Agenda 06/26/2018 Item #16D 306/26/2018 EXECUTIVE SUMMARY Recommendation to approve USIC, LLC as a single source provider in the estimated annual amount of $81,000 to provide locates for buried electrical network currently owned by Collier County, acting as the Vanderbilt Beach Beautification Municipal Service Taxing Unit (MSTU), to support the needs of the contractor providing sewer and water upgrades for the Public Utilities Department in the Vanderbilt Beach area. OBJECTIVE: To provide locates to minimize damage to a buried electrical network owned by Vanderbilt Beach MSTU during construction of sewer and water upgrades in the Vanderbilt Beach area. CONSIDERATIONS: The Board of County Commissioners (Board) has awarded several contracts administered by the Vanderbilt Beach MSTU to convert all the aerial utilities within the boundaries of the MSTU to underground. Phase I along Gulf Shore Drive was completed in September 2013. Phase II and III, from Gulf Shore Drive East to Vanderbilt Drive has been installed completely except for activation. On March 9, 2017, Florida Power and Light (FPL) accepted the As-Built construction prints for Phases II and III of the Vanderbilt Beach Aerial to Underground Conversion. The FPL installation contractor, MasTec, was asked to mobilize and prepare for activation on April 1, 2017. At that time, it was anticipated that the activation of both phases would be completed by December 1, 2017. However, a concern for the safety of the contractors and their personnel working on the Public Utility Department’s water and sewer line replacement project located in the same area as the phase III power line conversion project resulted in a request to delay activation of the FPL network for phase II and III. Through discussions among the County Manager’s office, Public Utilities Department, and the Public Transit & Neighborhood Enhancement Division, it was agreed the commencement of the FPL activation should be delayed until April 2018. The delay in FPL activation will result in added cost for remobilization, locates, and repairs in conjunction with the Public Utilities construction project; which will be reimbursed by the Public Utilities Department after post -audit. Due to Hurricane Irma in September 2017, the Public Utility project schedule had to be revised, and the activation has been further delayed and is now scheduled to be complete in December 2019. Until activation and acceptance by FPL, the buried network belongs to the Collier County MSTU, and the MSTU must provide locate services to comply with Florida’s 811 Sunshine (locates) law. Locates is a mandatory service under State law provided by the owner of the buried product for assistance to any contractor digging in the area. USIC was selected because it is currently the only locate company under contract with FPL to locate their services; and, although the work involves a Collier County MSTU project, the County must obtain FPL concurrence on contracts used for this project involving the underground relocation of FPL power lines. USIC agreed to add the MSTU locate tic kets to the other 811 Sunshine locate tickets requests within the project area, which will result in reduced cost to the MSTU both in staff time and 811 Sunshine charges. USIC has been performing locates since February 2017 under a Purchase Order with a waiver request for single source according to current Procurement policy. Because this change in the project schedule will result in increased costs over $50,000, it requires Board approval. If this revised schedule is maintained, the proposed cost increase should be sufficient through the estimated completion date of December 2019. On April 5, 2018, the Vanderbilt Beach MSTU Advisory Committee voted 5-0 to recommend approval of this Item. 06/26/2018 FISCAL IMPACT: Funds in the amount of $81,000 are available in Vanderbilt Beach MSTU Fund (143) until reimbursement is accomplished. USIC will locate buried conduit containing cables that are meant to supply feeder, primary, and secondary electrical service to the community. The cost is based on per request ticket rate for service by the excavation contractors and the extra man hours required to perform the service. Purpose: Describe in detail, the public purpose of the requested item(s) and why it is essential to County operations. Vanderbilt Beach Beautification MSTU has installed a buried electrical network in the Vanderbilt Beach with the objective of replacing all aerial services in the area and it has not been activated. Until it is activated and accepted by the FPL, it is owned by the MSTU which is mandated by 811 Sunshine Law to locate buried services for excavation contractors. Public Utilities has contracted to replace storm, sanitary sewers and water lines in the area and has requested that activation of the FPL network be delayed for two plus years. Upon verification of the cost, Public Utilities has agreed to reimburse the MSTU for added costs associated with the delay. How was the decision made to use this vendor? Describe in detail if a formal standardization process was performed via Procurement or if there is a historical precedence established for the use of the product, please explain purchase and use history and the current level of County investment in the product. USIC is under contract to FPL, CenturyLink, and Comcast to locate all of their services in the geographic area that the MSTUs buried network exists. Hiring USIC allows the combination of the FPL and MSTU locate tickets and minimizes the cost of each ticket. When USIC gets a locate ticket in the area it automatically locates the MSTU services. It also allows the MSTU to not join the 811 Sunshine service. The MSTU is very short staffed and joining