EXECUTIVE SUMMARY Recommendation to approve Petition VAC-PL20120001606, to disclaim, renounce and vacate the County and the Public interest in a portion of State Road No. 29 (a.k.a. Copeland Avenue South) a 200-foot public road right-of-way, being a part of Section 23, Township 53 South, Range 29 East, Collier County Florida being more specifically shown in Exhibit A. OBJECTIVE: To adopt a Resolution to vacate the County and the Public interest in a portion of State Road No. 29 (a.k.a. Copeland Avenue South) 200-foot Public Road Right of Way, being a part of Section 23, Township 53 South,Range 29 East, Collier County Florida. CONSIDERATIONS: Petition VAC-PL20120001606 has been received by the Engineering Services, Growth Management Division, Planning and Regulation from A. Rony Joel, representative for owner, Sammy Hamilton, Jr. This vacation request is intended to vacate a part of State Road No. 29 (a.k.a. Copeland Avenue South) 200-foot Public Road Right of Way, so the owner can properly repair and maintain the existing asphalt parking area that is used for his business. Letters of no objection from abutting property owners have been received from all who responded. Certified mail receipts exist for those who elected not to respond. FISCAL IMPACT: Growth Management Division, Planning and Regulation staff has collected a$2,000 "Petition to Vacate" fee from the petitioner which covers the County's cost of recording and processing the Petition. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. ENVIRONMENTAL ISSUES: There are no outstanding environmental issues. HISTORICAL/ARCHAEOLOGICAL IMPACT: There are no historical or archaeological impacts. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is legally sufficient, and requires majority support for approval. - JAK RECOMMENDATIONS: That the Board of County Commissioners; 1) approves the attached Resolution, relating to Petition VAC-PL20120001606, which will vacate the County and the Public interest in a portion of State Road No. 29 (a.k.a. "Draft approval letter: Collier County Transportation Staff approves partial vacation of the Right of Way along this property frontage. The approximate dimension of the vacation is 50'x 80'(a subset of the approximate 50'x100'site frontage). However Collier County wishes to retain ownership rights over the Southerly 50'x 20'of ROW fronting the applicants property. Regarding the Northerly+/-80': Staff supports vacating ownership rights over this portion of ROW, with a caveat that an ingress/egress easement be retained for the Public over this area,for use by County/State/Federal agencies to gain access to the remainder 50'x 20'area along the Southerly portion of the site.
