North Naples Fire Control and Rescue District's Certificate of Public Convenience and Necessity for Advanced Life Support non - transport services for one year and authorize the Chairman to execute the Permit and Certificate. OBJECTIVE: To receive approval from the Board of County Commissioners (Board) for the renewal of North Naples Fire Control and Rescue District's Certificate of Public Convenience and Necessity ( "COPCN ") for Advanced Life Support ("ALS ") non - transport services and authorize the Chairman to execute the permit and COPCN. CONSIDERATIONS: North Naples Fire Control and Rescue District is currently operating under a COPCN for ALS non - transport services. Section 10 of Collier County Ordinance No. 04 -12, as amended, allows renewal certificates to be approved routinely by the Board upon advice of the County Manager or designee. The Director of the Bureau of Emergency Services is the County Manager's designee. In addition, Section 10 provides that renewals be based on the same standards as the granting of the original COPCN along with such other factors as may be relevant. The minimum requirements for an application to be deemed complete are set forth in Collier County Ordinance No. 04 -12, as amended, Section 5. The application is back -up to this item. In accordance with Section 10 of Ordinance No. 04 -12, as amended, the Director of the Bureau of Emergency Services recommends approval based on his finding that there is a public necessity for North Naples Fire Control and Rescue District to provide the service and that all other requirements under Ordinance No. 04 -12 have been met. If this item is approved by the Board, the renewal COPCN and Permit will commence on January 1, 2013 and expire on December 31, 2013. FISCAL EVIPACT: A budget ammendment is. necessary to recognize the $250.00 application fee for the Certificate of Public Convenience and Necessity renewal and appropriate expenditure of the same amount within the EMS Fund 490. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact. LEGAL CONSIDERATIONS: The Ordinance allows the renewal COPCN to be approved routinely by the Board without a hearing. If a hearing is held the standards set forth in Ordinance No. 04 -12, Section 7 apply. Section 7 states: "The Board of County Commissioners shall not grant a certificate unless it shall find, after public hearing and based on competent evidence that each of the following standards has been satisfied: A. That there is a public necessity for the service. In making such determination, the Board of County Commissioners shall consider, as a minimum, the following factors: Packet Page -3825- 12/11/2012 Item 16.E.4. 1. The extent to which the proposed service is needed to iliprove the overall emergency medical services (EMS) capabilities of the County.,. 2. The effect of the proposed service on existing services with respect to quality of service and cost of service. 3. The effect of the proposed service on the overall cost of tMS service in the County. ke 4. The effect of the proposed service on existing hospitals other health care facilities. 5. The effect of the proposed service on personnel of existing services and the availability of sufficient qualified personnel_ in the local area to adequately staff all existing services. (2) That the applicant has sufficient knowledge and experience to properly operate the proposed service. (3) That, if applicable, there is an adequate revenue base 'for the proposed service. (4) That the proposed service will have sufficient personnel and equipment to adequately cover the proposed service area." Ordinance No. 04 -12, Section 8 provides: "In making the determinations provided for in Section 7 above, the Board may, in its sole discretion, appoint a Hearing Officer to hold a public hearing and to make factual findings and conclusions as a result of the hearing. Should a Hearing Officer be appointed, said Hearing Officer shall render a written report to the Board within 30 days of the hearing,, which report shall contain the officer's findings and conclusions of fact, and a reconXmended order. The findings and conclusions of fact shall be binding upon the Board, but the recommended order shall be advisory only." This item has been reviewed by the County Attorney, is legally sufficient, and requires a majority vote for Board approval. - JAK RECOMMENDATION: That the Board of County Commissioners: 1. The District has provided Advanced Life Support (ALS) first response non - transport in conjunction with the Collier Country Emergency Medical Services Department from 1999 to 2008. On February 8, 2011. the District received from the Board of County Commissioners a COPCN to provide ALS non- transport services Oil February 28, 2011 the district received its ALS provider licensure from the State of Florida Department of Health Bureau of Emergency � Medical Services. On April 1, 2011 the district began providing services after a successful site inspection by the State of Florida Bureau of Emergency Medical Services that revealed no discrepancies with State law and regulations. Since being Licensed, the district through its Medical Director has developed and implemented a comprehensive and challenging paramedic credentialing process that requires every paramedic seeking to provide AI.,S level patient care to successfully complete a40 hours protocol /skills review program. 