EXECUTIVE SUMMARY Recommendation to adopt a Resolution authorizing a public hearing to consider vacating a portion of the southerly 5 feet of an existing 10 -foot utility easement located in Lot 1, Block I, Gulf Acres, as recorded in Plat Book 1, Page 111, of the Public Records of Collier County, Florida. - Application No. VAC- PL20120001426. OBJECTIVE: Pursuant to Section 177.101, Florida Statutes, the Board of County Commissioners must authorize a public hearing to consider the vacation of a portion of a plat. CONSIDERATIONS: Petition VAC- PL20120001426 has been received by the Engineering Services, Growth Management Division, Planning and Regulation from Maria Rojas as agent for owner, James Ramos. This is a request to vacate a portion of the southerly 5 feet of the existing 10 -foot utility easement (Exhibit "A "), where the existing house (built in 1969) was constructed in error over the southerly part of the 10 -foot utility easement. The public hearing will be advertised in a local paper of general circulation pursuant to Resolution 2006 -160 and Section 177.101, Florida Statutes, and the adjoining property owners will be given notice. FISCAL IMPACT: The application fee of $2,000.00 covers staff review and processing. The Applicant is also responsible for advertising fees. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is legally sufficient, and requires majority vote for approval.
