A Resolution of the Board of Zoning Appeals of Collier County, Florida, relating to Petition Number V A~PL2010-739, for ft variance from Land Development Code Section 5.03.06 E.6 to permit a reduced side yard (riparian) setback from 7.5 feet to 0 feet on property located at 39 West Pelican Street in Section 31, Township 51 South, Range 26 East, Collier County, Florida. OBJECTIVE: To have the Board of Zoning Appeals (BZA) consider an application for a proposed Variance to pennit a boat dock facility and ensure the project is in hannony with all the applicable codes and regulations in order to ensure that the community's interests are maintained, CONSIDERATIONS: The .18:1: acre property has an existing single family home in Isle of Capri on a lot with converging riparian lines into Pompano Bay. The petitioner proposes a wood finger boat dock to facilitate one (1) vessel up to 17 feet in length. The proposed boat dock will be 3 feet wide and 153 feet long (as measured from the mean high water line (MHWL) and will total 374:J=: square feet over water. This Variance petition is a companion application to a boat dock extension petition for a proposed 133-foo1' extension to the maximum allowed 20-foot boat dock whic~ if approved, would allow a 153-foot long dock. The Conceptual Site Plan entitled "Schneller Dock - Proposed Walkway and Dock Layouf' revised on September 1, 2010 and prepared by Turrell, Hall & Associates, IDC, illustrates the location of the proposed boat dock and vessel. (See Site Plan included in the resolution and in the Application), According to infonnation provided by the applicant, the neighbors to the north (west) of the subject site have existing, single boat docks that are approximately 215.feet long. The neighbor directly to the 'east of the subject site does not have a boat dock. The applicant has received a letter of no objection (included in the backup materials) from the neighbor to the north. Staff also received a letter from the neighbor from the south stating that there was a civil case (No.02-1743-CA) cancelling clain1s of purported riparian rights of the subject lot, Lot 81. Staff has researched the allegation and the Collier COlU1ty Planning Commission (CCPC) received testimony that has led to the conclusion that Lot 81 has riparian rights. GROWTH MANAGEMENT PLAN (GMP) IMPACT: Future Land Use Element (FLUE): The subject properties are located within the Urban Residential Sub-district of the Future Land Use Map (FLUM) of the GMP. The GMP does not address boat docks, it focuses on the greater issue of actual land use, ENVIRONMENTAL ISSUES: This Variance petition was not required to be presented to the Environmental Advisory Council (EAC). COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION: The CCPC heard petition VA-PL2010-739, Schneller Boat Dock on January 20,2011, and by a vote of 9-0 recommended to forward this petition to the Board of Zoning Appeals (BZA) with a recommendation of approval. Because the CCPC motion was unanimous and the letter claiming that the subject lot has no riparian rights has been detennined and testified to be not true, this petition has been placed on the Smllinary agenda. LEGAL CONSIDERATIONS: TIns matter has been reviewed by the County Attorney's Office and has been found legally sufficient for Board action, A majority vote is required for approval. GROWTH MANAGEMENT PLAN (GMP) CONSISTENCY: The subject property is located in the Urban Mixed Use Residential land use classification on the County's Future Land Use Map (FLUM). This land use category is designed to accommodate a variety of residential uses including single family, multi-family, duplex, mobile home and mixed-use projects. As previously noted, the subject petition seeks a variance for a single family home that is located within a single-family subdivision, which is an authorized use in this land use designation, therefore, the single family home use is consistent with the FLUM. The Growth Management Plan CGMP) does not address individual variance requests; the Plan deals with the larger issue of the actual use. ANALYSIS: Section 9.04.01 of the Land Development Code gives the Board of Zoning Appeals (BZA) the authority to grant Variances. The Planning Commission is advisory to the BZA and utilizes the provisions of Section 9.04.03 A. through H. (in bold font below), as general guidelines to assist in making their recommendation of approval or denial. Staff has analyzed this petition -relative to these provisions and offers the following responses: . a. Are there special conditions and circumstances existing, which are peculiar to the location, size and characteristics of the land, structure or building involved? Yes. The subject property has narrow pie shaped riparian lines with the narrowest piece located where the proposed dock is to be located. The intersection of the riparian lines restrict the mooring of the applicant's vessel. The vessel will be located within the riparian rights of the applicant and in adequate water for safe ingress/egress to Pompano Bay. b. Are there special conditions and circumstances, which do not result from the action of the applicant such as pre-existing conditions relative to the property, which are the subject of the Variance request? Yes. The existing water depths are too shallow within the pie shaped riparian lines to moor a vessel within the required 7.5-foot riparian side yard setback. c. Will a literal interpretation of the provisions of this zoning code work unnecessary and undue hardship on the applicant or create practical difficulties for the applicant? Yes. The site conditions, mentioned above, make it difficult for the applicant to moor his vessel. .. d. Will the Variance, if granted, be the minimum Variance that will make possible the reasonable use of the land, building or structure and which promote standards of health, safety and welfare? VA-2010-739 12-16-10 Packet Page -31- 3/8/2011 Item 7.A. Yes. The proposed dock is reasonable while still allowing for safe access for the vessel to . moor within the riparian area e. Will granting the Variance confer on the applicant any special privilege that is denied by these zoning regulations to other lands, buildings, or structures in the same zoning