1'lney must successfully pass with a written exam with a minimum score of 80 that is based on the Collier County Common Medical Protocol. (transport Level), prepared by a third party vendor, and administered and graded by Hodges University. Lastly, each paramedic must successfully complete a one -on -one scenario based review with the Medical Director. This internal credenti.aling process is valid for two years. Requirement for board approval in granting., certificate The board of county commissioners shall not grant a certificate unless it shall find, after public hearing and based on competent evidence that each of the following standards has been satisfied: (1) That there is a public necessity for the service. In making such determination, the board of county commission shall consider, as a minimum, the following factors: a. The extent to which the proposed service is needed to improve the overall emergency medical services (EMS) capabilities of the county. Section 2 of Article IV of the District's charter, as can, be found in chapter 99- 450, Laws of Florida, allows the District to establish and maintain emergency medical services and rescue response consistent with section 191-008(1), Florida Statues, chapter 401, Florida Statues, and any certificate of public convenience and necessity or its equivalent issued. The North Naples Fire Control & Rescue District has provided ALS first response non - transport services within its district boundaries for over 12 (twelve) years. The District continues to provide not only a high level of ALS service, but also augments the Collier County Emergency Medical Services Department, by improving its response time benchmarks to Emergency Medical Calls within the district. Recently, the District and Collier County EMS have met to discuss more efficient ways of deploying ALS resources within the District. In particular, the ability for EMS to recognize NNFD ALS non-transport resources when making decision on moving transport resources to cover zones. In other words, when an EMS transport N vehicle is transporting a patient and is leaving their primary zone but, a N I FD ALS non - transports: vehicle is in the zone and available by recognizing the NNFD ALS resource. It will minimize the need. for CCEMS to have to move another unit from another zone to cover. Hence, further improving response times. These discussions are ongoing and a more detail plan is being developed. b. The effect of the proposed service on existing services with respect to quality of service and cost of service. The NNFD ALS non-transport progranis, provides Collier County EMS and the residents of North Naples with additional highly trained EMT's and Paramedics that can provide both BLS and ALS care either prior to CCEMS arrival or while on scene with CCEMS. One of the most positive impact-, to the quality of care is the continued commitment of NNFD to add an additional highly trained E.MT/Paranledic during transport to the hospital of some of the most critical patients. These critically injured or sick patients are the ones that truly require an additional highly trained pair of hands to deliver the appropriate level of care and maintains a strict level of continuity of care. Since the inception of the NNFD ALS program in April 2010 North Naples has participated in 579 transports to the hospital utilizing over, 650 personnel. Packet Page -3835- 12/11/2012 Item 16.E.4. Delivering quality service is the highest priority for the District. One of the ways the district strives to always assure that it is providing such service is through its participation in a county -wide Quality Assurance Committee for non - transport providers. This committee is proving to be an excellent and valuable forum for the Collier County's Associate Medical Director, the District Medical Director and staff to exchange ideas, review current practices and develop quality indicators. This committee is in addition to the already robust internal state required Quality Assurance /Quality improvement program. This internal program is physicians driven and reviews 100 percent of all patient care report and treatments. Including, targeted patient outcome reviews and EMT and Paramedic credentialing status. c. The effect of the proposed service on the overall cost of EMS service in the county. Your continued support in granting the COPCN to the District for provision of ALS non - transport services has not only not incurred any additional cost to the current Collier County EMS department, but it can be said the addition of ALS non - transport services to NNFD has allowed CCEMS the flexibility to reassign units and personnel to other areas of the county in order to improve services. The District continues to stand firm that additional efficiencies and cost saving exist, and also continues to support the development of public forums which will encourage increased communications and expanded visions to further improve the n is delivery of Emergency Medical Care in Collier County. One example of our commitment is the Districts involvement in the current Collier County Public Safety Authority and the NNFD EMS council. 