EXECUTIVE SUMMARY Recommendation to approve the annual rate resolution to establish the fees, rates, and charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees, recycling drop-off center fees, and residential multi-family and commercial waste collection fees for FY13. This resolution adopts the rates that fund the FY13 Budget for solid waste collection and disposal. OBJECTIVE: Approve the annual rate resolution setting landfill tipping fees, recycling drop-off center fees, and residential multi-family and commercial waste collection fees for FY13. This resolution adopts the rates that fund the FY13 Budget for solid waste collection and disposal. CONSIDERATIONS: The Solid and Hazardous Waste Management Department's budget primarily is based on the annual mandatory trash collection and disposal assessments and user fees for the Collier County Landfill, the Immokalee Transfer Station and four recycling drop-off centers (Marco Island, Naples, North Collier and Carnestown). These fees are critical to sustaining the Board of County Commissioners' (Board)-approved Enduring Guiding Principles, which provide directives toward obtaining best value solutions, preserving valuable landfill (disposal) airspace, and the proper disposal of solid waste generated in Collier County. There are no increases proposed to existing tipping fees or to basic residential collection assessments. The fees outlined in the rate resolution support the Solid and Hazardous Waste Management Department's FY13 Budget approved by the Board at the September 20, 2012, budget meeting. These rates reflect budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the wide range of waste generated in the county. Waste collected throughout Collier County includes municipal solid waste taken to the landfill and recyclable materials taken to the drop-off centers, biomass, construction and demolition materials, tires, electronics, household hazardous waste, cardboard, white goods, and furniture. The rate resolution provides the correct funding to retire costs associated with the demands for solid waste disposal, while planning for the future recycling and solid waste needs of our community. Residential solid waste collection services in Collier County include twice a week trash pickup, once a week recycling pickup, on demand bulky item and electronics pickup, once a week biomass (yard) waste pickup, and guaranteed recycling services. Residential curbside rates for FY13 will remain the same as the FY12 rates; $173.49 per residential unit for District I (greater Collier County), and $165.28 per residential unit for District II (Immokalee and northeastern Collier County), as approved by the Board as Agenda Item 17A at the September 11, 2012 meeting. The solid waste disposal service costs are supported by landfill tipping fees and the volume of disposed waste. The recycle drop-off center and landfill tipping fees will remain the same as the 2012 rates. On June, 12, 2012, Agenda Item F8, the Board approved the restructuring of departments within the Public Utilities Division including the assimilation of the Pollution Control Department's Hazardous Materials Group into the existing Solid Waste Management Department. The restructuring enhances high quality, best value services to the residents of Collier County and Packet Page-2357- 9/25/2012 Item 16.C.2. provides enhancements for proper disposal of hazardous waste in accordance with local, state and federal guidelines. FISCAL IMPACT: The proposed landfill tipping fees and recycling center fees will provide estimated FY13 revenues of $14,291,200 for the Solid Waste Disposal Fund (470). The mandatory trash collection and disposal assessments will provide estimated FY13 revenues of $19,028,100 for the Mandatory Trash Collection Fund (473). LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office, is legally sufficient for Board action and only requires a majority vote for approval—SRT. GROWTH MANAGEMENT IMPACT: This rate resolution is in compliance with the Growth Management Plan, which provides for increased recycling and reuse of the solid waste stream. RECOMMENDATION: Approve the annual rate resolution to establish the fees, rates, and charges for the use of Collier County Solid Waste Facilities, including landfill tipping fees, recycling drop-off center fees, and residential multi-family and commercial waste collection fees for FY13, and authorize the Chairman to execute the Resolution. RESOLUTION NO. 2012- RESOLUTION SUPERSEDING RESOLUTION 2011-172 AND ESTABLISHING THE FEES, RATES AND CHARGES FOR USE OF COLLIER COUNTY SOLID WASTE FACILITIES PURSUANT TO COLLIER COUNTY ORDINANCE NO. 84-31 WHEREAS, under the authority of Chapter 403.706, Florida Statutes, Collier County has the responsibility and power to provide for the operation of solid waste management facilities to meet the needs of all areas of the County; and WHEREAS, said statutory authority grants the Board of County Commissioners the power to prescribe, fix, establish and collect fees, rentals or other charges for the use of the established solid waste disposal system and to pledge such revenues as security for the payment of bonds issued under said statutory authority for the construction of a solid waste disposal facility; and WHEREAS, Florida Statutes, Section 125.01(k)(1) and (2) grants the Board of County Commissioners the power to provide and regulate waste collection and disposal; and WHEREAS, The Board of County Commissioners through its adoption of County Ordinance No. 84-31 has implemented the user fee system for Solid Waste to all public and private users. WHEREAS, these rates reflect budget guidance and provide the appropriate fees necessary to collect, process, recycle, and/or dispose of the County's wide range of generated waste. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION 1: Resolution No. 2011-172 is hereby superseded in its entirety.
