Agenda 06/12/2018 Item #16D1606/12/2018 EXECUTIVE SUMMARY Recommendation to approve a Resolution directing the County Manager to take immediate action to make the minimum necessary repairs required to facilitate the transport of emergency service vehicles on Blue Sage Drive, authorize all necessary Budget Amendments and move forward with the repayment process. OBJECTIVE: To make repairs to Blue Sage Drive to make the roads accessible for emergency vehicles. CONSIDERATIONS: As set forth in the backup material, Great Naples Fire Rescue District (GNFRD) Chief Kingman D. Schuldt recently advised the County as follows: The GNFRD “was tasked with visually inspecting Blue Sage Drive, a private street located off Brantley Blvd. in the Golden Gate Estates section of Greater Naples Fire Rescue response area. The purpose was to identify the condition of the road, and what state of repair it is in, with regard to response readiness.” The travel time from Brantley to the end of the road was evaluated to identify whether any hazards were presented by the roadway condition. The GNFRD reported: 1. Blue Sage Drive (approx. 1.5-mile-long), took over ten minutes to traverse to the end. a. The street is comprised of small to large potholes which measured about 18 to over 20 inches deep and larger in diameter than the staff’s vehicle driven; b. There are rolling rises and low spots which present a hazard with low hanging plumbing of the larger apparatus; c. There are sections of the road where the surface itself has been washed away due to the recent heavy rains. The condition is only going to get worse as the current rainy season continues. There are photos attached to demonstrate that the width of the road is demising and with substantial truck traffic, I believe it would fail. d. Blue Sage Drive’s condition would cause approximately a 30 plus minute shuttle delay if required to respond to a working structure or wildland fire at the north end of the road. e. The street is not conducive to ALS care or CPR in a Traumatic or Cardiac Care mission. The time to travel and condition of the street would allow conditions to deteriorate rapidly in some cases. The County received email correspondence from a property owner on Blue Sage Drive reporting the unsafe conditions and expressed concern for the existing roadway conditions and have inquired about options available to get the roadway repaired. Based on the letter from the Fire Chief, Blue Sage Drive is currently impossible for use by fire rescue apparatus and requiring immediate attention. The attached Resolution seeks to strike a balance between the Board of County Commissioners (Board) obligations to safeguard the health, safety, and welfare of the citizens of Collier County, and its duty to respect the Constitutional private property rights of owners of private roads. Because the cost utilized to repair the private roads will be ultimately borne solely by the residents serviced by the private road, the County Attorney has previously opined that the proposed procedure is legally sound. In accordance with the County’s established procedures for emergency repairs of private roads, as set forth in Resolution Nos. 2013-221 and 2015-244, the attached Resolution does the following: 1. Waive notice of a public hearing to the residents of Blue Sage Drive as this is a case of an immediate public emergency. 2. Directs the County Manager to (1) take immediate action to bring Blue Sage Drive to a passable condition to facilitate the transport of emergency service vehicles; and (2) following the 16.D.16 Packet Pg. 1483 06/12/2018 necessary repairs to the road, place an item on the Board's Agenda to establish an involuntary Municipal Service Benefit Unit (MSBU) or Municipal Service Taxing Unit (MSTU). The purpose of the MSBU or MSTU, whichever is deemed more appropriate, will be for repayment of funds used to make emergency repairs to Blue Sage Drive and to establish funds to be used for future emergency repairs. 3. Requires initial funds generated by the MSBU/TU to be used to repay the County its full cost in repairing the road, with any leftover funds held in a separate account for future emergency repairs. Should an alternative method to reimburse the County for the repairs performed on private unpaved roads be adopted by the Board, staff will utilize that method if deemed appropriate. FISCAL IMPACT: The Road Maintenance Division estimated that the emergency repair work to make the road passable will cost approximately $12,500. These emergency repairs will initially be incurred within the MSTD General Fund (111) Road Maintenance budget and reimbursed utilizing an intergovernmental charge back against Special Assessment Fund (341). In Fund (341) a budget amendment will be processed that establishes a Blue Sage Drive Emergency Repair budget by reducing existing reserves. As provided above, repayment by benefiting properties will occur through a MSBU or MSTU mechanism. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact. LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney, is approved as to form and legality, and requires majority vote for approval. -JAK RECOMMENDATION: To approve the attached Resolution directing the County Manager to take immediate action to make the minimum necessary repairs required to facilitate the transport of emergency service vehicles on Blue Sage Drive, authorize all necessary Budget Amendments, and move forward with the repayment process.