0 The North Naples Fire Control & Rescue District continues to be completely funded to provide the same level of Basic and Advanced Life Support service currently enjoyed by the residents and visitors to the county. The district continues to successfully enhance the existing level BLS and ALS services without affecting the cost of the Collier County EMS Department or its residents. This practice is expected to continue unless a change to the federal Government or county fee ordinance providing opportunities for billing for such services d. The effect of the proposed service on existing hospitals and other health care facilities. The North Naples Fire Control & Rescue District is home to two of the 4 hospitals within the county. The District has been providing both Basic & Advanced Life Support non- transport service for many years with no negative effect in the operations of either hospital. Consequently, 2 of the Districts 4 Associate Medical Director work at each of the two hospitals and they also serve on the NNFD Emergency Medical Services Medical Council which closely monitors the provision Packet Page -3836- 12/11/2012 Item 16.E.4. operations of either hospital. The Districts record of augmenting; and enhancing the level of care continues to be recognized by all members of the council.. c. The effect of the proposed service on personnel of existing services and the availability of sufficient qualified personnel in the local area to adequately staff all existing services. The North Naples Fire District currently operates I1 Basic Life Support and Advanced Life Support First response non- transport apparatus, 58 utilizing paramedics and 69 Emergency Medical Technicians. The District currently employs a sufficient number of Paramedics, and Emergency Medical Technicians to provide the level of service being requested. It shall have no impact on the staffing levels of the existing services. 2) That the applicant has sufficient knowledge and experience to properly operate the proposed service. The North Naples Fire District has been providing Fire and Emergency Medical Services within its boundaries since 1961, and Advanced Life Support non- transport services since 1999. Our management stall' has a combined over 80 years of experience in providing excellence in service to its community. The District responds to approx.iniately 6500 911 medical calls per year, providing each Paramedic with ample experience in the provision of both Basic Life Support and Advanced. Life Support. In addition, due to an almost n.orie existent employee turnover rate other than from a plan buy -out or normal retirement the district has a collection of some of the most experienced and tenured Paramedics in the county. Many of the districts most experienced paramedics originally came from the Collier County Emergency Medical. Services Department transport service All district Eii-IT's and Paramedics have to meet all State of Florida Department offlealth certification requirements. In addition, all District Paramedics before being allowed to perform in an ALS capacity must complete a comprehensive credentialing process which combines required didactical training, performance benchmarks, written exams, and one -on- one with the District Medical Director. This process must be completed every two years in order to be re- granted the privilege to practice at the ALS level. In order to ensure continued competency beyond the initial certification the District Medical Director has developed a benchmarkinfgr program which tracks the activity of every EMT and Paramedics and tracks their progress in achieving pre - selected critical skills and mandatory patient exposures. This program, is designed to ensure that .EMT's and Paramedics w =hich for whatever the reason did not receive the appropriate Level of exposure will be given additional training and skill exposures. This program is in addition. to the required Packet Page -3837- 12/11/2012 Item 16.E.4. credentialing process mentioned above. Paramedic's which fail to meet the expectation of the Medical Director are not allowed to practice. (3) That, if applicable, there is an adequate revenue base for the proposed service. The North. Naples Fire Control & Rescue District currently provides Advanced Life Support non- transport services within its district boundaries including areas covered through mutual an auto aide agreements. The District has consistently funded Dire Operations and Prevention services, as well as Basic Life Support and Advance Life Support non- transport services, utilizing its m.illage cap of 1 Mil. No change to this funding source is either necessary or expected. (4) That the proposed service will have sufficient personnel and equipment to adequately cover the proposed service area. The North Naples Fire Department currently operates 11 Advanced Life Support first response non - transport apparatus utilizing 58 paramedics and 69 EINTI's. The District has enough paramedics and EMT's to provide the level of service being requested. IMPACT r�EES.--The district board may allow 3 for the assessment and collection of impact fees for capital 2 improvement on new construction within the district' 3 (1) (a) It is hereby found and det.ertiiined that Collier 4 CoiE-ity is located in one of the fastest growin areas in the 5 nation, and new construction and the resulting population growth 6 are placing a strain upon the capabilities of the district to 7 continue to provide the_h�jq level of professional fire protection and related emergency services for which the residents of the district pay and which they deserve. 