EXECUTIVE SUMMARY
Recommendation to award Contract #10-5586 for the installation of an emergency
generator at the Collier Area Transit facility at 8300 Radio Road to Wm. J. Varian
Construction Co. Inc., in the amount of $90,223.85 plus a ten percent contingency ($9,022)
for a total amount of $99,245.85.
OBJECTIVE: To install an emergency generator at the Collier Area Transit (CAT) facility at
8300 Radio Road for continuity of operations during power outages.
CONSIDERATIONS: Collier County Board of County Commissioners approved a grant
award from the Federal Transit Administration (FTA) on September 15, 2009 for purchase and
installation of an emergency generator at the CAT Operations facility at 8300 Radio Road. The
grant total was $259,000 and was matched by toll revenue credits assigned from the Florida
Department of Transportation.
The purchasing department advertised the solicitation on November 5, 2010. Email notices of
the bid were sent to 1,309 firms; 65 firms downloaded the bid and 5 bids were received on the
due date of November 30,2010
The five (5) responsive bids received ranged from $90,223.85 to $183,051.00. Bid costs are
noted on the attached bid tabulation.
The engineer of record has reviewed the bids received and recommends awarding the
construction contract to Wm. 1. Varian Construction Co. Inc. as the lowest, qualified and
responsive bidder. Their quote was the lowest at a cost of$90,223.85.
Although Wm. 1. Varian Construction Co. Inc. did not submit E-verify validation with its bid
submittal, the Purchasing Department had previously received such validation and had the
information on file. Wm. 1. Varian Construction Co. Inc. also did not provide the signed
Vendor's Insurance Statement, Addendum 1 acknowledgment or Certificate of Authority. That
documentation has been subsequently obtained by Purchasing and staff considers the lack of
submission of the documentation with the proposal to be a minor irregularity since the
documentation has no effect on the bid price. Staff recommends that the Board waive the minor
irregularity and award the bid to Wm. J. Varian Construction Co. Inc.
FISCAL IMPACT: Funding is available in the CAT Enhancement Fund, 426, within Project
No. 33031. The source of funding is FTA Section 5309 grant funding.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office, is legally sufficient for Board action and only requires a simple majority
vote-SRT.
GROWTH MANAGEMENT IMPACT: Consistent with Objective 10 and 12 of the
Transportation Element of the Growth Management Plan.
RECOMMENDATION: That the Board of County Commissioners (1) approves award of
Contract #10-5586 to Wm. J. Varian Construction Co. Inc. for the installation of an emergency

contingency, and (2) authorizes the chair to sign the standard contract after review by County
Attorney.
