EXECUTIVE SUMMARY Recommendation to approve Amendment No. A02 renewing the Sonth Florida Water Management District Agreement No. OT061098, as amended by Amendment No. AOI, to continue monitoring of ground water in Collier County in Fiscal Year 2011 (estimated fiscal impact $116,000 in earned revenue). OBJECTIVE: That the Board of County Commissioners approves the attached staff recommended Amendment No. A02 to Agreement OT061098, as amended by Amendment No. AOI, between Collier County and the South Florida Water Management District (SFWMD). Amendment A02 renews the existing Agreement for one year, and pays the county up to $1 l6,000 in Fiscal Year 201]. This is the first annual renewal of a two-year renewal option provided in Amendment AO I . CONSIDERATIONS: Amendment A02 continues a four year monitoring effort for collection and analysis of ground water throughout Collier County. Under this Agreement, the County's Pollution Control & Prevention Department will monitor 70 ground water sites semiannually for three years. An annual assessment report will be generated that investigates the effects of land use on groundwater quality. The report will also be used to develop watershed management strategies for the protection of groundwater qual ity in Collier County. A,mendment A02 extends the tenn of the Agreement by one year to Septcmber 30, 20 1 I and allows the County to further extend the term for up to one additional ycar, FISCAL IMP ACT: Amendment A02 rencws the current Agreement for one year and in accordance with the tcrms of the original Agreement OT06] 098 SFWMD will fund the county up to $] 16,000 in Fiscal Year 20 11. Payments for Fiscal Year 20] 1 will be received from the SFWMD semiannually based on complction of the county's required deliverables as specified in the Amendment. This revenue was budgeted for Fiscal Year 2011 in Water Pollution Control Fund 114. The option to renew the Amendmcnt in Fiscal Year 20]2 will be exercised at the discretion of the SFWMD and approval by its Governing Board. LEGAL CONSIDERATIONS: According to the Purchasing Department, the additional one year term provided by Amendment A02 will begin on October 1,20]0 in order to cover the work, deliverable and payment schedule that are tied to the fiscal year. All other terms and conditions of the Agreement remain unchangcd. SWFMD requires that the County approve Amendment A02 prior to its approval. This item is legally sufficient and requircs a simple majority vote. - JBW GROWTH MANAGEMENT IMPACT: The scope of the Agreement complies with, and is consistent with, the requirements of the Conservation and Coastal Managemcnt Element Objective 3.4 and the Natura] Groundwater Aquifer Recharge Sub-element Objective 1.3 of the Growth Management Plan relative to ground watcr quality monitoring. -- Packet Page -303- 2/8/2011 Item 16.C.2. OT061098 BETWEEN THE SOUTH FLORIDA WATER MANAGEMENT DISTRICT AND BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA This AMENDMENT NO. 02, entered into on , to that AGREEMENT dated January 09, 2007, and as amended on December 15, 2009 (A01), between "the Parties," the South Florida Water Management District (DISTRICT), and Board of County Commissioners, Collier County, Florida (COUNTY). WITNESSETH THAT: WHEREAS, the AGREEMENT may be amended with the prior written approval of the Parties; and WHEREAS, the Parties wish to amend the AGREEMENT in order to exercise the option to extend the period of performance for an additional year; NOW THEREFORE, the DISTRICT and the COUNTY, in consideration of the mutual benefits flowing from each to the other, do hereby agree as follows: 1. The term of the AGREEMENT is hereby extended by One (1) Year and the expiration date, as amended, is September 30, 2011. Regardless of the actual date of execution, this AMENDMENT NO. 02 shall be effective as of October 01,2010. 2. Upon completion of the Fiscal Year 20ll option, the DISTRICT reserves the right to extend the period of performance for up to one additional year. This option shall be exercised at the sole discretion of the DISTRICT and subject to DISTRICT Governing Board budgetary approval for Fiscal Year 2012, No work for this option year shall be authorized until such time as the COUNTY has received written notification from the DISTRICT exercising the option. 3, All other terms and conditions ofthe AGREEMENT remain unchanged.
