EXECUTIVE SUMMARY
Recommendation to approve an amendment to the Community Development Block Grant
Agreement between Collier County and David Lawrence Mental Health Center, Inc. by extending
the grant agreement period, requiring compliance with HUD Grant B-11-UC-12-0016, and
updating the project work plan.
OBJECTIVE: Allow for a grant extension to accommodate unexpected project delays and require
compliance with the County's Funding Approval/Agreement with U.S. Department of Housing and
Urban Development.
CONSIDERATIONS: On October 25, 2011, Item 16D2, the Board of County Commissioners (Board)
approved a subrecipient agreement with David Lawrence Mental Health Center, Inc. (DLC) for the
purchase and installation of an emergency back-up generator as more fully described in Scope of Services
of the subrecipient agreement. The generator project is funded by HUD Grant B-I1-UC-12-0016. On
April 24,2012, Item 16D2,the Board approved a first amendment to the subrecipient agreement to reduce
the contract amount and modify the Scope of Services.
On September 27, 2012, DLC sent staff a letter requesting an extension of the project completion date set
forth in the subrecipient agreement. The letter is back-up to this item and states that the delay is due to
Florida Power and Light's very recent determination that the existing transformer must be upgraded to
accommodate the generator. The letter further states that the generator will be installed by the October
24, 2012 project completion deadline,but, it will not be operational until the new transformer is installed.
The terms of the proposed amendment to the subrecipient agreement do not conflict with HUD Grant B-
11-UC-12-0016. Approval of the subrecipient agreement will not negatively impact the County's HUD
timeliness ratio.
The proposed amendment:
1. Extends the completion date of the project to March 31,2013 (Paragraph III);
2. Requires compliance with HUD Grant B-11-UC-12-0016(Paragraph III);
3. Updates the Project Work Plan. (Exhibit"A" Scope of Services);
FISCAL IMPACT: No general funds are associated with this item. The amount of grant funds and
budget for DLC's project will not increase. Accordingly, there is no fiscal impact associated with this
item. 2011-2012 CDBG Funds are located within Housing Grants Fund(705),Funded Program 33176.
GROWTH MANAGEMENT IMPACT: Acceptance and implementation of this amendment will
further the goals,objectives and policies of the Growth Management Plan's Housing Element.
LEGAL CONSIDERATIONS: Language requiring compliance with the grant was inserted by the
County Attorney's Office and will be added to future templates and amendments, as necessary. This item
is legally sufficient and requires a majority vote for Board action. -JBW
RECOMMENDATION: To approve and authorize the Chairman to sign an amendment to the
subrecipient agreement with David Lawrence Mental Health Center,Inc.

It has just come to our attention that we will not be able to meet the current October 24,2012
deadline,and therefore we are asking for an extension to March 31, 2013. We are requesting this
extension because FPL will not approve the existing plans proposed by the electrical engineer.
FPL is now requiring us to upgrade the existing transformer. They had not made this known to us
until last Friday, so this delay is beyond our control.
Although the generator will be installed and wired to go prior to the Oct 24 deadline, we will not
be allowed to operate it until the new transformer is also installed. This is estimated to be about
16 weeks from now. Our request will be for 20 weeks, to allow some time for unknown delays.
A new Project Work Plan has been submitted below for your review. Sorry for the
inconvenience, and please call with questions.

This Second Amendment, is entered into this day of , 2012, by and
between David Lawrence Mental Health Center, Inc. d/b/a/ David Lawrence Center, a private not-for-
profit corporation existing under the laws of the State of Florida, herein after referred to as
SUBRECIPIENT and Collier County, Florida, herein after to be referred to as "COUNTY,"
collectively stated as the "Parties."
RECITALS
Whereas, on October 25, 2011, the County entered into an Agreement with David Lawrence
Center for Community Development Block Grant Program funds to be used for the purchase and
installation of an emergency back-up generator(hereinafter referred to as the "Agreement"); and
Whereas, on April 24, 2012, the Parties amended the Agreement to add compliance language,
and to modify the Scope of Services and work plan; .
Whereas, the Parties desire to further amend the Agreement to extend the time of performance
and modify the Project Work Plan.
NOW THEREFORE, in consideration of the foregoing Recitals, and other good and valuable
consideration, the receipt and sufficiency of which is hereby mutually acknowledged, the Parties agree
to amend the Agreement as follows:

III. TIME OF PERFORMANCE
The effective date of the this Agreement between DLC and Collier County shall be October 25,
2011. The services of the SUBRECIPIENT shall comply with all terms and conditions of HUD Grant

April 1, 2013. Any funds not obligated by the expiration date of this Agreement shall automatically
