Dear Mr. Migliazzo,
Please be advised that you are scheduled to appear before the Collier County Board of Commissioners at
the meeting of March 22, 2011, regarding the above referenced subject.

Your petition to the Board of County Commissioners will be limited to ten minutes. Please be advised
that the Board will take no action on your petition at this meeting. However, your petition may be
placed on a future agenda for consideration at the Board's discretion. If the subject matter is currently
under litigation or is an on-going Code Enforcement case, the Board will hear the item but will not
discuss the item after it has been presented. Therefore, your petition to the Board should be to advise
them of your concern and the need for action by the Board at a future meeting.
The meeting will begin at 9:00 a.m. in the Board's Chambers on the Third Floor of the W. Harmon Turner
Building (Building "F") of the government complex. Please arrange to be present at this meeting and to
respond to inquiries by Board members.

My property located at 1815 Dove Tree Street was originally classified as agricultural use. When a new
aquaculture facility was completed, the 2010 tax rolls came out and classified this property as a mining
operation because in January, 2010 it was under construction and was completed in approximately five
months.
Please explain in detail the action you are asking the Commission to take (attach additional page if necessary).
I am respectfully requesting that I be given back my original zoning and agriculture value.

Dear Mr. Migliazzo:
Thank you for your inquiry regarding State of Florida recognition of aquaculture activities and
production facilities. The Department is authorized by the State legislature via Chapter 597, Florida
Aquaculture Policy Act, Florida Statutes, to -Issue or deny aquaculture certificates that identify
aquaculture producers and aquaculture products and collect all related fees (S97.oo3(1)(a)).- And
aquaculture is defined in statute as being "the cultivation of aquatic organisms (597.0015(1)):
Furthermore Chapter 570.02 (1), F S., by definition includes Aquaculture as Agriculture
To carryout this responsibility, the Department is further authorized by the legislature to
periodically inspect aquaculture facilities to insure compliance with the Chapter and agency rules that
are developed to regulate those facilities.
Currently, your aquaculture facility is in compliance with Florida Statute and Rule, it is an
agricultural as well as aquaculture facility, and your production is an agriculture/aquaculture product.
