PRESENTATION BY FLORIDA DEPARTMENT OF TRANSPORTATION ON THE REQUIRE- MENTS FOR METROPOLITAN TRANSPORTATION PLANNING - NO ACTION TAKEN Chairman Pistor said that the workshop would cover the presenta- tion by the Florida Department of Transportation on the requirements for motropolitan transportation planning. Community Development Administrator Virta sai1 that representatives of the Division of Transportation Planning of Florida DOT were present to make a present- ation regarding what a Metropolitan Planning Organization is, why the County has to establish an MPO, what the benefits are, and he intro- duced Mr. William Godfrey, Deputy Director of the Department of Trans- portatIon PlannIng. He said that, in 1962, Congress responded to local elected officials who said that the State DOT and highway departments were building projects without the officials involvement and they expresseð a desire to have more opportunity for such involvement. He saið that in 1962 Congress passed a law which stated that in areas with a population of ovcr 50,000, federal funds for highway projects would not be spent unless there was a plan which had been developed cooperati~ely by the local elected of!icials and the DOT, and that the project that was being funded was part of that plan. Mr. Godfrey said that because of the workload which the afore- mentioned process placed on local government, in 1973 planning funds were set up called PL Funds or Section 112 Funds which, he explained, pass through the department and cannot be spent by the department. He explained the reimbursable process whereby local governments spend the money for planning and the DOT reimburs~s the government and then seeks reimbursement from the Federal Highway Department. Mr. Godfrey said that the Federal Government in 1975 issued regulations which stiffened the MPO organization and made it very formal with the MPO to be designated by the Governor. In 1979, the Florida State Legislature passed statutes which established the MPO which state that, where an MPO is required by Federal Government, one must be formed, he explained. Mr. Godfrey introduced Mr. Bob Cromminsky from the Urban Plannin9 Of flee in Tallahassee, Mr. Claude Whi te from the Fort Lauderdale '\ . District Office and his assistant, Hr. A slide presentation, prepared by the Division of Transportation Planning and Programming of the Florida ~~ansportation Dopartment, followed which was an orientation program to , hel~~eoPle better understand their responsibilities and authority as members of an MPO and described the role of the MPO. Following the slide presentation, Mr. Godfrey explained that, since that script had been written, some changes have been made and, that sincð there have been changes in the Reagan Administration, Federal requirements have eased a little. Mr. Godfrey stated that, as far as Collier County is concerned, the following items would need to be written: l. Interlocal agreement between the City, County and DOT. 2. A contract between DOT and the MPO for the money. 3. A contract between the MPO and its sta ff for the money. Chairman Pistor stated that a letter had been sent to the Governor requesting that the makeup of the MPO be changed from fIve and five to three members from the County and two from the City but no rcsponse had been received. He said that he heard reccntly that the necess1ty of the County forming ah MPO was questionable pince, with a population of approximately 50,000, an MPO might not be required. He said that he was concernod about whether or not the County is blocked from receiving Federal funds if no MPO is formed. He said he had not looked at the flv. ;.' .\ ,H; year work program to see if there were any federally funded projects at ~j the present time, and, therefore, he could not say that if the County did not form an MPO 3 certain job would ·fall by the wayside·. The point was made that 1-75 is outside the urbanized area. County Manager Norman noted that the City Council of Naples has scheduled the MPO matter for discussion at their regular meeting on October 21, 19a1 and Mr. Barry, Community Development Director, will present a recommendation that the Council endorse the County's proposal for a five member MPO. Mr. Godfrey said that the September 17, 1981, Federal Register, which covered brand new MPO's,' incorporated a change which is that the design~tion will be by cooperative agreement between local elected officia)s and the Governor, instead of by the Governor alone, which Is . what the State law had m~ndated. He said that a number of MPO's in Florida, in the past, have requested the Governor to modify his deslg- nation and in every case, where there has been a reasonable attempt and agreement on the local level, he has done as requested. Chairman Pistor said that two members of the staff went to a meeting two weeks ago regarding MPO's. He asked if everyone has to be an elected official on an MPO, and Mr. Godfrey said that under Florida Statute everyone muat be an elected official of general purpose gov- ernment, not a Sheriff for instance, except for the two non-voting members of DOT. Mr. Virta said that a draft of inter-local agreement has been p~epared between the County and the City of Naplesl a set of proposed " bY-~WS are being formulated for the MPO, should it be constituted and work has begun on a work program in anticipation of the County becoming involved in an MPO when a response is received from the Governor. Hr. Godfrey said that, assuming tho Federal funding level stays approximately the same, that funding would be approximately $40,000 to support the MPO, which would require a 20\ match. He explained that, in the past, the Department has put up 10\ of that match in in-kind services and that, as long as staff is available, the Department would be willing to do that in the future, which would mean that the County would h~ve to fund the local staff for approximately $4,000 per year to make the match. In response to Mr. Norman's question, Mr. Godfrey said that in-kind contributions are accepted for the match. Chairman Pistor thanked Mr. Godfrey for the presentation. Mr. . Virta said that no action was required by the Board at this time. . . . . . . .