the service would rapidity overwhelm the division. USIC has been performing this service for over a year and is currently working under a PO for $50,000 under a waiver request. What is the cost/benefit of using, or continuing to use, this vendor for this product(s)? Describe savings or benefit of staying with this firm and the additional cost or down side of switching to another provider. Locates is a mandatory service provided by the owner of the buried product. Utilizing the existing vendor hired by FPL to locate the future FPL buried service allows the MSTU locate tickets to be piggybacked onto the other utility tickets in the area without incurring the cost of joining 811 Sunshine and staffing up to support it. In addition USIC can and will locate the MSTUs services for less cost overall than another locate company. Market research and market alternatives: When was the last time a market evaluation was performed to determine if either the technology or vendor offerings have changed? When will your next evaluation be performed? The method for providing the services offered under this contract is regulated by the State of Florida. The vendor must comply with most recent State regulations. Citing the definitions provided at the top of this form, why is this either a Sole Source or a Single Source? Provide Information on why a particular product and/or vendor was chose. Collier County Public Utilities is replacing all Potable Water, Sanitary Sewer, and Storm Sewer lines in Vanderbilt Beach. Vanderbilt MSTU has completed installation of buried power lines in the same area with a value of approximately $4.5 million and until completely activated and connected will own the network and is responsible for Locates under 811 Sunshine Law in Florida. Due to safety concerns of the contractor, Utilities has requested a delay of the activation of the buried lines for two plus years. To prevent damage to the buried network and to not delay the Utility project, it is mandatory that locates be performed. PTNE Division is not a member of 811 Sunshine and the division does not have the staffing to handle the volume of calls if they became a member. In addition, there is a substantial cost associated with becoming a member of 811 Sunshine. 2. If the Product requested is one -of -a -kind item, provide background information on how this was determined and backup resources utilized. USIC has agreed to do the MSTU locates at the same time it does the other locates in the same area. This allows the MSTU to provide locates without joining 811 Sunshine and do so immediately. USIC is the only Locate company that supports locates for the other three utility companies that have services in the area. 3. What would the impact be to change to a different product (include: training, inventory, parts, maintenance, project or staff time to replace the item? If another locate company was utilized, there would be a significant delay in providing locates. Since USIC is already in the area on a daily basis doing locates for three other utilities, the incremental costs of the service will be less since USIC would be combining like services. The MSTU will not have to join 811 Sunshine saving significant costs of doing so and providing staff to support it. 4. If unique features are required to successfully perform the required function, identify those features and why they are required and cannot be substituted. only lack of time to respond is really important in this case and this is a service and not a product. The locates must be performed immediately and ongoing for a minimum of 1.5 years. To help prevent damage to the buried network. Vanderbilt MSTU has completed installation of buried power lines in the same area with a value of approximately $4.5 million and until completely activated and connected will own the network and is responsible for Locates under 811 Sunshine Law in Florida. Due to safety concerns of the contractor, Utilities has requested a delay of the activation of the buried lines for two plus years. To prevent damage to the buried network and to not delay the Utility project, it is mandatory that locates be performed. PTNE Division is not a member of 811 Sunshine and the division does not have the staffing to handle the volume of calls if they became a member. In addition, there is a substantial cost associated with becoming a member of 811 Sunshine. 2. If the Product requested is one -of -a -kind item, provide background information on how this was determined and backup resources utilized. USIC has agreed to do the MSTU locates at the same time it does the other locates in the same area. This allows the MSTU to provide locates without joining 811 Sunshine and do so immediately. USIC is the only Locate company that supports locates for the other three utility companies that have services in the area. 3. What would the impact be to change to a different product (include: training, inventory, parts, maintenance, project or staff time to replace the item? If another locate company was utilized, there would be a significant delay in providing locates. Since USIC is already in the area on a daily basis doing locates for three other utilities, the incremental costs of the service will be less since USIC would be combining like services. The MSTU will not have to join 811 Sunshine saving significant costs of doing so and providing staff to support it. 4. If unique features are required to successfully perform the required function, identify those features and why they are required and cannot be substituted. Only lack of time to respond is really important in this case and this is a service and not a product. The locates must be performed immediately and ongoing for a minimum of 1.5 years.
