. These factors, in part, determine the canal cross-section, and constitute the primary reason that some easements are required along only a portion of the north side of Outfall 4. The existing canal bank along the north side of Outfall 4 is quite steep through that section and is located outside the existing 30 foot wide platted drainage easement. Therefore, construction of a proper slope on the canal bank is necessary to insure the long term integrity of the canal function (i,e., to prcvent a collapse of the bank into the canal), and to ensure that the north bank can be properly maintained. Since this needs to be accomplished as an integral part of the project, it enabled the engineers to shift the entire cross-section to the north at these locations thereby minimizing acquisition and mitigation costs along the south side of the canal. Construction is scheduled to commence in the dry ___ season of 2011/2012, Project scheduling requires that authority be granted for the condemnation of the Packet Page -671- 3/22/2011 Item 1O.D. easement interests required to complete the project, so as to ensure that construction is not delayed if these parcels are not acquired in a timely manner by negotiation, A technical memorandum is attached from Daniel W. Brundage, P.E., a principal with the firm Agnoli, Barber & Brundage, Inc" the consultant engineering firm designing and pennitting the project. By its review, concurrence and approval of this Executive Summary, the back-up documentation, and the proposed resolution, the Board will have detennined that the legal descriptions, and the interest in real property specified on each legal description attached to the resolution, represent the most feasible location, and are necessary for the construction of the Outfalls 3 and 4 segments of the LASIP project. FISCAL IMPACT: The cost of acquiring the easements necessary to complete these segments of LA SIP is estimated to be $1,556,500. This amount includes not just the direct cost of all easements required for construction; it also includes an estimate of severance damages to remaining properties caused as a result of the part taken to construct the project, as well as all expcnses for title work, real estate appraisals, and those expenses related to condemnation when necessmy, such as propel1y owner attorney fees and expert witness fees, which the County is required to pay according to Sections 73.091 and 73,092, F,S. To the extent settlements are achieved in lieu of litigation, this 1igure may be reduced signi1icantly, All such payments will be made from the Stormwater Capital Improvement Fund 325 under the Lely Area Stormwater Improvement Project, Project No, 5110 I, The balance of funds necessary will be programmed into the project as the multi-year acquisition effort proceeds. Source offunds is Ad Valorem taxes, LEGAL CONSIDERATIONS: This item requires a duly noticed public hearing, It is ready for Board consideration. A majority vote is needed for approval. . WHEREAS, the Board of County Commissioners desires to improve the treatment and control of stormwater in the East Naples Area in order to alleviate flooding; and WHEREAS, the Lely Area Stormwater Improvement Project consists of improvements to an existing drainage system for an approximately I 1,100 acre area located in East Naples, of which Outfalls 3 and 4 (hereinafter referred to as the "Project") is but one phase; and WHEREAS, the Project includes the expansion of existing ditches and the improvement of maintenance pathways along the ditches; and WHEREAS, the Lely Area Stornlwater Improvement Project is in accordance with both the Capital Improvement Element and Drainage Sub.element of the Growth Management Plan; and WHERE/I.S, the location for the construction of the proposed improvements has been fixed by suney and is collectively represented by the legal descIiptions comprising Exhibit "A" attached hereto and incorporated herein; and WHEREAS, after consideration of the availability of alternate routes and locations, the comparative costs of Project alternatives, various impacts upon the environment, long range planning options, and public safety considerations, the Board desires to exercise its right to condemn the property for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that it has been detcnnined by the Board that it is necessary and in the public's best interest to acquire the propeny described in Exhibit "A" (the .'Property") for the purpose of constructing the improvements proposed as pan of the Outfalls 3 and 4 segments of the Lely Area Stormwater Improvement Project located in East Naples, and for providing access to the improvements, in order to protect the health, safety and ,velfare of the citizens of Collier County, AND IT IS FURTHER RESOLVED that acquisition of the Property and construction upon the Property is part of the County's long range planning efTort to alleviate flooding in the East environment publie safety and welfare considerations associated with the design and construction of the Project, and the costs associated with the design, property rights acquisition, and construction of the Project; and the Board finds that after consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that the perpetual, non.exclusive drainage, access and