Agenda 06/12/2018 Item #11D06/12/2018 EXECUTIVE SUMMARY Recommendation to authorize an Amendment to the January 12, 2016, Agreement between CrowderGulf Joint Venture, Inc. and the County to add additional line items to the existing contract to perform waterway debris removal within the original scope of work of the contract and to obtain direction for work in critical areas downstream of the main Collier County Stormwater Management System, as part of the stormwater debris initiative. OBJECTIVE: To provide a contractual line item for CrowderGulf to perform waterway debris removal operations under its current contract and obtain direction for work in critical areas downstream of the Collier County Stormwater Management System, as part of the stormwater debris initiative. CONSIDERATIONS: The County awarded CrowderGulf Joint Venture, Inc. (Contractor) a contract to provide Disaster Debris Management, Removal, and Disposal Services. The Unit Cost Fee Rate Schedule included in the original solicitation and resulting contract was not uniform and did not include appropriate unit cost line items for waterway debris removal activities. The County provided a required fee schedule and provided the option for Supplemental/Ancillary Services Fee Schedules. In the case of the supplemental/ancillary fee schedules, not all awarded contractors provided uniform line items. Line items for removal, collection, and disposal of Canal/Marine debris, small hazardous stump removal or private locate services have now been created and added to the subject contract a mendment. Unit prices have been negotiated and established to function as the cost basis for waterway debris removal operations. By amending the contract, this will allow the Contractor to provide necessary debris removal services under the scope of work Agreement 15-6365 (Disaster Debris Management, Removal and Disposal Services). In doing so, the County can now choose from any of the three (3) awarded vendors under RFP 15-6365 to perform the contractual scope of services within Collier County waterways. Areas downstream of the Collier County Stormwater Management System have been identified as part of the ongoing Stormwater debris cleanup efforts. Those areas have historically been beyond the limits of regularly inspected segments of the system as they are the lower (downstream) reaches beyond the last water control structure. As a result of Hurricane Irma impacts, however, Stormwater Management staff is recommending these identified areas now be addressed due to their currently impacted condition. All locations have significant storm debris accumulation, have been determined critical for downstream stormwater conveyance and have potential for flow restrictions which could cause flooding in upstream basins. Work in these areas has been completed previously based on the same or similar needs with each case by case action being Board approved. Staff has been working with the Federal Emergency Management (FEMA) and National Resources Conservation Service (NRCS) on eligibility and availability of funding and/or reimbursement for debris removal activities in the areas listed below, however, no solution has been finalized. As stated above, due to the heavy debris in these areas, which will impede stormwater flows, there is a high risk for flooding in upstream basins. Therefore, the debris removal work must move forward, irrespective of funding determinations, to protect health, safety and welfare of Collier County citizens, businesses and visitors. Staff is recommending that the below areas be included in the Irma related storm debris clean-up work as funds and resources are available, pending approval of the contract amendment. The areas, with approximate cost estimates (upper limits), are listed below for the Board’s consideration. 11.D Packet Pg. 239 06/12/2018 Critical/Short-Term Areas: - Cocohatchee River/Palm River: Estimated Cost $1M - Rock Creek: Estimated Cost $2M - Lower Gordon River: Estimated Cost $3M - Haldeman Creek: Estimated Cost $1.5M Areas being assessed for longer-term solutions include Henderson Creek, Vanderbilt Finger Canals (silt), Horse Creek and US 41 Ditch from Naples Manor to Tomato Road. These areas do not present an immediate risk for flooding, and ultimate solutions may include debris removal grants, partnerships with other Local, State and/or Federal Agencies and public-private partnerships. Moving forward, Stormwater Management staff will advance an initiative addressing these areas as part of the overall system of stormwater management watercourses beginning with annual inspections. Proper conveyance of stormwater flows beyond (downstream) of the last water control structure is critical to the overall performance of the system upstream. This is true during and after storm events as well as during normal rainy season operations. Those areas will likely not require annual maintenance events. Those areas will however, need to be inspected annually and immediately following storm events. Maintenance event frequency in those areas is estimated to be once every eight to ten or more years. That work typically consists of tree, vegetation, debris and sediment removal. As directed, staff is prepared to establish inspection and management procedures creating a line item in the annual work plan funding oversight and management of these areas using knowledge gained from Hurricane Irma. FISCAL IMPACT: By amending this contract, Collier County can choose the best valued contractor to perform waterway debris removal and disposal services. Though value is not always directly related to overall costs, the agreed upon rates may be significantly lower than other awarded contractors. As noted above, although staff has been in constant contact with NRCS and FEMA, there is a risk that some or all of the waterway debris removal will not be reimbursed. GROWTH MANAGEMENT IMPACT: This item is consistent with the goals, objectives, and policies of all applicable sections of the Stormwater Management and the Conservation and Coastal Management elements of the Growth Management Plan. Kurtz, P.E., Principal Project Manager Stormwater Management Date: June 5, 2018 Subject: Post Irma Current Stormwater Management System Status Since Hurricane Irma staff has been working diligently to assess the storm related blockages in watercourses critical for providing flood protection level of service to the citizens. Many portions of the system have been cleared however, significant amounts of Irma related debris are still blocking essential stormwater management conveyance ways in Collier County. With the eminent start of the South Florida rainy season, hundreds of structures are currently at risk of flooding due to the lack of completion of the waterway debris cleanout effort. Significant amounts of Irma related waterway debris have not been addressed to date because staff is still awaiting authorization for debris removal in critical areas until the reimbursable funding assistance qualification process is complete. This process is long and complicated with no clear indication that cost reimbursement for waterways is eminent. Hurricane related debris, mostly downed trees, have the potential to impede surface water flows necessary to provide an adequate flood protection level of service in the upstream watershed service areas. The potential for increased flood risk caused by the existing debris has been documented. As Principal Project Manager for the Stormwater Management Section, it is my duty to inform you of this situation and to urge you to allow staff to move forward with additional work now. Staff will continue to pursue all available avenues for federal funding reimbursement, however, the debris removal mission cannot be delayed. 11.D.4 Packet Pg. 249 Attachment: Memo Hurricane Irma Debris - June 2018 (5798 : Amendment to CrowderGulf Agreement and obtain direction on critical areas of Capital Project Planning, Impact Fees and Program Management Staff stresses the importance of post storm conveyance system maintenance, regular directed maintenance - even in the downstream receiving areas, importance of maintenance in advance of the storm season (Storm Readiness), the nexus between good and proper conveyance system maintenance and providing adequate flood protection level of service (LOS), as a matter of public health, safety and welfare. We should not delay this critical work any longer. Hurricane Irma and last year's record wet season showed that well-maintained flood control systems are critical to protecting private property ensuring the maximum amount of flood protection available for Collier County residents.
