To appoint 2 members representing Residential to serve 4 year terms, expiring on March 31, 2015, to the Pelican Bay Services Division Board, Declare a vacancy for the 1 term representing Residential expiring March 31, 20 I] that did not receive an applicant. CONSIDERATIONS: This 1] member Board was established by Ordinance 2002-27 as amended, The Division provides landscaping services, including all public road maintenance and park areas, street lighting services, aquatic management services, beach cleaning, and the Clam Bay Restoration Project. It is the Division's responsibility to provide the framework of long-term community planning so that residents can enjoy the benefits of Pelican Bay while ensuring both the social and financial well being of the Pelican Bay Community, A list of the current membership is included in the backup, Ordinance 2002-27 states that the Board of County Conunissioners shall publish the list of nominees and the positions on the Committee for which they have been nominated and deliver a conformed copy to the Clerk of Courts, The Clerk shall cause the name of each nominee as reported and published by the Board of County Commissioners to be included on the mail ballot, which ballot shall be mailed to all of the non-governmental property owners of the class (i.e. "Residential or Commercial/Business/Other") corresponding with the class for which the balloting is occurring ("Residential or Commercial/Business/Other") within the Unit no less than thirty (30) days prior to the balloting date. Said balloting date being set by the Board of County Commissioners, The terms for John Iaizzo (resident), Michael H. Levy (resident), and Theodore J. Raia (resident) will expire on March 31, 2011. BCe FROM: Scott R, Teach, Deputy County Attorney DATE: January 18,2011 RE: Pelican Bay Services Division Board - Election of Board Members Collier County eode of Laws and Ordinances, Chapter 122, governs the composition and appointment of members to the Pc1ican Bay Services Division Board (the "Board"), The Board is comprised of eleven (II) members; nine (9) members are representatives from the residential portion of the taxing unit and two (2) members are representatives of the commercial and business interests, Three (3) vacancies were advertised seeking applications to till the vacant positions in December 20]0 as required by Section 122-1 662(c) of the Ordinancc, Only two (2) applications were submitted, I am responding to your question as to how those two applications should be processed for the vacant positions and what procedure should be followed for the remaining vacant position, J will answer those issues in order. A. The Two Applicants In instances where the number of applications exceeds the number of available positions, the ordinance provides a process where the Clerk of Court is involved in a process of mailing out ballots to nongovernmental propelty owners in Pelican Bay to votc for either residential or commercial candidates, The mail ballots are then cast directly to the Clerk who opens and counts the ballots at a designated time, Jd. S (d)(3), If. however, the number of applications does not exceed the number of open members, Section 122- 1662(f) states: "",there shall be no balloting for such position, Rather, the list of nominees for the position shall simply be forwarded to the Board of County Commissioners who, following public hearing on the matter will make the necessary appointments to fill the position," Therefore. the names of the two applicants, if otherwise qualified, should be forwarded to the Board of County Commissioners for appointment. B, The Remaining Vacant Position As to the third remaining vacant position, I would recommend re-advertising the position and seeking a recommendation from the PBSD Board, The exact situation we have in this instance is not addressed in thc ordinancc but thcrc is somc authority that would support following the advertising and selection procedure in the County's general Advisory Board Ordinance No, 2001,55, Notably, all appointments of members to the PBSD Board are at thc sole and complete discretion of the BCC - although when thc process works the way it is supposed to. the BCC is to give "great weight" to the recommendations of the properry owners as represented in their ballots, Packet Page -183- 2/8/2011 Item 9.B.
