EXECUTIVE SUMMARY
Recommendation to approve Amendment AOl to Agreement No. 4600001937 between
Collier County and the South Florida Water Managcment District, renewing the existing
agreement for the supplemental collection of surface water quality samples in Collier
County (estimated fiscal impact $60,000 in earned revenue) and to approve the associated
budget amendment.
OBJECTIVE: That the Board of County Commissioners approves the attached staff
recommended Amendment AOI to the original Agreement No, 4600001937 between Collier
County and the South Florida Water Management District and to approve the associated budget
amendment.
CONSIDERATIONS: Amendment AOI renews the eXlstmg Agreement between the Big
Cypress Basin (Basin) of the South Florida Water Management District (SFWMD) and the
Collier County Pollution Control and Prevcntion Department (County) for the collection and
analysis of 50 surface water quality monitoring locations within Collier County,

The primary objective of the original Agreemcnt is to supplement existing monitoring to obtain
more spatial coverage and additional parameters to I) continue evaluation of the water resources
within the Basin and the coastal waters of Collier County; 2) provide data and analyses required
for development and implementation of the County's watershed management plans; 3) meet the
water quality protection objectives of the County's grO\vth management plan; and, 4) meet the
requirements of the Florida Department of Environmcntal Protection's Total Maximum Daily
Load program.
FISCAL IMPACT: Consistent with the payment terms in the original Agreement Nd.
4600001937, the Amendment will fund the County up to $60,000 in Fiscal Year 2011 and
provides a one-year renewal option. Payments, not to exceed $60,000, will be received from the
SFWMD semiannually bascd on completion ofthc County's required deliverables as specified in
the Amendment. For Fiscal Year 2011, in Water Pollution Control Fund 114, $l2,700 was
budgeted; therefore a budget amendment for $47,300 will be required. The option to renew the
Agreement for Fiscal Year 2012 will bc exerciscd at the discretion of the SFWMD and approval
by its Governing Board.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action and requires a
simple majority vote for approval. SFWMD requires that the Board execute Amendment AOI
prior to SFWMD approval. - JBW
GROWTH MANAGEMENT IMPACT: The scope of the Amendment and original Agreement
complies with, and is consistent with, the requirements of the Conservation and Coastal
Management Element of the Growth Managcment Plan relative to surface water quality
- monitoring.

RECOMMENDATION: To approve the attached Amendment AOl to Agreement No,
4600001937 whereby the South Florida Water Management District will pay the County's
Pollution Control & Prevention Department an amount not to exceed $60,000 to collect surface
water samples within Collier County beginning in Fiscal Year 2011, with an option to renew in
Fiscal Year 2012. To also approve, the attached budget amcndment for $47,300.

TO AGREEMENT NO. 4600001937
BETWEEN THE
SOUTH FLORIDA WATER MANAGEMENT DISTRICT
AND
BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA
This AMENDMENT NO. 01, entered into on , to
that AGREEMENT dated January 12, 2010, between "the Parties," the South Florida Water
Management District (DISTRICT), and Board of County Commissioners, Collier County,
Florida (COUNTY),
WITNESSETH THAT:
WHEREAS, the AGREEMENT may be amended with the prior written approval of the
Parties; and
WHEREAS, the Parties wish to amend the AGREEMENT in order to exercise the
option to extend the period of performance for an additional year;
NOW THEREFORE, the DISTRICT and the COUNTY, in consideration of the mutual
benefits flowing from each to the other, do hereby agree as follows:
1. The term of the AGREEMENT is hereby extended by One (1) Year and the expiration
date, as amended, is September 30, 2011. Regardless of the actual date of execution, this
AMENDMENT NO. 01 shall be effective as of October 01, 2010.
2, Upon completion of the Fiscal Year 2011 option, the DISTRICT reserves the right to
extend the period of performance for up to one additional year. This option shall be
exercised at the sole discretion of the DISTRICT and subject to DISTRICT Governing
Board budgetary approval for Fiscal Year 2012. No work for this option year shall be
authorized until such time as the COUNTY has received written notification from the
DISTRICT exercising the option.
3. All other terms and conditions of the AGREEMENT remain unchanged.
