EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners Approve the Stipulated Final Judgment for Parcels llOFEE and llOSE in the condemnation action styled Collier County v. Meridian Broadcasting, Inc., et aI., Case No. 08-1253-CA, Tree Farm Road Project #60171. (Fiscal Impact: $122,050). OBJECTIVE: That the Board of County Commissioners approve the Stipulated Final Judgment for Parcels 1 10FEE and 1 lOSE in relation to the condemnation action in Collier County v. Meridian Broadcasting, Inc., et a!., Case No. 08- 1 253-CA. CONSIDERATIONS: Collier County condemned a 1.11 acre (Parcel 11 OFEE) and .40 acre (Parcel 11 OSE) for the widening of Woodcrest Drive in conjunction with a road project known as Tree Farm Road from property owner Mary Wagner. The County's initial appraisal dated July 17, 2007, valued the taking at $367,000. The County offered the owner $392,000 as the County's statutory offer in August 30, 2007. An updated appraisal, dated April 10, 2008, showed no change in the market value of $367,000 for the taking. An Order of Taking hearing was held on May 28,2008, and the County deposited the sum of$367,000 in the Court Registry. The owners' appraiser valued the two parcels at $863,500, which included $404,600 in restoration costs for drainage and access, as well as $35,000 for improvements in the take. The date of valuation, by law, is the date that the property is taken by the condemning authority. In this case that date is June 9, 2008. Should the matter have proceeded to trial, the jury would have been instructed to determine full compensation as of June 9, 2008. Mediation was held and monetary issues were agreed to pending the resolution of the access issue. Further negotiations resulted in an agreement for access at substantially the location shown on the attached engineering drawing. After negotiations, the parties agreed to settle the compensation in this matter in the amount of $447,000. Expert fees and costs were also settled from $13,6]2.05 to $] ],600 for Hanson Real Estate Advisors, Inc. and from $ 1 4,321.25 to $ 1 2,300 for Messimer and Associates. Attorney fees are mandated by statute and will be $] 8,] 50. If approved, the County will pay the following costs: · Additional Compensation . Appraiser . FISCAL IMP ACT: Funds in the amount of $] 22,050 are available in Gas Taxes. Source of funds are Gas Taxes. GROWTH MANAGEMENT IMP ACT: None. LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. This item requires only a simple majority vote.
