EXECUTIVE SUMMARY Recommendation to approve Petition V AC-PL2010-2196, to disclaim, renounce and vacate the County's and the Public's interest in a portion of a 20-foot wide Access Easement for drainage and maintenance crews, over Lot 26, Block B, Palm River Estates Unit No.7, according to the Plat thereof as recorded in Plat Book 12, Pages 28 through 30, of the Public Records of Collier County, Florida, situated in Section 23, Township 48 South, Range 2S East, Collier County, Florida, the subject portion of easement to be vacated is more specifically depicted and described in Exhibit "A". OBJECTIVE: To adopt a resolution vacating the County's and the Public's interest in a portion of a 20-foot wide Access Easement for drainage and maintenance crews, over Lot 26, Block B, Palm River Estates Unit No.7, a subdivision according to the Plat thereof as recorded in Plat Book 12, Pages 28 through 30, of the Public Records of Collier County, Florida, situated in Section 23, Township 48 South, Range 25 East, Collier County, Florida, the subject portion of easement to be vacated is more specifically depicted and described in Exhibit "A". CONSIDERATIONS: Petition VAC-PL2010-2196, has been received by the Engineering Services, Growth Management Division, Planning and Regulation from Joseph Hohmann owner, requesting the vacation of a portion of a 20-foot Access Easement for drainage and maintenance crews so the owner can expand their existing lanai and install an in ground swinuning pool. The abutting property owners on each side of the proposed vacation have responded with letters of no objection to the proposed vacation. The Homeowner's Association has also produced a letter of no objection. All platted streets, roads and easement were dedicated to the perpetual use of the public for the purposes shown. The original intension of the easement was to allow access for maintenance from thc lake bank, since most lake maintenance in now completed from inside the lake and the fact that the petitioner has demonstrated that a minimum of 20 feet between the proposed structure and the lakes edge (lake control elevation) remains, staff feels limited if any impact results from the vacation of the portion of easement. Sole responsibility for any additional cost which may be incurred due to the reduction in easemcnt width will lie with Homeowners Association. Given the nature of the Access Easement, no utilities companies or emergency services such as the Collier Sheriff or Fire and Rescue have been notified. All required documentation as required by Collier County Resolution 2006-160, Attachment "B", Policy and Procedure for the vacation and annulment of plats or portions of plats of subdivided land, has been submitted, thereforc county staff recommends approval. FISCAL IMP ACT: Growth Management Division, Planning and Regulation staff has collected a $2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. ENVIRONMENTAL ISSUES: There are no outstanding environmental issues.