10 (b) It is readily that additional 11 equipment and facilities will- be needed to meet the expanded 12 commercial and residential growth within the district, at a 13 cost beyond that which can be -provided from current and 14 anticipated ad valorem tax revenues assessed, collected, and received by the district. _Lu (c) 17 - is hereby declared that the cost of-new 1,9 facilities and equipment for fire protection and related 19 emergency services shall be borne by new users of the 20 -district's services, to the extent that new construction 21 requires new facilities and equipment, but only to that 22 extent. 23 (d) It is, therefore the legislative intent to 24 transfer to the new users of the district's fire protection and 25 related. emergency services a fair share of the costs of new 26 facilities imposed on the district by new users, 27 (e) It is hereby declared that the amounts of 28 impact fees for capital improvement provided for in this 29 section are lust, reasonable, and e_jtIJLtLible, 30 (2) No person shall issue or obtain a building permit 31 for new residential dwellinq units or new commercial or 16 CODING: Words stricken are deletions; words underlined are additions. WFI'NESSETI -1: WHEREAS, each of the Parties maintains equipment and personnel f "or the suppression of fires and other emergencies within its own jurisdiction and areas; and WHEREAS, the Parties represent ten (10) fire suppression entities, or Agencies, in Collier County, consisting of one county fire department; two dependent tire districts of Collier County; two municipal fire departments, and five independent special fire control and rescue districts; and WHEREAS, no single Agency can command sufficient staffing and resources to handle all potential emergencies; and WHEREAS, in extraordinary circumstances, an Agency may not have sufficient manpower and resources to handle all possible emergencies: and l'at?e I of 7 Packet Page -3859- 12/11/2012 Item 16.E.4. NOW, THEREFORE, in consideration of the mutual covenants expressed herein, and for other good and valuable consideration, receipt of which is hereby acknowledged, the Parties agree as follows: GENERAL PROVISIONS: 1. All services performed tuider this Agreement shall be rendered without reimbursement of either Party or Parties and as provided for herein. ?, Any Party receiving a request for assistance shall respond to the request only to the extent that the available personnel and equipment are not required for adequate protection in the responding Agency's jurisdiction. The Fire Chief of the responding Agency, or their designee, shall have the sole authority to determine the amount of personnel and equipment, if any, available for assistance. Nothing; in this Agreement shall require any Agency to provide personnel or equipment to another Agency. 3. Each Party is authorized and directed to rneet and drafi any detailed plans and procedures of operations necessary to effectively implement this Agreement, Such plans and procedures of operations shall become effective upon ratification by the Parties. 4. Agencies responding under this Agreement. shall work under a recognized Incident Management System. OPERATIONAL ASSISTANCE: Operational Assistance shall mean assistance which is provided for fire suppression activities, rescue operations, emergency medical incidents or other emergencies, which exceed the capabilities of an Agency with jurisdiction to mitigate effectively. I . W11C11ever it is deemed advisable by the senior fire officer of an Agency or by the senior officer of any such agency actually present at an emergency to request assistance under Page 2of7 Packet Page -3860- 12/11/2012 Item 16.E.4. The Fire Chief, or his or her designee, ` at an Agency receiving the request shall forthwith take the following action: a. Immediately determine if apparatus, personnel or other requested resources are available and notify the requesting Agency of whether it is able to respond to the emergency; and b. Determine what apparatus, personnel, or other requested resources are available to respond, so that the utilization of apparatus, personnel and other resources can be performed safely and efficiently; C. Notify the requesting Agency of the amount of apparatus and personnel being deployed to the emergency in order for the requesting Agency to make additional requests of other Agencies, if and as necessary. Z. A request for assistance shall specify the type and amount of resources needed. Requests may include, but are not Limited to, manpower, engine companies, ladder companies, tanker companies, special services /equipment resources (e.g., portable cascade system, hydraulic . tools, brush vehicles, rescue vehicle, etc.). A request for assistance shall also specify the location ' to which the resources mentioned above are to respond and to whom they are to report. 3. Personnel responding to a request for assistance shall be under the direction and control of the Incident Commander of the requesting Agency. Should the need arise, the responding Agency may request at any time the recall of apparatus, personnel, equipment and other resources, not actively involved at an emergency incident. 4.