district? No. Most other neighboring properties moor two vessels. This property can only moor one vessel. In addition, the applicant is requesting a fInger boat dock that is similar to the three neighboring properties to the north. f. Will granting the Variance be in harmony with the general intent and purpose of this Land Development Code, and not be injurious to the neighborhood, or otherwise- detrimental to the public welfare? - The proposed encroachment would have an impact mostly on the neighbor to the north. However, the applicant has received a letter of no objection (attached) from the neighbor to the north. In addition, the proposed dock will have no impact to navigation in the adjacent bay. g. Are there natural conditions or physically induced conditions that ameliorate the goals and objectives of the regulation such as natural preserves, lakes, golf courses, etc. ? . Yes. There is a sandbar that is approximately 125 feet wide between the docking area and then a mangrove island which pushes the location of the boat dock further into the water. In addition, the proposed boat dock is located in Pompano Bay, which is an aquatic preserve that does not allow dredging. h. Will granting the Variance be consistent with the Growth Management Plan? Approval of this variance will not affect or change the requirements of the Growth Management Plan. Turrell, Hall & Associates performed a submerged resource survey for the site referenced above on May 12, 2010. The survey was requested by Collier County staff. The Schneller residence is located in Isles of Capri, Florida. The project site is more specifically located in Section 31, Township 51 South, 26 East ofthe Naples, Florida, United States Geological Survey 7.5-minute series quadrangle map. The proposed docking facility as shown on the attached exhibits is a fixed wooden finger dock to facilitate the mooring of one vessel up to 17' in length, protruding .roximatelY 142' from the MHWL. The objective of the submerged resource survey is to identify and assess potential impacts to the existing submerged resources by the proposed project. The survey provided onsite environmental information to help determine if the proposed project would impact any existing submerged resources and if so would assist in reconfiguring the proposed in order to minimize any impacts. The general scope of work performed at the site is summarized below. · Turrell, Hall & Associates personnel conducted a site visit and snorkeled/walked transects within the proposed project basin and verified the location of any submerged resources. · Turrell, Hall & Associates personnel identified submerged resources at the site, estimated the % of coverage, and delineated the approximate limits of any submerged resources observed. · Turrell, Hall & Associates personnel delineated limits via a handheld GPS (Garmin Model 76csx). 2.0 Submerged Resource Survey Methodology J effRogers, Biologist of Turrell, Hall & Associates performed the submerged resource survey during an incoming tide with high tide being at 12:24 P.M. The submerged resources were evaluated using snorkel equipment where accessible and walked the remaining area where lower water levels exist all within the proposed dock footprint. The entire project area was evaluated systematically, setting up a series of transects approximately every ten feet ~>ughout the length of the entire shoreline and o~t waterward beyond the proposed docking facility and boat. .sects were laid from each property line running northwest and southeast all within the entire impact area. This IS the area that will be impacted with construction and normal ingress/egress of the proposed vessels utilizing the docking facility. A visual estimation of percent cover for submerged resources was made for each transect. Surface water conditions at the time of the submerged resource survey were calm. There was an incoming tide that was encountered during the survey with high tide registered at 12:24 P.M. (+2.4 MLL W) on this date. The substrate found at the site ranged from a silt sand or sand with small amounts of shell debris that ranged from the mangrove fringe line out past the distances of the proposed impact area. It is estimated that 95% of the area is covered with the silt sand with about 5% shell debris. The submerged resource survey at the site yielded few findings. Green alga (Coulexpa sertularioides) was observed, along with a few Florida Fighting Conchs (Strombus alatus), and a Banded tulip snail (Fasciolaria hunteria). Barnacles were in the immediate area growing on the mangrove roots along the shoreline and on the piles of the adjacent property dock. Few fish were also observed sporadically throughout the deeper transects that were cencentrated around the adjacent dock were shelter is provided. Since there are no seagrasses and no oysters that were observed, it is our opinion that the project will have little to no negative effect on the surrounding marine ecosystem. DEPARTMENT OF ENVIRONMENTAL PROTECTION SUBMERGED LANDS AND ENVIRONMENTAL RESOURCES PROGRAM GENERAL CONSENT CONDITIONS FOR AUTHORIZATIONS Project No: 11-0283215-001 Chapter 18-21.004(7), F.A.C., provides that all authorizations granted by rule or in writing under Rule 18- 21.005, F.A.C., except those for aquaculture activities and geophysical testing, shall be subject to the general conditions as set forth in paragraphs (a) through (i) below. The general conditions shall be part of all authorizations under this chapter, shall be binding upon the grantee, and shall be enforceable under Chapter 253 or Chapter 258, Part II, F.5. Chapter 18-21.004(7), F.A.C., General Conditions for Authorizations: (a) Authorizations are valid only for the specified activity or use. Any unauthorized deviation from the specified activity or use and the conditions for undertaking that activity or use shall constitute a violation. Violation of the authorization shall result in suspension or revocation of the grantee's use of the sovereignty submerged land unless cured to the satisf~ction of the Board. (b) AuthoriZations convey no title to sovereignty submerged land or water column, nor do they constitute recognition or acknowledgment of any other person's title t<? such land or water. (c) Authorizations