maintenance easements include the right to place and/or excavate materials for the purpose of constructing, operating, and maintaining drainage structures and facilities, including but not limited to canals, ditches. swales, earthen oenns, rip-rap and retaining wall systems, underground pipes, and various types of water control structures within the easement areas. These easements also include the right to remove and use any and all excavated material and to construct and maintain a stabilized roadbed facility capable of providing access for vehicles and equipment for perpetual maintenance of drainage facilities thereon and adjacent thereto. AND IT IS FURTHER RESOLVED that the perpetuaL non-exclusive drainage easements include the right to place and/or excavate materials for the purpose of constructing, operating, and maintaining drainage structures and facilities, including but not limited to caJlals, ditches, swales, earthen berms, rip-rap and retaining wall systems. underground pipes, and various types of water control structures within the casement areas. Condemnation Resolution for LASIP Naples Manor Outfalls 3 & 4 Improvements The Board of County Commissioners will be considering the adoption of a Condemnation Resolution for the property interests necessary to construct the Naples Manor Outfalls 3 & 4 portion of the Lely Area Stormwater Improvement Project (LASIP), This memorandum contains vital information that the Board of County Commissioners must consider in adopting this resolution. The LASIP system, as a whole, will provide a comprehensive stormwater outfall system for an area of East Naples formerly known as Water Management District #6 which has for years experienced an increasing level of drainage related problems as growth has continued in the area, The drainage area of LA SIP consists of about 11,135 acres and consists of two sub-basins known as the Lely Canal Basin (LCB) system and the Lely Manor Basin (LMB) system, The Lely Canal Basin discharges into an estuarine coastal zone along the intercoastal waterway near Dollar Bay. Due to the lack of a comprehensive drainage outfall system in the LASlP area continued development of the area has impacted flood levels as well as water quality, Available data indicates that water quality is generally good at present but could be expected to deteriorate unless an improved water management outfall system for the area described as follows is developed, A. Lelv Canal Basin The existing Lely "Main" Canal flows from Rattlesnake Hammock Road south then west and parallel to Rattlesnake Hammock Road, then south again and through the bridges at V,S, 41 and south until it discharges into an estuarine coastal zone along the intercoastal waterway near Dollar Bay, The LASIP Lely Main Canal Extension improvements consist of the portion of the Lely Main Canal system located south of and parallel to Rattlesnake Hammock Road between a point approximately Y. mile east of County Barn Road, thence south for approximately 344 feet, and thence westerly approximately I mile to the southern bend of the Main canal. The flow capacity of the canal and structures in the Main upstream of the V.S. 41 bridges will be increased. At the downstream discharge of the Main canal a spreader lake with a control berm elevation 01'2,5 NGVD has been constructed to eliminate current over drainage. salt water intrusion, and provide a broader distribution of fresh water instead of the existing concentrated point discharge, South of Rattlesnake Hammock Road a weir will be constructed at Doral Circle to raise the normal stage elevation to 4,0 to eliminate current over drainage, The LASIP overall plan will extend the Main canal system upstream using the stonnwater management system of the Royal Wood Development. A network of smaller canals, weirs and swales is proposed to provide appropriate flood relief without over draining existing wetlands, One new canal system will be extended from the northeast corner of Royal Wood to serve the northeast portion of the Lely Canal Basin area. Water levels in these swales will be maintained by the downstream weir control elevations, The weir structures have gates that allow lowering water levels if needed after or in preparation for a major storm event. Also an east to west canal will collect part of the drainage from the area along Sandy Lane, It will also provide a cross-basin connection that will normally be closed, but in special emergency situations can be opened to allow interconnection of the Lely Canal Basin and the Lely Manor Basin systems. A culvert and canal system will also extend from the northwest comer of Royal Wood up to Whitaker road, It will provide added capacity for flood relief for the downstream end of the slough and for the area between Royal Wood and Whitaker. A tributary called the "Branch" joins the Lely Main Canal a short distance upstream of the V,S. 41 Bridge and east of the intersection ofV.S, 41 and Rattlesnake Hammock Road, The Branch provides drainage for the developed area along the Florida Power and Light COIporation right- of-way north of Rattlesnake Hammock Road, the areas surrounding Loch Louise and Crown Point developments located south of Davis Boulevard, and the developments along the north side of Davis Boulevard, The proposed