- The incident Commander will make every effort to release mutual aid apparatus, personnel, equipment and other resources, and return said apparatus, personnel, equipment and other resources to their respective Agencies as soon as conditions permit. S. Parties to this Agreement shall not respond outside of their area of responsibility (AOR) into another agency's AOR, unless requested by that Agency's duly appointed or elected oflicial. or as this Agreement or additional Agreements may permit. If an Agency is unknowingly dispatched into another agency's AOR, the responding Agency, upon realizing they are entering (or already in) another Agency's AOR, shall, as soon as possible, notify the dispatching Agency of the dispatching error and advise the dispatching Agency to notify the appropriate Agency. An Agency responding as described above, shall follow their Agency's protocol for the situation, keeping in mind the best interest of life safety and property conservation. 6. A request for assistance made pursuant to this Agreement shall specify the type and a,nount of resources needed. Each Party operating under this Agreement shall be responsible for maintaining records of all incidents involving their participation. POWER, PRIVILEGES AND IMMUNITIES- Whenever, pursuant to the terms of this Agreement, a responding Agency is performing services in a requesting Agency's jurisdiction, the responding Agency shall have the same powers, duties, rights, privileges and immunities as if they were performing those services in the jurisdiction ill which they are non -rally employed, and as provided by applicable law. The privileges and immunities from liability, exemptions from laws; ordinances and rules; and other pension, insurance, relief, disability, worker's compensation, salary, death, and other benefits that apply to the activity of such responding Agency, as when performing their duties within their Agency's jurisdiction, shall apply to them to the same degree, manner and extent while engaged in the performance of services extraterritorially under the provisions of this Agreement, and as provided by applicable law. LEGAL STATUS OF PERSONNEL AND EQUIPMENT: Nothing in this Agreement shall be deemed to create an employment or agency relationship between personnel performing services extraterritori ally pursuant to this Agreement and the municipal or other jurisdiction in which those Services are actually performed. Similarly, nothing in this Agreement shall be deenhed to transfer any legat or equitable title to any apparatus, equipment or other resources utilized pursuant to this Agreement. LOSS OR DAMAGE TO EQUIPMENT: Each Party to this Agreement waives all claims against the other party or parties for �i compensation for any loss or damage occurring as a consequence of the performance of this Agreement. An Agency providing assistance under this Agreement shall bear the cost of any loss or damage to that Agency's property or equipment as a result of the use of such property or equipment in providing assistance under this Agreement, provided that such. act of loss or damage does not result fi-om gross negligence on behalf of the requesting Agency. 0 STAFFING COSTS: An Agency furnishing assistance pursuant to this Agreement shall compensate its responding members during the time of the rendering of such assistance, and shall defray the actual travel and maintenance expenses of such Agency's members while they are providing such assistance. The Agency furnishing; assistance shall also pay any amounts due for compensation as a result of the personal injury or death of any Agency's responding member while rendering; assistance. LIABILITY AND INDEMNIFICATION: While operating; under the terms of this Agreement, each .Party shall bear liability as provided by applicable law rind the terms of this Agreement. Each Party shall be liable for its own actions and negligence and, to the extent permitted by late; each Party shall inderrinify, defend and hold harmless the other Parties against any actions, claims or damages arising out of negligence in cotuiection with this Agreement. The foregoing; indemnification shall not constitute a waiver of sovereign immunity beyond the limits set forth in Section 768.28, Fla. ,Slat., nor shall the same be construed to constitute agreement by any Party to indemnity another Party for such other Party's negligent, willful or intentional acts or omissions. INSURANCE: Each Party shall provide and carry liability insurance, worker's compensations insurance and other insurance necessary to insure that each Party is be protected and indemnified from any and all liabilities which may result from activities undertaken pursuant to this Agreement. EFFECTIVE DATE: This Agreement shall be effective from the date that the last Party executes this Agreement and shall continue in full force and effect for four (4) years. Prior to the expiration of this term, the Agreement shall be reviewed and then renegotiated and amended, if necessary. Absent amendment to the Agreement, the terms of this Agreement shall be automatically renewed in four (4) year periods. A cancellation by any Party to This Agreement prior to the initial four (4) year term or any subsequent 1bur (4) year term shall be effective only with respect` to that Party. CANCELLATION; Any Party to this Agreement may withdraw or cancel such Party's participation, without liability to any other Party, by providing ninety (94) days prior written notice of such withdrawal or cancellation to all other Parties. The withdrawal from, or cancellation of, this Agreement shall be effective only regarding that Party. and this Agreement shall remain in hull force and effect regarding the remaining Parties that have not provided written notice of withdrawal or cancellation.