may be modified, suspended or revoked in accordance with their terms or the remedies provided in Sections 253.04 and 258.46, F.S., or Chapter 18-14, F.A.C. . e> Structures or activities shall be constructed and used to avoid or minimize adverse impacts to sovereignty s~bmerged lands and resources. (e) Construction, use, or operation of the structure or activity shall not adversely affect any species which is endangered, threatened or of special concern, as listed in Rules 68A-27.003, 68A-27.004, and 68A-27.005, F.A.C. (f) Structures or activities shall not unreasonably interfere with riparian rights. When a court of competent jurisdiction determines that riparian rights have been unlawfully affected, the structure or activity shall be modified in accordance with the court's decision. (g) Structures or activities shall not create a navigational hazard. (h) Structures shall be maintained in a functional condition and shall be repaired or removed if they become dilapidated to such an extent that they are no longer functional. This shall not be construed to prohibit the repair or replacement subject to the provisions of Rule 18-21.005, F.A.c., within one year, of a structure damaged in a discrete event such as a storm, flood, accident, or fire. (i) Structures or activities shall be constructed, operated, and maintained solely for water dependent purposes, or for non-water dependent activities authorized under paragraph 18- 21.004(1)(f), F.A.C., or any other applicable law. . You must maintain the activity authorized by this permit in good condition and in conformance with the terms and conditions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification. of this permit from this office, which may require restoration of the area. 3. H you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by this permit, you must immediately notify this office of what you have found'. We will initiate the Federal and State coordination required to determine if the remains warrant a recovery effort or if the ~ite is eligible for listing in the National Itegister of Historic Places. 4. H you sell the property associated with this permit, you must obtain the signature and mailing address of the new owner in the space provided below and forward a copy of the permit to this office to validate the transfer of this authorization. . 5. H a conditioned water quality certification has been issued for your project, you must comply with the ' conditions specified in the certification as spec;ial conditions'to this permit. 6. You must allow representatives from this office to ~pect the authorized activity at any time deemed necessary to ensure that it is being or has been accomplished in accordance with the terms, and conditions of . your permit. further information: 1. Limits of this authorization: a. This permit does not obviate the need to obtain other Federal, State or local authorizations required by law. b. This permit does not grant any property rights or exclusive privileges. c. This permit does not authorize any injury to the property or rights of others. d. This permit does not authorize interference with any existing or proposed Federal projects. 2. Limits of Federal Liability. In issuing this permit, the Federal Government does not assume any liability for the following: a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted activities or from natural causes. . b. Damages to the permitted project or uses thereof as a result of current or fu~e activities undertaken . by or on behalf of the United States in the public interest. c. Reevaluation of Permit Decision: This office may reevaluate its decision on this permit at any time the circumstances warrant. Circumstances that could require a reevaluation include, but are not limited to, the following: a. You fail to comply with the terms and 'conditions of this permit. b. The information provided by you in support of your permit application proves to have been false, incomplete, or inacctIrate (see 3 above). c. Significant new information surfaces which this office did not ~onsider in reaching the original public interest decision. 5. Such a reevaluation may result in a determination that it is appropriate to use the suspension, modification, and revocation procedures contained in 33 CPR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. Listed below please find my comments: 1. The site map is incorrect A large plot of land lies between the plotted lots and the bay. 2. This land is not accreted. court records and photos from the 1950's show the contour of the land has not changed. 3. Mr. & Mrs. James Hughes (their letter of support for the petition is in your file) constructed the first dock extension over the land in question approximately 8 years ago. 4. Initially the Hughes attempted to gain possession of the land by means of adverse possession. Apparently they did not complete the process because there is no record of them having obtain Quiet Tittle. 5. In lieu of Quiet Tittle, the county record show Mr & Mrs Hughes apparently devised a different tactic. 6. :Mrs. Eleanor Hughes used her maiden name which was Eleanor DaSilva to represent the owner of the land with riparian rights and under that identity quit claim the property to herself and her husband. To the best of my knowledge DaSilva had no property rights. 7. After Hughes was successful, at least two other lot owners built docks apparently crossing land to which they had no deeds. Another land owner (lot 79 ) Puentes, attempted to have a dock approved in 2005, that was stopped when the circuit court ruled that none of this property owners had water front property or riparian rights. 8. All of this data is a matter of Collier County Public Record as a result of my quiet tittle Packet Page -99- 3/8/2011 Item 7.A. action for lot 78 in 2005. 9. The Trigo Survey was directed by Mr. run Hughes. Mr. Trigo testified in Circuit Court that he was directed how to apportion the land by Jim Hughes. 10. Mr Puentes letter to Collier County and the Collier County attorney dated 01/16/2011 is correct. The courts have denied riparian rights to all the lot owners adjacent to and North of the subject lot 81. 11. It appears to me that the docks built across this land are in violation.