plan calls for increasing the capacity of the Branch downstream of Loch Louise, reconstructing the Loch Louise weir, constructing a new weir at the northern end of the existing triple box culverts under Davis Boulevard, and extending the collection system along the north side of Davis Boulevard to its full planned length east of Santa Barbara Boulevard, The project along the Branch system also includes constructing a weir structure at the intersection of the Haldeman Creek Basin system and enclosing an existing ditch south of Loch Louise (the north ditch of Riviera) in a storm drain, Elsewhere in the Lely Main Canal system, improvements associated with three road projects, Rattlesnake Hammock Road, County Barn Road and Santa Barbara Boulevard Extension will have LASIP drainage features either constructed or made active. The majority ofwetland impacts associated with the Lely Main Canal portion of the LASIP project are related to modifications involving excavating existing canals. Wetlands will be impacted by this construction but impacts are offSet by the improved flow conditions into the existing receiving estuarine wetland area. B. Lelv Manor Basin The Lely Manor "Main" Canal collects stormwater from within the Naples Manor subdivision, developments to the north, and from the drainage area to the northeast of Naples Manor subdivision, Storm water then flows west to the U,S, 41 culvert which discharges into a wide canal oriented east to west eventually discharging into a large fresh water marsh, The lower main begins south of the marsh and discharges into an estuarine coastal zone near the headwaters of Sandhill Bay and eventually into Rookery Bay, A number of smaller canals provide internal drainage for the Naples Manor subdivision and discharge into the U,S, 41 road ditch, Stormwater in the road ditch flows through three additional culverts and to the south and then to the west to the lower main canal. The proposed plan downstream ofU,S, 41 is to increase the capacity of the main canal to provide flood relief for upstream areas, Additionally, a weir will be constructed to prevent over drainage of a large wetland marsh and a spreader lake will be constructed to prevent over drainage while eliminating the current problem of a freshwater point discharge. The plan will also create a new north/south canal system roughly along the east side of sections 30 and 31 of Township 50 South Range 26 East. The existing canals that currently divide a historic slough/flow way will be abandoned (by future development plans of the land owner), a pump station will be installed to re-hydrate the slough, capacity improvement will be made to the existing canals extending from K:\7000\7599,6 Naples Manor 0u1l1l1l3 and 4\Correspondences\MemolNaples Manor Outfalls 3 & 4 Technical Memorev2,21,ll.MEM,doc 4 Packet Page' 718, 3/22/2011 Item 1O.D. U.S. 41, and a new discharge point will be created by constructing a spreader lake adjacent to another wetland flowway system that has been cut off from historic sheet flow fur many years. Upstream ofU.S, 41 the proposed plan will make capacity improvements to the north perimeter canal of Naples Manor, including construction of a weir at Warren Street to reduce current over drainage impacts to adjacent wetlands. Capacity improvements will be made to the canal along the north side of U,S. 41 to allow for lateral distribution of stonnwater to all the culverts crossing beneath U.S. 41. For safety and capacity reasons, one existing channel within the Naples Manor subdivision will be enclosed in a pipe, Upstream ofthe Naples Manor subdivision, the southern end of the existing Rattlesnake Hammock slough will be benned and a discharge weir constructed to prevent current over drainage into the north perimeter ditch of the Naples Manor subdivision. North of Rattlesnake Hammock Road the existing piecemeal system of ditches will be modified to create a manageable stonnwater system, Strategically located culverts, weirs, and channel improvements will direct stonnwater flow into the northern remnants oflhe Rattlesnake Hammock slough. Weirs are located with control elevations to provide flood protection while keeping the adjacent wetlands as wet as possible, A major component ofthis reconstruction involves connecting the existing perimeter canals around the Wing South Airpark into the Lely Manor Basin canal system. The areas of wetland impact are at and near the proposed discharge spreader lakes, the wide main canal south ofU.S, 41 and the lower main canal. the proposed new Region 5 East outfall canal. areas near the County's South County Water Reclamation Facility, and areas around the Wing South Airpark, The impacts are minimized by installation of weirs to maintain water levels and to promote replenishment of existing wetland areas in the lower and upper parts of this basin. A weir is proposed at the upper end of the lower main canal 10 maintain water levels in the fresh water marsh. The majority of wetland impacts associated with the Lely Manor Basin portion of the LASIP project are related to modifications involving excavating existing canals, However, there are some areas where new canal and spreader lake construction will create new wetland impacts, although extensive effort was made to avoid or minimize