OBJECTIVE: Pursuant to Florida Statute 336.09, the Board of County to consider the vacation of a portion of any public road. CONSIDERATIONS: must authorize a public hearing The Engineering Services Department has received a re q est from A. Rony Joel, PE, as Agent for the adjacent property owner to vacate a portion of Copeland Avenue South. The proposed vacation is for a portion of Copeland Avenue South which is not utilized as roadway. The hearing will be advertised in a local paper of general circulation pursuant to Statute 336.10, and the adjoining property owners will be given notice as well. FISCAL IMPACT: The application fee of 52,000.00 covers staff review and for advertising fees. GROWTH MANAGEMENT IMPACT: There is no Growth Management Impac-_. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is for approval. WHEREAS, Petitioner, A. Rony Joel, has requested that a public hearing be held pursuant to Sections 336.09 and 336.10, Florida Statutes, to consider disclaiming, renouncing, and vacating the County and public interest in a. portion of State Road 29, also known as Copeland Avenue South, which is a 200 -foot public road right -of -way more specifically described in Exhibit "A," attached hereto; and WHEREAS, Petitioner does hereby request that the Board of County Commissioners take appropriate action, including the adoption of a resolution setting the date and time of a public hearing to consider disclaiming, renouncing, and vacating the County's interest in the above described right -of -way.