these impact areas, C, LASIP Naoles Manor Outfillls 3 & 4 Easement Reouirements Easements are required across the parcels indicated on the exhibits for the purpose of construction of the Naples Manor Outfalls 3 & 4 facilities as well as access for maintenance of the outfilll systems when constructed and in operation, Staff has considered the following filctors before recommending that these easements must be acquired, and this memo serves to summarize them for the Board's benefit. l. Alternate Routes Alternate alignments and configurations ofthe LASIP proposed improvements have been exhaustively analyzed as part of the design and permitting process for the LASIP system, A detailed alternatives analysis was prepared for the permitting agencies and is prescnted in a docwnent entitled "Lely Area Stonnwater Improvement Project" dated October 200 I. Throughout the pennitting process each alternative configuration was reviewed and debated and it has been detennined that the current design is the one that provides the most public benefit with the least environmental impacts, The Naples Manor Outfalls 3 & 4 portion of the project calls for improvements to existing canals and is therefore the most practical location for the improvements resulting in the least amount of cost and environmental impacts. The easement requirements for Outfall 3 were straight forward due to the small amount and low quality of wetlands located along the alignment of the existing canal. The proposed easements along Outfall K:\7000\7599-6 Naples Manor Outfall 3 and 4\CorrespondencesIMemolNaples Manor Outfalls 3 & 4 Technical Memo rev 2,21,1 I.MEM,doc 6 Packet Page -720- 3/22/2011 Item 1O.D. 3 are sized to be just wide enough to accommodate the required canal widening and the proposed maintenance pathway, The design of Outfall 4 is more of a challenge due to the larger amount of wetlands and an existing lake located at the westerly end ofthe existing canal. A thorough review during the design and layout of the Outfall 4 canal was made to reduce the overall footprint of the project in order to minimize the size of easements and wetland impacts. The original concept plans called for a proposed 50' drainage easement on the south side of the canal in addition to the already existing 30' drainage easement. This would have required the acquisition of approximately 106,000 square feet or 2.43 acres of additional drainage easement. Through a refined engineering design this impact was reduced to approximately 75,500 square feet or 1.73 acres, a total reduction of 0,7 acres, There are four main design segments associated with Outfall 4, The frrst segment starts at the connection to the existing LASIP Phase I B South Canal and runs easterly for approximately 800 LF. In this section, the existing canal widens into a lake area with a maximum width of 110'. This lake was likely excavated in order to obtain fill dirt. There will be no re-shaping of the north banks in this segment since they are so far outside of the existing County drainage easements. Considering the additional storage volume and flow capacity in the lake, the alignment of the canal was shifted to the north to reduce easement requirements and impacts to wetlands along the south side 0 fthe Canal. The second segment extends further to the east for approximately I, I 00 feet. In this portion of the project, the existing canal bank is actually located outside of the existing county drainage easement. Therefore, it was necessary to acquire drainage easements on the north side of the canal to be able to re-sbape it and have it contained within county easements for future maintenance, The width of the drainage easements vary from 2' to 20'. In the third segment of the project all of the existing canal banks are located within the existing 30' drainage easement. The Naples Manor Outfalls 3 & 4 portion of the project is a vital component of the system linking upstream portions of the Main Canal Basin to the downstream portion of the Main Canal. 3. Lom~ Ranlle Planninll Factors The LASIP improvements including the Naples Manor Outfalls 3 & 4 project are part of the County-wide plan to improve the level of service for flooding and flow-way enhancement within the Basin and further the stated goals, objectives, and policies of the drainage/stormwater management sub-element of the Collier County Growth Management Plan to unify and implement the County-wide Stormwater Management Plan that provides an acceptable level of service for stormwater contruls and environmental management objectives. The project improves the LASIP regional stormwater management system and natural flowways within the area. 4. Environmental Factors The LASIP system has been designed to limit the amount of environmental disturbance as much as possible. Natural flowways and sloughs have been preserved and incorporated into the design as much as possible, A pump system has been included in the design to re-hydrate an existing wetland slough by pumping excess stonnwater from within the LASIP system into the slough. Weirs have been incorporated in the design in order to avoid over-draining the Basin, Spreader lakes have been designed at the ends of the three major outfalls to disperse the discharge as sheet. flow to the receiving waters/wetlands.
